 The year 2017 was years for stability for Peoples’ Vigilance Committee on
Human Rights (PVCHR) and Jan Mitra Nyas as now it has own program
office after 21 years of its foundation. The office was inaugurated on the
auspicious the occasion of ‘International Human Rights Day i.e. 10
December, 2017 by Acharya Mritunjay Tripathi and Mufti Haroon Rashid in
the presence of the several senior officials and dignitaries. The office was
named as as “Helma Richa Centre for Human Dignity” in the honor to Ms.
Helma Ritscher, Chairwomen of Indo- German Society of Reimschied for
her tireless work and support for the marginalized children in India.

Helma Ritscher said, “The occasion was emotionally moving for her. The
Centre would is touted to becoming the focal point of the joint social activities
and educational projects of PVCHR / Jan Mitra Nyaas , community of
Varanasi and Baghvanala and Indo-German Society of Remscheid (Germany).

Helma Ritchers son Excel Ritscher observed his mother was a living
example of espousing deep human values. He said, “I call her ‘Mahatma
Maa’ for her continuous and unabated work in India,”

German Member of Parliament Sven Wolf and Social Democratic Party’s

regional chapter of the German state of Rhine-Westphalian congratulated
and said that centre would be pivot to human rights protection.

This center was constructed by PVCHR / Jan Mitra Nyas with the support
from Indo- German Society of Remscheid and the land was donated by by
Urmila Singh, the mother of the organisation’s managing trustee Shruti
Nagvanshi.

The book Justice Liberty and Equality “Dalits in Independent India”

published in Hindi by the Frontpage publication. PVCHR in joint
collaboration online news portal Different Truth launched campaign on the
issues of bonded and women rights.

Jan Mitra concept where there shall be no violation of civil rights granted to a
citizen by the state.

OUR MISSION

To provide basic rights to all, to eliminate situations, which give rise to

exploitation of vulnerable and marginalized groups and to start a movement
for a people friendly society (Jan Mitra Samaj) through an inter-institutional
approach.

Working locations: Intensively in Eastern (Varanasi, Jaunpur, Sonbhadra,

Allahabad, and Ambedkar Nagar) and western (Aligarh, Moradabad,
Meerut, Badaun and Aligarh) regions of Uttar Pradesh and Koderma
district of Jharkhand. Through networking working in 16 states of India
with Involvements of 99 organizations.

Service Delivery – Programme

The activities were implemented on the basis of the five

comprehensive programsi following the strategic plan of PVCHR/JMN
for three years (2015- 2018):

o Psycho- social support through testimonial therapy to 127

survivors of torture and follow-up of the survivors on the basis of
the WHO I 5 and participation scale. In exposing the complex
interconnections between marginalization, narration, and
reconciliation, the work of PVCHR sheds light not only on systems of
elite oppression of marginal communities but also on the power of
story to create social change. By building “memory justice” and what
we may call identity justice through challenging existing narratives
and discursive relationships, narrative therapy can be a
revolutionary means to societal change for the marginalized. Hearing
the stories of “others” can have the social effect of not only empathy
but a desire to increased action. Stories themselves act and focusing
on their agency as a resource can have transformative social
outcomes. Humans talk in stories and stories talk for collectives. If we
listen, change, however slowly, will come to those working to
overcome oppression and develop reconciliation.

o 15 survivors of torture received Ayurveda treatment Panchkarma for
pain management ·

o Legal Support: 31 cases in districts and high courts.

o 587 Meta – Legal with the allied system through using email as a cost
effective tools for the intervention. In 38 cases Hon'ble Commission
ordered for the compensation of 8,096,150 INR (127029 $)

o 39 Folk School and Honor Ceremonies for making people aware

about D.K Basu Guideline in Hazaribagh and koderma districts of
Jharkhand and Varanasi, Sonbhadra and Ambedkar Nagar districts of
Uttar Pradesh. In the folk school 1380 people participated in which
673 are female and 707 are male.

o Provided emergency support to Junaid and Sahil two juvenile

tortured by the police and also provided 56 blankets to the survivors
of police tortureii The project also provided transportation assistance
to survivors of the legal investigation.

o Providing duniyabi talim (Education for life) and ITE to 3981

children (2192 Male and 1789 Female) in 20 Madarsa of Bazardiha
and Lohta

o On 13th May, 2017 200 bags were distributed to the poor students in
Bazardiha.

o In 2017 8 summer camp were held in Baghwanala and Bazardiha in

the joint collaboration of Banaras school of Art. In the camp children
learned and practiced art, cartoon, craft, clay toys and wall news
paper.

o On 5th June, 2017 – 8th June, 2017 four days perspective building
workshop on adolescence health, rights, education and health
organized in Baghwanala, Varanasi. In the workshop Ms. Parul

 Sharma trained 120 adolescence girls on the issue of human rights,
gender, education and health.

o Working with 6156 children between age group 0 – 18 years and

3663 women on the maternal and neo dalit health on 48 villages and
slums of Varanasi district. Directly monitoring 1875 children
between age group 0- 5 years and 185 pregnant mothers.

o Rescued and rehabilitation of 255 bonded labours and child labour

in Uttar Pradesh

o Intervened in the 143 cases of domestic violence and provided psycho- social
support through testimonial therapy to 57 survivors of domestic violence.
Most of the cases were referred to Asha Jyoti Kendra.

o Awarded scholarship to 130 girls and 2 boys from most marginalized

communities to continue their further studies with support from Parul Sharma
and Raj Dulari Foundation.

o Intervened in 5444 call received in Childline line Collab in Badaun

district of Uttar Pradesh.

o PVCHR had 22 active youth groups in Varanasi. The 100 participated

the I – Bikethon organized by I- Next daily Hindi Newspaper.

Interface with different stakeholders: On 9th January, and January 21,

2017 organized in Hotel Kamesh Hut, Lahurabeer, Varanasi and Labour
department in Jaunpur. During the stakeholder the discussion was on the
problem and challenges faced in the implementation of the
Bonded Labour Act, Juvenile Justice Act and Child LabourAct and IPCs. The
Labour commissioner informed about the work done by the labour
department in one year.

'Cognizance 2017’: PVCHR was social partner in the 'three days

Cognizance 2017' at Indian Institute of Technology (IIT) Roorkee
(https://www.iitr.ac.in/) from 22 - 26 March, 2017.. In the cognizance the
participants and presented the work of PVCHR before 45000 students from 506
colleges.

 Dance with color: On 18th February, 2018 PVCHR in joint collaboration of
Kalagan Foundation and Benaras School of Fine Art organized “Dance with
color with support from Sir Dorabji Tata Trust”. The motive behind
organizing the program was to strengthen child participation, motivating
creative and creative expression in children. In this therapy around 100 of
the marginalized from the urban slum (Baghwanala and Bazardiha) of
Varanasi participated. Through this workshop children learned the
importance of the colour and how it affects the person mood, physical and
mental health.

Atrocities and Human Dignity: The seminar on ‘Atrocities and Human

Dignity’ was held under the aegis of PVCHR , IRCT and Sanjha Sanskriti
Manch. The chief guest of the seminar, Yogesh Dubey, state commissioner
Hindustan Scouts and Guides and special executive officer (Maharashtra
government) said the Human Rights Day should be observed as a national
festival. He said as human beings, we should be aware of human rights and
always strive to protecting it for ourselves and others, so that every person
lives with dignity as provided under the Constitution. Besides to propagate
its concept in society, the government should compulsorily introduce it in
the academic curriculum. Others present in the seminar viz. Ballabhacharya
Pandey, Dr Mohd Arif, Sandhya Jha, Dr Mahendra Pratap, Lal Bahadur Ram,
Prof Saina Rizvi, Ragib Ali, Dr Iftekhar, Idrish Ansari, Lallan Jaiswar,
Rajendra Kumar etc also shared their views on human rights and stressed
its protection.

o PVCHR submitted its comment to UN SR on water and sanitation during his

Breaking domestic violence:

PVCHR with the support of Parul Sharma and Raj Dulari Foundation
provided scholarship to Jyoti Seth to continue her further studies.
Jyoti is now working as teacher in private school. PVCHR wrote
letter to Chief Minister of Uttar Pradesh for allotting house to her
Urban Housing mission. The complaint is in the process. Once the
village head denied and wrote that she is survivor of domestic
violence and she is looking her case in family court from her paternal
house. After again intervention the

health

On 11th November, 2017 Anita labour pain

started. She called ASHA. Immediately she
came and called on helpline no 102. However
Anita delivers the child at the home with the
help of ASHA health worker. Within one hour
she feed Colostrum to child. The child weighs
2.5 Kg. ASHA worker and JMN activist advised
for only breast feeding till six month. Also, it
was also told that water should not be given
separately besides milk, there is a lot of water
in mother's milk.

Anita husband work as daily wages labourer and hardly earn 3000 INR in a
month. Anita owns the ration card and she bought ration at nominal price.
The child is registered in ICDS center and get gets nutrition diet from the
center.

Hope for child survivor of police torture

In the case of Sahil Nut chargesheet against accused has been filed in the
court on 5th June, 2018 against the accused. The case is being advocated by
our lawyer in the court of Judicial Magistrate – I, Varanasi court. The
accused is not present in the court on the prescribed several dates. On 28th
October, 2017 the court issued bail able warrant of 20,000 INR for the next
date 21st December, 2017.

Sahil Nut is resident of Newada Natan Basti Sunderpur in Lanka area was
tortured and kept under detention for whole night. Sahil is 10 years old son
of Sanjay Nut.

It is alleged that Sahil is a beggar and on 21 May 2013 he ran after a

women seeking alms and received 2 Rupees from her. She later complained
to the police that boy stole her large cheque of large amount. The next
morning she informed the police that she has founded her missing cheque.
Sahil was taken to the police station. The police officer also beat him up
black and blue and intimated to give electric shock. He was detained in
police station whole night and next day he was released. One person gave

600 INR to his mother who took her to hospital to got treatment to Sahil.
His father is also intimidated by police. Another day his story was
published in local Hindi newspaper.

PVCHR/JMN filed complained to National Human Rights Commission

(NHRC), National Commission for Protection of Child Rights (NCPCR) and
different forum of Government. NHRC took cognizance (Case no:
20381/24/72/2013) in this matter and issued notice to Chief Secretary
and police department. The matter was being investigated by Additional
Superintendent of police from Gazipur district i.e. another district of Uttar
Pradesh. On the police investigation report NHRC order for action against
responsible police officials and interim protection.

PVCHR provided psycho- social support through testimonial therapy to

Sahil’s parents in 2017 and counseling to Sahil. PVCHR/JMN also provided
assistance to himiii. Case has been against involved police officials crime no.
238/13 under section 452/323/504/506 IPC and 3 (I) X SC/ST Act.
Departmental disciplinary action initiated action against the delinquent
police personnel, who were allegedly involved in beatings, intimidating and
unlawfully detaining the victim boy at the police station.

Breaking sackle of trafficking

Life took a serious turn for 15-year-old Radha (name changed), when her
relatives sold her to a brick kiln owner in Kerakat town in Jaunpur district
of Uttar Pradesh in January 2012. Radha was sexually abused by the brick
kiln owner Baju Yadav for more than two months. Radha is a resident
of Chakradharpur in Singhbhum district, Jharkhand.

In her testimony, she said, “I was with my family when a woman

called Shanti visited us and told me to come with her. She was from the
same village so I trusted her. She said she was going to take me to a fair. But
this woman had tricked me and forced me to go to the brick kiln factory.
There I had to work for the owner, doing his cooking and cleaning, and
also massage him. Two days after I arrived he forced himself on me. He
used to give me a tablet, then he would force himself on me. My room was

next to where the owner worked and every time he wanted me, he would
come to my room.

He would come two or three times a day. I told that woman Shanti that I
didn’t like it, and she said that if I told anyone, the owner would kill me.
One day I opposed it, and the owner beat me up brutally. I was so scared.
The brick kiln owner was in his sixties, had no teeth, used to drink a lot, and
force me to drink alcohol as well. When I refused, he used to hit me. I’m still
in pain from the rapes.”

When Radha reported her ordeal to Shanti Devi, she rebuked Radha and
warned against reporting the incident to anyone else. Shanti Devi has been
working at Baju Yadav’s brick kiln for the past seven years and also had
illicit relations with him. Unable to bear the trauma, on March 20, 2017,
Radha somehow managed to flee from Baju’s brick kiln and reached
her relative Palu Devi’s house living in the same village.

After that, a chain reaction started and resulted in the accidental death
of Battan Mushahar. The case reached to the People Vigilance Committee
on Human Rights (PVCHR), which helped Radha and Paulo Devi family to
flee from a hiding place. To ensure the safety of the girl and those of her
relatives, they had short shelter in PVCHR office. PVCHR took up the case of
Radha to the National Human Rights Commission, the National Commission
for Protection of Child Rights, the National Commission for Women, New
Delhi, the National Schedule Caste Commission, the Chief Minister
of Uttar Pradesh and Jharkhand. They also approached the SHO- Kerakat,
District Magistrate Jaunpur, the superintendent of police – Jaunpur and
filed Right to Information applications asking for further details about the
case.

Radha, in her interview to human rights watch for the report “Breaking the
silence Child Sexual abuse in India” says that an improperly conducted
medical examination in Varanasi after she was repeatedly raped in
February and March 2012 is impeding her legal case. They took her to the
police and to a hospital, where a doctor carried out a medico-legal “two-
finger test.”

Radha, with the support of PVCHR, is challenged the doctor’s findings. In

September 2012, the police in her home district in Jharkhand agreed that
Radha’s testimony could form the basis of a charge against her alleged
assailant. After intervention FIR was
lodged against Shanti Jamuda (ii) Baiju Yadav in crime no. 135/2012 u/s

372/ 374/376/34 IPC and 3(3)(6) SC/ST Act
against Shanti Jamuda and Baiju Yadav.

The case after an investigation had been submitted to the court for trial. A
case u/s 304A IPC was registered at crime no. 136/2012 at PS Kairakat on
March 21, 2013, against Bejnath, Rajmath, Gulab and Dinesh. A charge
sheet was submitted on May 9, 2012, and the matter is sub judice in court

The Inspector general police – Varanasi had submitted a report to the

NHRC on February 20, 2017. The DIG Zone got the enquiry conducted by
SP Jaunpur, and an additional SP Rural report had been submitted.

According to the report, there are allegations that Ms Radha Jamuda d/o
Saluda was kept bonded Baiju Yadav and sexually exploited. However,
these claims were overlooked by SI Sabhajeet Singh,
HC Satya Dev Srivastava and Gurdip Singh Sarna, the then
Inspector Kherakat. Radha was not examined, they tried
to conceal the offence and committed a breach of duty.

The enquiry officer found HC Satya Dev Srivastava,

SI Sabhajeet Singh and Inspector Gurdip Singh Sarna guilty of dereliction of
duty and for not registering the case under the relevant provision of
law and case under 166A IPC had been registered against the police
officers.

There are facts in the report dated February 20, 2017, submitted by IGP
Varanasi report dated that a complaint was
lodged by Surender s/o Sehli r/o Triyani, PS Kairakat,
District Jaunpur, regarding the death of his son Bunti in an accident on
March 21, 2017, and case no. 136.2012 u/s 304A IPC was
registered against the Bejnath, Rajmath, Gulab and Dinesh in which charge
sheet was submitted.

On the report of Additional SP Jaunpur, the same is

under reinvestigation u/s 173(8) Cr.P.C. Commission has considered the
report of IGP Varanasi. The complainant allegation is in respect of sexual
exploitation of Km. Radha d/o Saluka Jamuda r/o
West Singhbhum District, Jharkhand by Baiju Yadav. How the case
instituted on the report of Surender against Bejnath and others is
connected with the complaint in question, needs clarification. The
commission directed IGP Varanasi Zone to submit a typed, legible and a
duly authenticated copy of FIR of crime no. 136/2012 u/s 304A IPC
instituted at PS Kairakot, Jaunpur, along with the charge sheet filed in that

case urgently through a special messenger in a sealed cover within two
weeks.

The Hon’ble Member in the Case No. 8542/24/39/2012 has directed on

November 3, 2017, as under Case No.429/17 under section 166A IPC has
been registered against Gurdeep Singh Sarna, the then SHO Kerakat,
Jaunpur, SI Sabhajeet Singh and Chief Constable Satyadev Srivastava which
is under investigation and directions have been issued to conclude the
same on merits expeditiously.

It is stated that in case of the victim of rape Radha case crime No.135/12
u/s 372/374/376/34 IPC r/w Section 3(3)(6) SC/ST Act has been
filed against Shanti Jamuda w/o
late Godo Jamuda and Baiju Yadav s/o Sahdev Yadav. After the
investigation, a charge-sheet has been filed in the court.

Vide report dated September 12, 2017, it has been stated that 25% of ₹
1,00,000/- (compensation under SC/ST(PoA) Act) has been paid to the
victim vide cheque No.581748 dated August 16, 2017. The commission has
taken a very serious view of the matter. Despite the directions by the
commission to pay a compensation of ₹1,00,000/- vide its proceedings
dated December 26, 2016 no proof of payment has been received till date.

Let a reminder be issued to the Chief Secretary, Government of UP to pay a

sum of Rs. 1,00,000/- on account of compensation to the victim Radha
and submit the proof of payment within four weeks. The Chief Secretary,
UP be also asked to submit as to:

i) Why the compensation as provided under rule 11 and 12 of the SC/ST

(POA) Act amounting to Rs 1,80,000/- (50% of the amount to be paid at the
time of medical examination) has not been paid. ii) Why compensation
under rule 21 of the SC/ST (POA) Act (full cost of education and
maintenance of the child, provision of utensils, rice, etc. for three months)
has not been paid to the victim. iii) The progress of enquiry dated
November 15, 2013, against the erring official, pending before the
administration and status of the investigation of Case Crime No.429/17
within four weeks.

The Commission perused the record and observed that in Case No.
8542/24/39/2012 monetary compensation has already been
recommended by the Commission. Therefore, there is no justification for
continuing with this case i.e. Case No. 1405/34/18/2013-WC. Therefore,
the case No. 1405/34/18/2013-WC is closed.v
