A "revision" is defined in the New Article 10 regulations, in relevant part, as "[a]n

amendment of an application or Certificate proposing or authorizing a change in the major

electric generating facility likely to result in any significant increase in any environmental impact

of such facility . . . ." 16 NYCRR § 1000.2(ak). 16 NYCRR § 1000.16(a) elaborates on this

definition, stating that to determine whether a proposed amendment constitutes a "revision" (i.e.,

whether an increase in environmental impact is "significant"), the criteria for determining

significance set forth in 6 NYCRR § 617.7(c) will apply. As explained below, the Upgrades will

not have a significant adverse impact on the environment, and therefore should not be considered

material or significant for purposes of determining whether the proposed amendment is a

revision.

6 NYCRR § 617.7(c) directs agencies to compare the impacts that may be reasonably

expected to result from a proposed action against a set of criteria set forth in that section. Those

criteria are intended to be illustrative, not exhaustive, but are indicators of significant adverse

impacts on the environment. The criteria are as follows:

(i) a substantial adverse change in existing air quality, ground or surface water
quality or quantity, traffic or noise levels, a substantial increase in solid waste
production; a substantial increase in potential for erosion, flooding, leaching or
drainage problems;

(ii) the removal or destruction of large quantities of vegetation or fauna; substantial


interference with the movement of any resident or migratory fish or wildlife species;
impacts on a significant habitat area; substantial adverse impacts on a threatened or
endangered species of animal or plant, or the habitat of such a species; or other
significant adverse impacts to natural resources;

(iii) the impairment of the environmental characteristics of a Critical Environmental


Area as designated pursuant to 6 NYCRR § 617.14(g);

(iv) the creation of a material conflict with a community's current plans or goals as
officially approved or adopted;
(v) the impairment of the character or quality of important historical, archeological,
architectural, or aesthetic resources or of existing community or neighborhood
character;

(vi) a major change in the use of either the quantity or type of energy;

(vii) the creation of a hazard to human health;

(viii) a substantial change in the use, or intensity of use, of land including


agricultural, open space or recreational resources, or in its capacity to support existing
uses;

(ix) the encouraging or attracting of a large number of people to a place or places for
more than a few days; compared to the number of people who would come to such
place absent the action;

(x) the creation of a material demand for other actions that would result in one of the
above consequences;

(xi) changes in two or more elements of the environment, no one of which has a
significant impact on the environment, but when considered together result in a
substantial adverse impact on the environment; or

(xii) two or more related actions undertaken, funded or approved by an agency, none
of which has or would have a significant impact on the environment, but when
considered cumulatively would meet one or more of the criteria in this subdivision.

Under sections (2) and (3) of 6 NYCRR § 617.7(c) , the agency is required to consider

reasonably related long-term, short-term, direct, indirect, and cumulative impacts, including

actions which are included in long-range plans or dependent upon such plans. Further, the

agency is required to assess the action's impacts in connection with its setting, probability of

occurrence, duration, irreversibility, geographic scope, magnitude, and the number of people

affected.

Under any interpretation of section 617.7(c), the Upgrades will not give rise to any

significant adverse impact on the environment. The Upgrades are occurring not just within the

footprint of an existing building, but in the internal components of equipment within that

building. As described in more detail throughout this Petition, the Upgrades will (a) generate

little to no wastes, noise or odors, (b) have no effect on any wildlife, scenic resources, water or
drainage, or anything else outdoors in the vicinity of the site, and (c) generate only a nominal

increase in traffic to the Facility over a period of only 40 days. Although the Upgrades will have

the effect of generating more power, they will do so with no increase in net air emissions, as set

forth in more detail in PSEGNY's Title V permit modification application (see Appendix 16).

Accordingly, the Upgrades will not have a significant adverse impact on the environment,

as described in 6 NYCRR § 617.7(c), and therefore do not constitute a "revision" as defined in

16 NYCRR § 1000.2(ak) and §1000.16.
