Before me, the undersigned authority, on this day personally appeared the undersigned affiant who, after being duly sworn by me, on oath stated: my name is Nek beth TAS and | am a peace officer of the City of Dallas, Dallas County, Texas. |, the affiant, have good reason and do believe that on or about January 24, 2019 one MONTANEZ, RENE EDUARDO Jr. did then and there in the City of Dallas, Dallas County, Texas commit the offense of Capital Murder, a violation of section 19.03 of the Texas Penal Code, a Capital Felony. Affiants belief is based upon the following facts and information: Affiant's personal investigation of this alleged offense. J. Loeb #7751, a fellow peace officer of the City of Dallas, Dallas County, Texas, who personally participated in the investigation of this alleged offense, providing this information to affiant, and whose information affiant believes to be credible. On 1-24-19 at approximately 10:05p.m., the suspects intentionally killed the complainant at 8080 Park Ln in Dallas, Dallas County, Texas. The suspects in this offense were robbing the complainant and after the robbery had been completed, one of the suspects shot and killed the complainant. The complainant in this offense is Joseph Pintucci. On 1-24-19 at approximately 10:02pm, three Hispanic male suspects met up with complainant Joseph Pintucci inside the second level of a parking garage located at 8080 Park Lane. The complainant had been communicating with ‘one of the suspects through a messaging app called WB to set up the sale of some drugs. The complainant was sitting in his car with two witnesses when suspect Rene Montanez Jr. and two additional suspects approached them and made small talk before all three suspects pulled out guns and demanded the drugs. After the suspects stole the drugs at gunpoint, one of the suspects, who was not Rene Montanez, shot the complainant then the three suspects fled the parking garage together on foot. A third witness who was not affiliated with the complainant in any way, saw the suspects laughing as they ran towards with exit ramp with the stolen property. On 1-25-19 in the early morning hours, a potential suspect was developed by Detectives based on social media records. However, when the lineup was shown, the witnesses did not identify anyone and one witness confidently ‘stated that the suspect was not In the lineup. Later that day, during the early afternoon, as information about this murder began to spread through social media and traditional news, multiple people contacted the witnesses and began texting them pictures of suspect ReneDallas County, Texas Sorvicett: 016424-2019 104: Arrest: Warrant Number: Charge: Capital Murder ‘Suspect Name: Montanez, Rene Montanez Jr. Both witnesses immediately recognized the suspect as one of the suspects involved in the robbery and contacted Detective J. Loeb #7751. A true name and date of birth were eventually obtained for Rene Montanez Jr. On 1-26-19 the witnesses came to police headquarters and they were shown various photographs of Rene Montanez Jr. and both witnesses confirmed without any doubt that Rene Montanez Jr was one of the three suspects directly involved in this murder. A traditional blind sequential lineup could not be shown due to the fact that the witnesses were providing the suspect information to detectives. Shortly after the witnesses verified the identity of Rene Montanez Jr. a police sketch was made of the shooter based on witness recollection.
