The year 2017 was years for stability for Peoples’ Vigilance Committee on
Human Rights (PVCHR) and Jan Mitra Nyas as now it has own program
office after 21 years of its foundation. The office was inaugurated on the
auspicious the occasion of ‘International Human Rights Day i.e. 10
December, 2017 by Acharya Mritunjay Tripathi and Mufti Haroon Rashid in
the presence of the several senior officials and dignitaries. The office was
named as as “Helma Richa Centre for Human Dignity” in the honor to Ms.
Helma Ritscher, Chairwomen of Indo- German Society of Reimschied for
her tireless work and support for the marginalized children in India.
Helma Ritscher said, “The occasion was emotionally moving for her. The
Centre would is touted to becoming the focal point of the joint social activities
and educational projects of PVCHR / Jan Mitra Nyaas , community of
Varanasi and Baghvanala and Indo-German Society of Remscheid (Germany).
Helma Ritchers son Excel Ritscher observed his mother was a living
example of espousing deep human values. He said, “I call her ‘Mahatma
Maa’ for her continuous and unabated work in India,”
This center was constructed by PVCHR / Jan Mitra Nyas with the support
from Indo- German Society of Remscheid and the land was donated by by
Urmila Singh, the mother of the organisation’s managing trustee Shruti
Nagvanshi.

OUR MISSION
o 587 Meta – Legal with the allied system through using email as a cost
effective tools for the intervention. In 38 cases Hon'ble Commission
ordered for the compensation of 8,096,150 INR (127029 $)

o On 13th May, 2017 200 bags were distributed to the poor students in
Bazardiha.
o On 5th June, 2017 – 8th June, 2017 four days perspective building
workshop on adolescence health, rights, education and health
organized in Baghwanala, Varanasi. In the workshop Ms. Parul

Sharma trained 120 adolescence girls on the issue of human rights,
gender, education and health.
o Intervened in the 143 cases of domestic violence and provided psycho- social
support through testimonial therapy to 57 survivors of domestic violence.
Most of the cases were referred to Asha Jyoti Kendra.

Dance with color: On 18th February, 2018 PVCHR in joint collaboration of
Kalagan Foundation and Benaras School of Fine Art organized “Dance with
color with support from Sir Dorabji Tata Trust”. The motive behind
organizing the program was to strengthen child participation, motivating
creative and creative expression in children. In this therapy around 100 of
the marginalized from the urban slum (Baghwanala and Bazardiha) of
Varanasi participated. Through this workshop children learned the
importance of the colour and how it affects the person mood, physical and
mental health.
PVCHR with the support of Parul Sharma and Raj Dulari Foundation
provided scholarship to Jyoti Seth to continue her further studies.
Jyoti is now working as teacher in private school. PVCHR wrote
letter to Chief Minister of Uttar Pradesh for allotting house to her
Urban Housing mission. The complaint is in the process. Once the
village head denied and wrote that she is survivor of domestic
violence and she is looking her case in family court from her paternal
house. After again intervention the

order has been made for giving
house to her.

Anita husband work as daily wages labourer and hardly earn 3000 INR in a
month. Anita owns the ration card and she bought ration at nominal price.
The child is registered in ICDS center and get gets nutrition diet from the
center.

In the case of Sahil Nut chargesheet against accused has been filed in the
court on 5th June, 2018 against the accused. The case is being advocated by
our lawyer in the court of Judicial Magistrate – I, Varanasi court. The
accused is not present in the court on the prescribed several dates. On 28th
October, 2017 the court issued bail able warrant of 20,000 INR for the next
date 21st December, 2017.
Sahil Nut is resident of Newada Natan Basti Sunderpur in Lanka area was
tortured and kept under detention for whole night. Sahil is 10 years old son
of Sanjay Nut.
Life took a serious turn for 15-year-old Radha (name changed), when her
relatives sold her to a brick kiln owner in Kerakat town in Jaunpur district
of Uttar Pradesh in January 2012. Radha was sexually abused by the brick
kiln owner Baju Yadav for more than two months. Radha is a resident
of Chakradharpur in Singhbhum district, Jharkhand.

next to where the owner worked and every time he wanted me, he would
come to my room.
He would come two or three times a day. I told that woman Shanti that I
didn’t like it, and she said that if I told anyone, the owner would kill me.
One day I opposed it, and the owner beat me up brutally. I was so scared.
The brick kiln owner was in his sixties, had no teeth, used to drink a lot, and
force me to drink alcohol as well. When I refused, he used to hit me. I’m still
in pain from the rapes.”
When Radha reported her ordeal to Shanti Devi, she rebuked Radha and
warned against reporting the incident to anyone else. Shanti Devi has been
working at Baju Yadav’s brick kiln for the past seven years and also had
illicit relations with him. Unable to bear the trauma, on March 20, 2017,
Radha somehow managed to flee from Baju’s brick kiln and reached
her relative Palu Devi’s house living in the same village.
After that, a chain reaction started and resulted in the accidental death
of Battan Mushahar. The case reached to the People Vigilance Committee
on Human Rights (PVCHR), which helped Radha and Paulo Devi family to
flee from a hiding place. To ensure the safety of the girl and those of her
relatives, they had short shelter in PVCHR office. PVCHR took up the case of
Radha to the National Human Rights Commission, the National Commission
for Protection of Child Rights, the National Commission for Women, New
Delhi, the National Schedule Caste Commission, the Chief Minister
of Uttar Pradesh and Jharkhand. They also approached the SHO- Kerakat,
District Magistrate Jaunpur, the superintendent of police – Jaunpur and
filed Right to Information applications asking for further details about the
case.
Radha, in her interview to human rights watch for the report “Breaking the
silence Child Sexual abuse in India” says that an improperly conducted
medical examination in Varanasi after she was repeatedly raped in
February and March 2012 is impeding her legal case. They took her to the
police and to a hospital, where a doctor carried out a medico-legal “two-
finger test.”

The case after an investigation had been submitted to the court for trial. A
case u/s 304A IPC was registered at crime no. 136/2012 at PS Kairakat on
March 21, 2013, against Bejnath, Rajmath, Gulab and Dinesh. A charge
sheet was submitted on May 9, 2012, and the matter is sub judice in court
According to the report, there are allegations that Ms Radha Jamuda d/o
Saluda was kept bonded Baiju Yadav and sexually exploited. However,
these claims were overlooked by SI Sabhajeet Singh,
HC Satya Dev Srivastava and Gurdip Singh Sarna, the then
Inspector Kherakat. Radha was not examined, they tried
to conceal the offence and committed a breach of duty.
There are facts in the report dated February 20, 2017, submitted by IGP
Varanasi report dated that a complaint was
lodged by Surender s/o Sehli r/o Triyani, PS Kairakat,
District Jaunpur, regarding the death of his son Bunti in an accident on
March 21, 2017, and case no. 136.2012 u/s 304A IPC was
registered against the Bejnath, Rajmath, Gulab and Dinesh in which charge
sheet was submitted.

case urgently through a special messenger in a sealed cover within two
weeks.
It is stated that in case of the victim of rape Radha case crime No.135/12
u/s 372/374/376/34 IPC r/w Section 3(3)(6) SC/ST Act has been
filed against Shanti Jamuda w/o
late Godo Jamuda and Baiju Yadav s/o Sahdev Yadav. After the
investigation, a charge-sheet has been filed in the court.
Vide report dated September 12, 2017, it has been stated that 25% of ₹
1,00,000/- (compensation under SC/ST(PoA) Act) has been paid to the
victim vide cheque No.581748 dated August 16, 2017. The commission has
taken a very serious view of the matter. Despite the directions by the
commission to pay a compensation of ₹1,00,000/- vide its proceedings
dated December 26, 2016 no proof of payment has been received till date.
The Commission perused the record and observed that in Case No.
8542/24/39/2012 monetary compensation has already been
recommended by the Commission. Therefore, there is no justification for
continuing with this case i.e. Case No. 1405/34/18/2013-WC. Therefore,
the case No. 1405/34/18/2013-WC is closed.v
