LOVELL, BIG HORN COUNTY, STATE OF WYOMING.
WHEREAS, THE TOWN OF LOVELL ENDURED A
SEVERE AND VIOLENT STORM ON OR ABOUT JULY 26,

WOULD REGULATE OR LICENSE CONTRACTORS

WHEREAS THE GOVERNING BODY HAS BEEN

NOW THEREFORE, THE TOWN OF LOVELL
GOVERNING BODY FINDS THAT IT IS IN THE BEST
INTERESTS OF THE RESIDENTS OF THE TOWN OF
LOVELL TO ADOPT AN EMERGENCY ORDINANCE
PURSUANT TO W.S. 15-1-115(c), AND THE GOVERNING
BODY HEREBY WAIVES THE REQUIREMENTS
FOR THREE READINGS AND PUBLICATION FOR
ORDINANCES FOR THIS ORDINANCE.
IT IS HEREBY ORDAINED by the governing body of the
Town of Lovell, Wyoming, as follows:
Section 1. Sections 07-03-010 through 7-03-080 of the Lovell
Town Code are hereby adopted to provide as follows:
7.03.010 - Definitions.
A. "Building contractor" means and includes anyone engaged
in the business of roofing, or concrete contracting, either flat,
form or wall work, or as a masonry contractor; or as a carpenter
contractor; or as a general building contractor; and any person
engaged in the construction, remodeling, renovation, alteration
or repair of buildings or other structures or sidewalks or street
pavements; or electrical or plumbing, heating or cooling, painting

B. The above definitions do not apply to a person performing
work within one's own property.
7-03-020 – Permit Required
A. It is unlawful for any person, individual or business entity
to do any work or agree to do any roofing, carpentry, general
contracting, or any other work described in Section 7-03-01 of the
Town of Lovell Code within the town limits or on town property
without first obtaining from the town a valid contractor's permit,
hereinafter referred to as 'permit", to do such work and to pay the
permit fees required by this section. A permit will be issued to any
person that submits a properly completed application, fulfills the
requirements of this article, and pays the required fee. The town
may require such permit fee to be paid by cash or other form of
payment satisfactory to the town, and in the event such fee is paid
by check and check is returned to the town for the reason that the
payer does not have an account with the bank, the permit shall be
considered void and the contractor shall be subject to the penalty
provided in this article the same as if he or she had never made
application for a permit and the permit was never issued.
B. Any person doing business as a subcontractor of any
kind shall be construed as engaged in the business of building
contractor for which a permit is required by this chapter.
7-03-030 – Permit Application
A. Application for permit shall be made in writing to the town
at the Town Hall and shall state if the permit being applied for is a
resident or nonresident permit, and shall include:
1. Name;
2. Business address;
3. Residence address;
4. Social security number or IRS identification number;
5. Employer account number with Wyoming Unemployment
Insurance Division;
6. Proof of worker's compensation coverage;
7. Type of work to be performed under the permit;
8. How long engaged in such work and whether full-time or
part-time;
9. Business and resident telephone numbers;
10. Description of other permits issued to the contractor by
any other subdivision or state within the past 18 months;
11. Detailed description of all liens, lawsuits and causes of
action which have been filed against the contractor or any property
upon which the contractor performed any work within the past
two years;
12. Provide proof of liability insurance in an amount not less
than $1,000,000.
B. The town administrator or his or her designee may issue
the permit, provided all of the information in subsection A of
this section is provided, and the applicant has complied with all
of the requirements of this chapter, and no liens or lawsuits have
been filed against the contractor or any property upon which the
contractor performed any work within the past two years. If any
lien or lawsuit has been filed as stated above, then said application
shall be referred to the governing body of the town for approval
today
before such permit is issued, and before approval, the governing
body may require such security or bond as it deems necessary
before issuing such permit. The Town Clerk or Building Inspector
may issue a conditional permit, subject to confirmation of any of the
information in the application. If the Town Administrator or his or
her designee determine that any of the information is inaccurate,
misleading, false or incomplete, the Town Administrator or his or
her designee may proceed with revoking the license pursuant to
Section 7-03-050, and the applicant may be subject to the penalties
described in the Town Code.
C. The application for a contractor's permit shall be made by
the applicant or officer or agent of the applicant, who shall verify
by written document that he or she has authority to make the
application, and that the facts stated therein are true and accurate.
7-03-040 - Compliance required.
It shall be the duty of all building contractors to comply with all
ordinances, laws, rules and regulations relating to the construction
and repair of buildings or other structures, to the construction of
streets or sidewalk pavements, and all laws, rules, regulations and
ordinances pertaining to or regulating the activities engaged in.
7-03-050 – Permit Revocation.
Any building contractor permit may be revoked by the town
for violations of any ordinance relating to construction, alteration
or repair of buildings, or any aspect of construction work as
outlined in this chapter, or if any of the information provided by
the applicant is discovered to be false, inaccurate, incomplete or
misleading.
7-03-060 - Fees.
Each contractor shall pay the following fees:
A. One-hundred dollars ($100.00) or as established by the
governing body at its annual budget meeting.
7-03-070 - Permit expiration.
Every permit shall expire and be null and void on the thirty-
first day of December each year.
7-03-080 - Violation—Penalty.
Any person, contractor, firm or corporation which violates
any provision of this chapter shall be guilty of a misdemeanor and
shall be punished by a fine of not more than $750.00. Each day any
violation of any provision of this chapter continues shall constitute
a separate offense.
Section 2. This Ordinance shall be in full force and effect upon
adoption pursuant to W.S. 15-1-115(c), pertaining to Emergency
Ordinances.
