All Love Catering Service Agreement
This is a catering service agreement made on (Today’s Date) Between ________, (CLIENT) and All Love
Catering (CATERER). This event shall commence on (event date) at (location)

By signing this agreement CLIENT confirms that s/he has carefully reviewed and got clarification about
quotes, estimates and company policies provided by CATERER, and that s/he approves them all. In order to
secure the date, CATERER needs to receive a signed copy of this agreement along with deposit payment.

1.) For weddings CATERER requires a 30% non-refundable hold-date deposit along with a signed copy of this
agreement. For Payment, CATERER requires the full balance to be paid no longer than 7 days prior to
wedding date. CLIENT is responsible to provide final guest count to CATERER within 14 days of wedding
date. Final invoice will then be issued by CATERER within 2 days upon final guest count confirmation.

2.) For all other types of events CATERER requires a 30% non-refundable deposit of the estimated total cost
along with copy of signed agreement prior to the event. Final Guest count is due 5 days prior to event date.
Final Payment is due on or before event date.

3.) Please remit $_______ along with signed contract to secure date.

4.) As of the signing of this contract, the total amount is an estimate (Estimated Total Cost). If there are any
types of changes compared with the Estimated Total Cost that result in a final balance due CLIENT agrees to
pay the final balance within 2 days after receiving the final invoice (for instance, actual service staff hours
vs. estimated service staff hours). If a refund is due the overpayment will be returned to the client within 5
business days after the date of the event.

5.) Due to the fluctuating cost of food items, menu items are subject to change within 10 days before the
event. When a drastic change in the menu ingredient occurs, CLIENT has option of choosing a substitute
menu item.

6.) CATERER is allowed to document event with photos and video to display services to public. CLIENT
agrees that Caterer has rights and ownership to these photographs and videos. 10
7.) In case of Cancellation more than 30 days before the event date, all additional payments made are
returned to CLIENT in full except for the required deposit. In case of cancellation within 30 days of the
event date, all deposits and prepayments are forfeited in full, and CATERER will keep them. In the case of
an event date change or venue change, CATERER will apply the entire balance of CLIENT’s deposits and
prepayments towards the new event date, subject to CATERER’s availability. All costs are subject to change.

8.) There is a $50 fee assessed for all returned checks. A finance charge of 2.5% will be added to the final
invoice after 7 days and every 30 days thereafter that the balance is unpaid. In the case of non-payment,
the client is responsible for all additional costs, including collection fees, court, and attorney’s fees jointly or
severally.

9.) The guaranteed number of guests to be reserved and charged for will be given to CATERER no later
than 14 Days before the wedding event and 5 days for any other event. If the final guest count increases
after this time, the CLIENT will be charged based on the food, service and presentation costs for those
additional guests. For multiple day events, the guaranteed number of guests to be reserved and charged
for will be given to CATERER no later than 14 days before the first day of the event. CLIENT will be charged
for the guaranteed number of guests served. If there are more guests attending than the guaranteed guest
count CATERER will not be responsible for shortage of food or service.

10.) Service time charges provided by CATER prior to the event date are a fair estimate. The actual service
time involved in executing CLIENT’s event will be counted and charged for only by CATERER after the event
date. CLIENT will be billed for additional staff hours for any time extension beyond the prior agreed time.

11.) In Accordance with appropriate Health Codes, CATERER reserves the right to discard any leftover food
items, after the agreed upon event timetable, where there is a reasonable risk for food borne illness to
occur. CATERER is not responsible for products in which are recalled after use at CLIENT’s event. CLIENT
agrees to hold CATERER harmless in cases of food product contamination beyond CATERER’s control.

12.) Service Charge is a standard catering industry charge. It is not a tip. It applies to all charges included
in the estimate and the final invoice. CATERER’s team servicing the event are compensated by hourly wage
and do not expect an additional gratuity (some of our clients are so pleased with the service they receive
that they desire to tip our team an additional amount – which is perfectly acceptable and graciously
received by the team). 11
13.) All necessary rentals and event décor (and other event ancillary services) may be coordinated and
arranged by CATERER. For rentals and other services, management fees may apply. Any loss or damage to
any rentals and décor items will billed to CLIENT after the event. CATERER is not the manufacturer of
rentals or décor items nor the agent of the manufacturer. No warranty against patent or latent defects in
material workmanship or capacity is given, and CLIENT expressly waives all such warranties of fitness and
merchantability which may be accorded by law or otherwise. There is no warranty that rental items or
décor items are suited for CLIENT’s intended use or that these items are free from defects. CLIENT also has
the option of selecting its own rental provided. In the case, payment will go directly to said rental company.
If CLIENT provides china, linen, glassware and/or equipment, CATERER will not be held responsible for loss,
cleaning, damage or breakage. Event décor items and other specialty items included in the Estimated Total
Cost are an estimate and are subject to changes until CLIENT confirms the specific order for these items.
Once confirmed by CLIENT, these charges are nonrefundable and even in the case of changes or
cancellation CLIENT will be expected to pay these charges.

14.) CLIENT is responsible for purchasing any alcoholic beverages from a supplier. CLIENT assumes the
liability for obtaining all necessary liquor for catered events where any alcoholic beverages are served by
the CATERER’s subcontracted associates. CLIENT may order its own liquor and have it delivered to the
event site. After the event, CLIENT must retain any open bottles. CATERER cannot be liable for storing
liquor.

15.) CLIENT agrees to assume all responsibility for the actions and conduct of itself and of its guests.
CATERER will not be liable for any damages arising from intoxication of the client or its guests, and
reserves the right not to serve alcoholic beverages to a minor, a visibly intoxicated person, or to a person
whose conditional of habitual intoxication is known to its employees. CATERER accepts no responsibility in
this matter.

16.) CATERER will be relieved of its contractual obligations for circumstances beyond its control. These
include, but are not limited to: snow blizzards, ice storms, tornadoes, earthquakes, floods, inclement
weather conditionals, car accidents, accident delays, or acts of God.

17.) CATERER is not liable for any accidents, injuries, food allergy issues or reactions that may occur to
venue staff or CLIENT’s guests during the event at this location that are outside of their control and cannot
be held financially responsible. CATERER is responsible for its own staff for the event. 12
18.) CATERER assumes no responsibility for any damage or loss of merchandise, alcohol, equipment,
furniture, rentals, clothing or other valuables prior to, during or after the event. CATERER will do everything
possible to ensure that all of the CLIENT’s supplies, rentals and equipment are cared for and maintained in
good working order and without damage. When providing the location for the event/function, CLIENT
understands that accidents/breakage and/or damage may sometimes occur. CATERER will not be liable for
any damage or loss, unless specifically caused by the willful negligent actions or conduct of CATERER or its
employees. CLIENT will indemnify and hold harmless CATERER for any damage, theft or loss of CATERER’s
property occurring at the event and cause by CLIENT and/or its guests.

19.) CLIENT is solely responsible for all costs and/or deposits relating to the use of the venue, and for
obtaining any necessary permissions, authorizations, or other requirement of CATERER providing services
at the venue.

20.) CATERER reserves the right to terminate this contract for any valid reason. If CATERER terminates this
contract prior to event date all deposits and prepayments will be returned in full within ten (10) days.

All Love Catering accepts all credit cards, checks and cash as form of payment.
