Energy Commission
The Energy Commission is a statutory body
responsible for regulating the energy sector
particularly the electricity supply and piped gas
supply industries in Peninsular Malaysia and
Sabah. The Energy Commission ensures that
the supply of electricity and piped gas to
consumers is secure, reliable, safe and at
reasonable prices.

Background
The energy sector in Malaysia has undergone significant changes
since the 1990s. This was driven by the Government's aim to
enhance supply security, improve efficiency and quality in utility
services and increase the private sector's participation in
infrastructure development.

In its efforts to further enhance the performance of the energy

supply industry in Malaysia, on 1st May 2001, the Government
established the Energy Commission under the Energy Commission
Act 2001. The Energy Commission became fully operational on
1stJanuary 2002 and assumed all the responsibilities of the
Department of Electricity and Gas Supply which was dissolved on
the same date.

In line with the objectives of its formation, the Energy Commission

aims to balance the needs of consumers and providers of energy to
ensure safe and reliable supply at reasonable prices, protect public
interest, and foster economic development and competitive markets
in an environmentally sustainable manner.
Roles and Responsibilities of Energy
Commission (EC)
Economic Regulation - to promote efficiency and economy in the
generation, transmission, distribution, supply and use of electricity and in the
reticulation and use of gas; promoting and safeguarding competition; enabling
fair and efficient market conduct or, in the absence of a competitive market, to
prevent the misuse of monopoly or market power in the electricity and piped
gas industries.

Technical Regulation - to ensure security, reliability and quality in electricity

and piped gas supplies.

Safety Regulation - to protect the public from dangers arising from the
generation, transmission, distribution and supply and use of electricity and the
supply and use of piped gas.

Consumer Protection - to protect consumers in areas such as dispute

resolution, affordability of services as well as quality supply and services from
electricity and piped gas utilities.

LICENSED AND REGISTERED INSTALLATION
a) FOR THOSE WHO USE, WORK, OPERATE ANY INSTALLATION BY
MEANS OF SELF GENERATED ELECTRICITY SUPPLY WITH THE
CAPACITY OF MORE THAN 5KW, REQUIRE LICENCE FROM ENERGY
COMMISSION. FOR EXAMPLE, WORKS ON CONSTRUCTION SITES
USING GENERATOR SET MUST ACQUIRE LICENCE FROM EC.

b) FOR INSTALLATION (e.g. BUILDINGS, FACTORIES ETC.) WHERE THE

ELECTRICITY SUPPLY FROM LICENSEE (e.g. TNB) AT 11,000 VOLTS
AND ABOVE, OR IF THE INSTALLATION HAS A STANDBY
GENERATOR SET, THE INSTALLATION MUST BE REGISTERED WITH
EC.

HOW ABOUT SOLAR ENERGY?

 ELECTRICITY SUPPLY ACT 1990
EXEMPTION UNDER SECTION 54

IN exercise of the powers conferred by section 54 of the Electricity Supply Act 1990 [Act
447], the Minister exempts any person who uses, works or operates or permits to be used,
worked or operated any installation or, supplies to or for the use any other person
electricity from any installation, that uses photovoltaic system or solar panel for purposes
of generating electricity-

(a) for a three phase system, at a voltage not exceeding low voltage with a capacity of up
to 72kW; or

(b) for a single phase system, at a voltage not exceeding low voltage with a capacity of up
to 24kW,

from section 9 of the Act.

Commencement

2. This Notification comes into operation on 15 August 2008.

QUICKEST MEANS AVAILABLE, AND SUBSEQUENTLY WITH THE
LEAST POSSIBLE DELAY SHALL REPORT IN WRITING TO THE
COMMISSION THE FACTS OF THE MATTER SO FAR AS THEY ARE
KNOWN TO THEM RESPECTIVELY.
