MOTION FOR CONSOLIDATION

ROGER CRISOLOGO, private complainant, through counsel,

to this Honorable Court respectfully state THAT:

An information against the accused for violation of Batas

Pambansa Bilang 22 was filed before this Honorable Court on October
07, 2016.

On December 7, 2016, herein private complainant received a

subpoena for compliance hearing on June 5, 2017 and August 14, 2017,
involving the same accused and offense before the Municipal Trial
Court in Cities of Cebu City Branch 3 with Crim. Case. No. M-CEB-
16-04482-CR.

That the two criminal cases involved the same parties and criminal
offenses. Under Section 22 of Rule 119 of the Revised Rules on
Criminal Procedure state that:
 Section 22. Consolidation of trials of related offenses. -Charges
for offenses founded on the same facts or forming part of a series of
offenses of similar character may be tried jointly at the discretion of the
court.

WHEREFORE, it is respectfully prayed that an order be granted

to consolidate the cases in the Municipal Trial Court in Cities Branch 3
, Cebu City where Crim. Case. No. M-CEB-16-04482-CR was raffled
which may tend to avoid unnecessary costs or delay and to serve the
best interests of the parties and to settle expeditiously the issues
involved.
