AMICABLE SETTLEMENT
KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT made and entered into on this ___ day of December, 2018 at
Zamboanga City, Philippines, by and between:

“THE ZAMBOANGA CITY WATER DISTRICT (ZCWD),

a government owned and controlled corporation, created and existing by
virtue of Presidential Decree No. 198, as amended, with principal office
and place of business at Pilar Street, Zamboanga City, represented in this
instance by its Officer-in-Charge (OIC) for Finance Group, MIRIAM
R. BAGTASOS, of legal age, married, Filipino, and a resident of
Zamboanga City, Philippines, duly authorized under and by virtue of
Board Resolution No. 080 series of 2015, hereinafter referred to as
ZCWD; & hereinafter referred to as the “FIRST PARTY”;

-And-

“MRS. MERLYN E. REBAULA”, of legal age, married,

Filipino, and a resident of Barangay Tumaga, Zamboanga City,
Philippines, hereinafter referred to as the “SECOND PARTY”;

WITNESSETH:

WHEREAS, the SECOND PARTY is the actual user of the ZCWD account registered as
Account: APOSTOL, IMELDA, under Account No. 1071726 and located at Barangay Tumaga,
Zamboanga City, being the new owner of the property;

WHEREAS, on June 13, 2018, the SECOND PARTY, was apprehended for illegal connection
by workers of violation in the form of “Bypass Connection”, in violation of the provisions of
Republic Act No. 8041, otherwise known as the “National Water Crisis Act of 1995”;

WHEREAS, on July 23, 2018, pursuant to the recommendation of the LD, the registered
customer and its actual user were assessed illegal connection penalty in the amounts of Php 145,208.00;

WHEREAS, on July 27, 2018, the registered customer was sent a “A Notice of Illegal
Connection” which was received by Mr. Rey A. Guitao, a worker of the SECOND PARTY;

WHEREAS, the SECOND PARTY, on October 25, 2018, executed a Special Power of
Attorney (SPA) authorizing Mrs. Marina C. Saputalo as her agent to settle and resolve the assessed
penalty and illegal connection case thru an amicable settlement in order to avoid the long, tedious and
costly process of litigation;

WHEREAS, the actual users of the subject water service connection, has already paid a total
amount of Php 5,208.00 in assessed penalty;

NOW THEREFORE, the parties herein hereby enter into an amicable settlement under the
following terms and conditions:

 1) The SECOND PARTY agrees to pay to the FIRST PARTY the total sum of
Php 140,000.00 by paying Php 2,300.00 on or before November 31, 2018 and
then Php 2,000.00 per month thereafter, until fully paid.

2) In the event of breach of this amicable settlement/compromise agreement, the

filing of appropriate civil and criminal cases by the FIRST PARTY against the
SECOND PARTY will commence;

IN WITNESS WHEREOF, both parties have hereunto set their hands this ____ of December,
2018, in the City of Zamboanga, Philippines.
