AFFIDAVIT

I, TOMASA MALTU DAYAG, of legal age, Filipino, with residence at # 135

Avocado St. Tanza Tuguegarao City, Philippine, after having been duly sworn to in accordance
with law, hereby voluntarily depose and say that:

1. I am currently applying for an Immigrant Visa for Canada and part of

the requirements is to submit a sworn statement as to the facts
surrounding any case filed against me;

2. On January 17, 1984 Henedina Guttierez filed two criminal cases

against me, one of which is UNINTENTIONAL ABORTION filed
on January 17, 1984 which was dismissed on September 21, 1984
and another case for SLANDER BY DEED which was likewise
dismissed in view of the ruling of the court that I was found
“INNOCENT”;

3. That the said cases were filed by herein Ms. Guttierez which all
began in a simple misunderstanding between the two;

4. Sometime in December 1983, while I was selling different goods and

items in my store when Guttierez passed by and asked about a
certain item that I was selling. She negotiated the price of the said
item until I gave her a price which is considerably a little higher than
what she was bargaining for;

5. Ms. Guttierez acceded to the price I told her but when she paid for
the item, she gave P 25.00 only which was short of P10.00;

6. I reminded her of the price which I set for the items she bought
which is P35.00. Upon being told of the same, Guttierez immediately
kicked the table where my goods were displayed and started pushing
me to the table;

7. Due to the said actuation of Ms. Guttierez, I did my best to defend

myself and to repel the force she has been employing on me. I
likewise tried to push her and to protect the products and items
which I was selling;

8. From that time on, she started to shout foul and unacceptable words
at me and she tried to box me and kick me;

9. Fortunately, there were people who stopped Ms. Guttierez from

further hurting me;

10. I was just surprised that one day I received summons and subpoena
relative to the two aforementioned cases which were filed by Ms.
Guttierez against me;
 11. The criminal case of UNINTENTIONAL ABORTION was
dismissed on September 21, 1984 for utter lack of merit while in the
criminal case of SLANDER BY DEEDS, I was found INNOCENT
as to the allegations made by Ms. Guttierez against me hence the
same was dismissed;

12. That I am executing this affidavit to attest to the truth of the

foregoing facts for the expeditious processing of my immigrant visa
for Canada and for whatever legal purposes it may serve.

IN WITNESS HEREOF, I have set my hand and affixed my signature this 5 th day of
