FINALS LEGAL RESEARCH Judge E.D. Escalante

As the new lawyer of X and Y Law Firm, you have been tasked to research on the
complaint for disbarment that your firm intends to file against Atty. Fred Dela Cruz, a
member of the Philippine Bar as well as the State Bar of California, United States. The
grounds for disbarment are:

1.The State Bar of California suspended Atty. Jaimes Marcus from the practice
of law for misappropriating client’s money;

2. Atty. Fred Dela Cruz wrote a letter addressed to Judge Loren Llabres,
Presiding Judge of RTC of Caloocan City, Branch 32. Portions of the letter read:

"With the adverse decision rendered against my client, I have


completely lost my faith in the judiciary. I wonder if I would lose
every case I would file in court. How can I convince my clients to
repose their trust in the judiciary when I, myself, feel nothing but
disgust and contempt for the justice system?"

3.The business cards distributed by the secretary of Atty. Jaimes Marcus


contained the following information:

Prepare a comprehensive research work on:

I.Relevant and applicable law/s and jurisprudence in support of each ground for
disbarment;
II. Arguments to bolster the complaint for disbarment.

This paper is your prelims exams. Your output must be handwritten (not typed) on a
long bond paper (maximum of 4 pages only). Do not write your name. Instead, indicate
your student number, subject and school. Your research must be submitted on 27
October 2018. Late submission of research work will not be excused as ample time had
been given to students.

This research work shall be considered your final examination. You will be graded
according to:

- Substance, accuracy, brevity and clarity of research (30%)


- Proper citation of pertinent law/s and jurisprudence (30%)
- Persuasiveness of argument/s (20%)
- Grammar, handwriting (20%)
