1. Write a judgment by default (i.e.

defendant failed to file an Answer though


served with a copy of the summons together with a copy of the Complaint) using
the following allegations:
The Complaint, among others, alleges the following:

1) That sometime in July 2014, defendant Palautang borrowed money from


plaintiff in the amount of TWO HUNDRED TWENTY THOUSAND
PESOS (P220,000.00) to be used for the processing of his employment
requirements in Brunei;
2) That said defendant executed a notarized promissory note (Annex "A" of
the Complaint) evidencing his indebtedness to the plaintiff and containing
therein a promise to pay the same plus 18% interest per annum in seven (7)
months starting October 2014 to be taken from his salary in his employment
in Brunei;
3) That despite demands through text messages, e-mail and a demand letter
dated July 15, 2015, sent to defendant for him to pay his obligation, he failed
and refused to pay the same.

Thus, plaintiff filed the instant case on November 25, 2015.

2. File a Complaint based on the following circumstances:

a) Plaintiff is a co-owner of a parcel of land designated as Lot No. 5554,


under Original Certificate of Title No. 0-780 (a.f.) containing an area of Three
Thousand Four Hundred and Forty Six (3,446) square meters more or less, located
at Saray, Iligan City, as evidenced and more particularly described under Tax
Declaration 02-035-00766 and Tax Receipt No. 9774929 (Annexes “A” and “B” to
“B-1” of the Complaint);

b) Defendants occupation on the subject property is by mere tolerance as


shown by an allegation that sometime in the year 1995, defendants upon their
insistent pleas to plaintiff and the other co-owners were allowed to build temporary
shanties and stalls within the above-described property with the express
understanding that they willingly vacate the premises if and when plaintiff and the
other co-owners need the same for their own use;

c) Sometime in 2017, plaintiff and other co-owners decided to develop the


property for their own use and wanted to evict defendants on the basis of
defendants’ promise to vacate if and when plaintiff and the other co-owners need
the same for their own use;

d) Plaintiff and the other co-owners made several oral requests and
reminders to defendants concerning their promise to vacate the premises peacefully
giving them sufficient time to do so but they refuse to vacate and remove their
structures despite demands.

3. File a Complaint based on the following circumstances:

a). Sometime in the month of October 2015, defendant sought plaintiff’s


assistance in her retail used clothing business by asking plaintiff to extend her
credit in the amount of THREE HUNDRED FIFTY THOUSAND PESOS
(P350,000.00) evidenced by a copy of a piece of paper (Annex “A”) signed by
defendant which she promised to settle within sixty (60) days;
b). As of July 20, 2016, defendant has paid partial payments in the amount
of FORTY FIVE THOUSND PESOS (P45,000.00) only;
c). Payment of said obligation has been long overdue, but defendant failed
and refused, and still fails and refuses to pay the same or any part thereof,
notwithstanding repeated demands from the plaintiff as well as the amicable
settlement entered into at the barangay conciliation level;

4. File an Election Protest based on the following circumstances:

a) Both Protestant and Protestee were candidates for Punong Barangay of the
recently concluded Barangay Election held in May 2018;

b) After canvass of votes of three clustered precincts, Protestant garnered


351 votes while Protestee garnered 354 votes.
