RESUELVE:
Dirigirse al Poder Ejecutivo Nacional para que, por medio del Ministerio de Relaciones Exteriores y
Culto, informe a ésta Honorable Cámara de Diputados de la Nación respondiendo por escrito a las
siguientes preguntas:
Primera: ¿Por qué en la reunión de los Ministros de Relaciones Exteriores del “G77 más China”
celebrada este año (en adelante: Declaración/2017), no se volvió a aprobar el mismo texto de
Declaración sobre Malvinas que se había adoptado el año pasado en la misma reunión del “G77 más
China” (en adelante: Declaración/2016), siendo que el texto del año 2016 es más favorable a nuestros
derechos que el texto del año 2017?
Segunda: ¿Por qué en la Declaración/2017, en el punto 196, se insertó el término “to hold
negotiations” (sostener o celebrar negociaciones) en lugar del término “to resume negotiations”
(reanudar negociaciones) empleado en la Declaración/2016, siendo que para los intereses argentinos es
fundamental que siempre se reconozca en todos los foros que el Reino Unido debe “reanudar” las
negociaciones?
Sexta: ¿Por qué, en definitiva, se aprobó un texto en la Declaración/2017 que defiende en menor
medida nuestros derechos que la Declaración/2016?
Fundamentos
Señor Presidente:
Los Ministros de Relaciones Exteriores de los 134 países que conforman el llamado G77 más China
emiten anualmente una amplia Declaración sobre diversos temas, entre ellos, sobre el conflicto de las
Malvinas.
La Declaración del año 2016, cuyo texto reproducimos infra tanto en su versión en inglés como en una
traducción no oficial, es de sumo valor y refuerza el reconocimiento de los derechos argentinos.
Inexplicablemente, la Declaración del año 2017, deja de lado y omite conceptos fundamentales de la
Declaración del año 2016, lo cual constituye claramente un cambio perjudicial para los intereses
argentinos en línea con el texto del Comunicado Conjunto argentino-británico del 13-09-2016.
De la comparación de las dos Declaraciones es evidente que la del año 2016 defiende cabalmente la
postura argentina.
Es por ello que también reproducimos abajo la Declaración del año 2017 y su traducción no oficial, con
el objeto de poder conocer en detalle su texto y poder compararlo.
Declaración del G77 más China del año 2016 sobre Malvinas
145. Recalling that 16 December 2015 marked the fiftieth anniversary of the adoption of General
Assembly resolution 2065 (XX), the first resolution that specifically referred to the question of the
Malvinas Islands, the Ministers reaffirmed the need for the Governments of the Argentine Republic and
the United Kingdom to resume negotiations in accordance with the principles and the objectives of the
Charter and the relevant resolutions of the Assembly in order to find, as soon as possible, a peaceful
solution to the sovereignty dispute relating to the question of the Malvinas Islands, which seriously
damages the economic capacities of the Argentine Republic and the need for both parties to refrain
from taking decisions that would imply introducing unilateral modifications in the situation while the
islands are going through the process recommended by the Assembly.
146. Highlighting the right of the States members of the Group of 77 to permanent sovereignty over
their energy resources, the Ministers expressed the view that the operations not authorized by the
Government of Argentina in the Malvinas Islands area relating to the exploration of natural resources,
especially hydrocarbon resources, were seriously detrimental to the sovereignty rights of the Argentine
Republic over its continental shelf.
147. In that regard, the Ministers recognized the right of the Argentine Republic to take legal action
with full respect for international law and relevant resolutions against non-authorized hydrocarbon
exploration and exploitation activities in the referred area.
147. A este respecto, los Ministros reconocieron el derecho de la República Argentina a emprender
acciones legales con pleno respeto del derecho internacional y resoluciones pertinentes, contra las
actividades no autorizadas de exploración y explotación de hidrocarburos en el referido territorio.
Declaración del G77 más China del año 2017 sobre Malvinas
196. Recalling that 16th December 2015 marked the 50th anniversary of the adoption of UN
General Assembly resolution 2065 (XX), the first resolution which specifically refers to the Question
of the Malvinas Islands, the Ministers reaffirmed the need for the Governments of the Argentine
Republic and the United Kingdom to hold negotiations in accordance with the principles and the
objectives of the United Nations Charter and the relevant resolutions adopted by the General Assembly,
in order to find, as soon as possible, a peaceful solution to the sovereignty dispute relating to "The
Question of the Malvinas Islands", and appreciated the good predisposition and willingness of
Argentina in holding negotiations related to this aim.
197. In this regard, the Ministers highlighted the right of the Member States of the Group of 77 to
permanent sovereignty over their natural resources, based on the principle of territorial integrity (UN
General Assembly Resolution 1514 (XV)) and international law, and they recalled the importance of
not taking measures that could affect the economic growth and sustainable development, nor adopting
unilateral actions in the areas under sovereignty dispute between the Argentine Republic and the United
Kingdom of Great Britain and Northern Ireland.
197. A este respecto, los Ministros resaltaron el derecho de los Estados Miembros del Grupo de los 77
a la soberanía permanente sobre sus recursos naturales, basada en el principio de integridad
territorial (Resolución 1514 (XV) de la Asamblea General de las Naciones Unidas) y el derecho
internacional; y recordaron la importancia de no tomar medidas que pudieran afectar el crecimiento
económico y el desarrollo sostenible, ni adoptar acciones unilaterales en las áreas bajo disputa de
soberanía entre la República Argentina y el Reino Unido de Gran Bretaña e Irlanda del Norte (Hasta

En virtud de todo lo expuesto es necesario que ésta Cámara conozca las razones por las cuales
el Poder Ejecutivo ha procedido de esta manera, aprobando y promoviendo un texto en el año 2017 que
dista de defender cabalmente el interés nacional al ser comparado con el texto del año 2016.
