EXPLANATORY NOTE

This is a bill proposed in recognizing the important role of the private


sector in the improvement of the welfare of senior citizens and to actively
seek their partnership. The private sector comprises a big percentage in the
whole work force and even in the whole country and their contribution can
make significance when it comes to the development of the well-being of
senior citizens.

AN ACT ESTABLISHING THE CONGREGATION OF PRIVATE


SECTORS FOR SENIOR CITIZENS

Section 1. Short Title. – This Act shall be known as the “Private


Sectors Congregation for Senior Citizens Welfare Act of 2018

Section 2. – Definition of Terms. – For the purpose of this Act, the


following terms shall apply:

a. Senior citizen refers to any citizen of the Philippines sixty (60)


years of age and over;
b. Private Sectors Congregation are those various private
establishments may it be created for the purpose of commercial or
charitable institutions which are registered and formed a
congregation under this law, to provide active participation when it
comes to developing and implementing mechanisms contributing
to the improvement of the welfare of the senior citizens;
c. DSWD refers to the Department of Social Welfare and
Development;
d. OSCA refers to the Office of the Senior Citizens Affairs.

Section 3. – Coverage. – This Act shall be enforced in all cities and


municipalities in the Philippine Archipelago.
Section 4. – Availments. – The senior citizens who are still capable
and are willing to work shall not be deprived by private sectors and shall be
allowed in extending their services which also contribute to productivity and
public welfare. Also, the private sector congregation may pool funds from
their monthly contribution or from their charity works or donation which
will all be allocated for the benefit of the senior citizens.

Section 5. – Implementing Rules and Regulations. – The Office of


the Senior Citizens Affairs shall issue a corresponding rules and regulations
necessary for the implementation of this Act. Whenever the OSCA called for
meetings, all the members of the private sector congregation are required to
attend and participate actively.

Section 6. – Tax Exemption. – Private institutions, which registered


under this congregation, shall enjoy tax deduction of 50,000 pesos in their
annual income tax return and may be adjusted as prescribed by law.

Section 5. – Separability Clause. – If any provision of this Act is


declared invalid or unconstitutional, the provisions not affected thereby shall
remain in force and effect.

Section 6. – Repealing Clause. – All laws, presidential decrees,


executive orders, presidential proclamations, rules and regulations or parts
thereof contrary to or inconsistent with this Act are hereby repealed or
modified accordingly.

Section 7. – Effectivity. – This Act shall take effect fifteen (15) days
after its publication in the Official Gazette or in at least two (2) newspapers
of general circulation.

Context refers to the reason which influences the need of legislation with
respect to certain circumstances.
