T HE 13TH J UDICIAL D ISTRICT TRO

9. On October 24, 2018, Honorable District Court Judge Cindy Mercer of the

Thirteenth Judicial District Court entered a Temporary Restraining Order against Defendant

Garrett in this cause, identified as cause no. D-1314-CV-2018-01280.

10. Defendant Garrett was served with the Thirteenth Judicial District TRO on

October 25, 2018 at approximately 1:15 p.m. See Affidavit of Service, filed October 26, 2018.

11. Judge Mercer set the TRO hearing for November 9, 2018 at 10:30 a.m.

12. Judge Mercer was excused by Defendant Garrett on November 2, 2018, thus

resulting in the cancellation of the TRO hearing.

13. On November 9, 2018, in between 2:15 a.m. and 3:00 a.m., someone entered the

Legion Iron gym, removed a 20-foot banner, and spray painted “worthless” on the gym wall.
