MEMORANDUM OF UNDERSTANDING.
BETWEEN
MICHIGAN DEPARTMENT OF TRANSPORTATION,
AND
CITY OF KALAMAZ00
PURPOSE,
This Memorandun of Understanding (MOU) is entered into this date of
‘between the Michigen Department of Transportation (MDOT) and the
Gigy of Kalamazoo (CITY) for the purpose of wansfrring jurisdiction ofthe road segments
Aeseribed in Attaclment A, dated October 2, 2018 from MDOT to the CITY (ROAD
SEGMENTS). This MOU will begin upon award and will remain in effect unless it is
‘modified according to Section V below.
BACKGROUND
‘The ROAD SEGMENTS are within the CITY boundaries and would no longer function as
State Trunkline Highways. MDOT is willing to transfer jurisdictional control of the ROAD
‘SEGMENTS to the CITY and the CITY is willing to accept jurisdiction of the ROAD
SEGMENTS. This transfer of jurisdietional contol of the ROAD SEGMENTS will make
these ROAD SEGMENTS City Major strets (including arterials andor collectors).
‘The partes intend ‘his MOU to be an agreement to transfer jurisdiction of the ROAD
‘SEGMENTS in return fora fixed lamp sum amount of state funds as provided herein, which
will be utilized by the CITY for the design and construction of improvements tothe ROAD
SEGMENTS. The improvements willbe forthe renovation, repair and/or reconstruction of
the ROAD SEGMENTS and will meetor exceed the standard represented by the work items
set fort in Attachment B, dated October 4, 2018 (PROJECT).am,
MDOT and the CITY currently havein force a Trunkline Maintenance Contract for portions
of state trunkline located within the CITY boundaries,
AGREEMENT
Upon award and acceptance of his MOU by both parties, the paris agre tothe following
A. MDOT apres:
1, Totrnsfer jurisdictional contra of he ROAD SEGMENTS tothe CITY and
the CITY agrees to accept jurisdictional control of the ROAD SEGMENTS,
thereby making the ROAD SEGMENTS City Major Streets
2, Toppay the amount of seven million thirteen thousand nine hundred ninety-
cight dollars ($7,013,998) to the CITY, such amount being sixty percent
(60%) of the total estimated cost of the PROJECT. Pursuant to Act 296,
Public Acts of 1969, Section & 3) (a, this payment is made to the CITY so
that the PROJECT will be undertaken by the CITY in liew of being
tundetaken by MDOT. This payment will be disbursed to the CITY upon
completion of any final administrative approvals necessary to authorize the
release of finding and no later than 90 days after the award dat ofthis MOU.
3, To pay the amount of four million six hundred seventy-five thousand nine
Inundked ninety sine dollace ($4,675,999) to the CITY, such amount being
forty percent (40%) ofthe total estimated cost ofthe PROJECT. Pursuant to
‘Act £96, Public Acts of 1969, Section & (3) (8), this payment is made to the
CITY so thatthe PROJECT will be undertaken by the CITY in liew of being
undertaken by MDOT. This payment willbe disbursed tothe CITY after the
parties agree that the CITY as completed sixty percent (60%) of the
PROTECT between 4 years and 6 years after the award date ofthis MOU or 6
‘year after the award date of this MOU, whichever comes ist.
4. To pursue modification of the current ‘Trunkline Maintenance Contract
between MDOT and the CITY to reflect this MOU.

1, To aisume fll jurisdictional contro ofthe ROAD SEGMENTS.
2, Topesform maintenance of the ROAD SEGMENTS for which jurisdictional
canto! has been transfered to the CITY by this MOU.
