AFFIDAVIT OF DESISTANCE

I, EMILY G. GOYENECHE, Filipino, of legal age, and a

resident of Cagayan de Oro City, upon my oath, do hereby
depose and state – That:

1. I am the private complainant in a case for Constructive

Illegal Dismissal against Tummybliss Corporation (aka.
Kentucky Fried Chicken) filed before the NLRC RAB-X
entitled EMILY G. GOYENECHE vs. KENTUCKY FRIED
CHICKEN AND DENNIS S. CUYUGAN and docketed as
NLRC Case No. RAB 10-11-00571-09.

2. I, Emily G. Goyeneche, am going through a very sensitive

pregnancy and would personally want to do away with
the prospect of experiencing the unbearable emotional
stress brought about by this case. In addition, pursuing
this case would mean that I shall be obliged to shoulder
the costly legal fees which, at this point, would not be
wise for a family expecting a new member soon.

3. After my stint with respondent KFC, I am now venturing

into other fields to build a career with a promising
company and would rather live in peace than to go
 through the rigors of filing a case against respondents
Tummybliss Corporation and Dennis S. Cuyugan.

4. I fully understand the implications of executing this

Affidavit of Desistance consistent with my desire to have
the aforementioned complaint against respondents
dismissed and the labor case finally closed.

5. In view of the foregoing, I manifest that I now

COMPLETELY AND ABSOLUTELY DESIST FROM
PURSUING MY COMPLAINT for Constructive Illegal
Dismissal against Tummybliss Corporation and Dennis
S. Cuyugan entitled EMILY G. GOYENECHE vs.
KENTUCKY FRIED CHICKEN AND DENNIS S.
CUYUGAN docketed as NLRC Case No. RAB 10-11-
00571-09.
