COUNTER-AFFIDAVIT

I, GLEN GALAN PRIETO., Filipino, of legal age, with address at Barangay


Tisa, Cebu City, Philippines, after being sworn to in accordance with law, depose
and state:

1. That I am the accused charged with the crime of alarms and scandals
pending before Branch 3 of the Municipal Trial Court in Cities and
docketed as M-CEB-18-05277 CR;

2. That I do not personally know the private complainant. The first time
that I actually saw him was on the same day of the alleged incident
inside Police Station 10 at Punta Princesa, Cebu City, after I was arrested
for allegedly discharging a firearm at Santan Street, Tisa, Cebu City;

3. That Private Complainant’s name was previously mentioned to me by


my cousin, Jason Cabellon, who intimated to me that around the 1st
week of October 2018, a group of males, including Private Complainant,
were riding motorcycles and roving around looking for me at Adelfa
Street, Tisa, Cebu City. Before that, the complainant was a complete
stranger to me;

4. That the answer in question number 4 of the Judicial Affidavit of Private


Complainant Domer Canamo is vehemently denied for being untrue.
The truth being that on that same day at around 3:00 P.M. to 4:00 P.M.,
I, together with my fraternity brother Mark Arain, were riding a
motorcycle towards Sitio Capaculan, Tisa, Cebu City because we just
came from a clean-up drive at Tisa, and we just wanted to relax at Mark’s
house. While it was true that we passed through Santan Street, I did not
confront or even see the private complainant as I have not seen him
before. More importantly, I did not pull out any gun or fire it, because
in truth and in fact, I did not have any and did not have any reason to
do so. The truth was that we just passed through Santan Street on the
way to Capaculan, without any commotion;

5. That the answer in Question Number 5 is denied also because it is


untrue. I was actually accosted at Adelfa Street while I was on my way
home. Also, I did not see the Private Complainant as it was 2 policemen
and 2 barangay tanods who brought me to Police Station 10. As
previously mentioned, it was only in the Police Station that I first saw the
Private complainant;

6. That the answer in Question Number 6 is denied for being false. I was
confronted by 2 policemen and 2 barangay tanods at Adelfa Street and
was told that I was invited to the police station because there was
allegedly a commotion where I was involved. It was only after then that
I was brought to the police station and saw Private Complainant;

7. That I execute this Counter-Affidavit in support of my defense against the


allegations in the Judicial Affidavit Complaint filed against me before
Branch 3 of the Municipal Trial Court in Cities in Cebu City;
