1. The question that arises for consideration in

this petition in relation to the shares of a

Co-operative Housing Society is that whether this

petition is to be treated as petition within the meaning

of section 370 of the Hindu Succession Act 1925 or a

document relating to immovable property. Any decision

on the question will have direct nexus with the

liability of the court fees and therefore, the Court

deciding that question has to issue notice to the State

Government. The Office is therefore directed to serve

notice on the State Government. A copy of this order to

accompany notice be issued to the State Government. Put

up on 5th July 2006.
