AFFIDAVIT OF CUSTODY
OF CHILDREN

I, ARLINA GALVAN CABILATAZAN, 41 years of age, married,

Filipino citizen with present residence and post-office address at Vetaleah Homes
Highland, Zone 9, Gemini Street, Bulatok District, Pagadian City, Philippines,
after having been duly sworn to in accordance with law, do hereby depose and
state:

1. That I am the legal wife of JEFFREY ALMONTE CABILATAZAN with

whom I have been married in lawful wedlock in Pagadian City, sometime in April
26, 1997 in a marriage ceremony solemnized by Rev. Fr. Antonio S. Barol, Parish
Priest, at San Jose Parish Church, San Jose District, Pagadian City, under Marriage
License No. 1453817, as evidenced of a Certificate of Marriage, duly entered as
Registry No. 97-424, copy of which is hereto attached as Annex “A”, to form an
integral part hereof;

2. That during my cohabitation with JEFFREY ALMONTE

CABILATAZAN, having been living together as husband and wife as we were
united in lawful wedlock, we begot two (2) legitimate children, namely, a son,
being christened as Jeff Kyle Galvan Cabilatazan who was born on July 19,
1997, at S.M. Lao Memorial City General Hospital in Ozamis City, Misamis
Occidental; and a daughter, being christened as Kate Lyka Galvan Cabilatazan
who was born on July 24, 1998, at Metro Pagadian Hospital, Inc., Pagadian City;
all of which are evidenced by their corresponding Certificates of Live Birth, copies
of which are likewise hereto attached as Annexes ”B” and “C”, respectively, to
form integral parts of this affidavit;

3. That ever since my said children Jeff Kyle Galvan Cabilatazan and
Kate Lyka Galvan Cabilatazan were born and grown, they have always been,
and still at present, living together with me in Pagadian City under my care and
custody as their legitimate mother, providing them their basic necessities in life
including their education, my said son being now a first-year college student and

my said daughter being now a fourth-year high-school student, while their father,
JEFFREY ALMONTE CABILATAZAN had always been away reporting for duty
at his place of employment as a seaman abroad; worst, he never returned to us as
his own legitimate family, he having found another woman in his life whom he
has been cohabiting until my husband untimely encountered an accident while
on board a vessel abroad in line with the performance of his duties as such seaman.

4. That due to the fact that my said children and I were willfully abandoned
by my said husband with no apparent reason, I henceforth become both father and
mother of my said children, as I am, by operation of law, the latter’s natural
guardian and custodian for all legal intents and purposes.

5. That I am executing this affidavit in order to attest to the truth of the

foregoing circumstances and for the purpose of securing the best interests and
well-being of my said children Jeff Kyle Galvan Cabilatazan and Kate Lyka
Galvan Cabilatazan.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed my

at Pagadian City, Philippines, affiant having personally exhibited to me her
Community Tax Certificate for the current year and her Identification Card (ID)
issued by the School Registrar of Zamboanga del Sur Maritime Institute of
Technology (ZSMIT) where she is presently employed as her competent
evidence to identity her, bearing her photograph and signature.
