Re: State Lands Commission Lease No. PRC 2413.9 - Angel Island RFP
Dear Ms. McGuirk,
thas come to our attention that the Department of Parks and Recreation (‘State Parks”) issued
‘a Request for Proposals in May 2018 for ferry service from Tiburon to Angel Island at Angel
Island State Park. The term of the proposed concessionaire contract is for 20 years. Those
documents contemplate State Parks generating revenue from the ferry service at Angel Island.
‘Ths pier, dock, moorings and other improvements within San Francisco Bay at Angel [sland are
located on tide and submerged lands managed by the State Lands Commission and leased to
State Parks pursuant to Lease No. PRC 2413.9 (attached). The subject RFP and proposed 20-
year lease appears to be inconsistent with the terms of the current State Lands Commission
Lease No. PRC 2413.9. Specifically, several lease provisions prohibit commercial activites,
any subleasing by State Parks, and agreements with third parties, involving the lands and
improvements subject to Lease No. PRC 2413.9 without prior approval of the State Lands
Commission, Due to these potential lease compliance issues, Commission staff recommend
State Parks cancel or put the subject RFP on hold, and refrain from entering into any
concessionaire contract unti the inconsistencies identified above can be resolved.
