WHEREAS, the Local Government Unit of General Santos City encourages the
development and creation of socially responsible office organizations as part of the LGU’s
thrust for the promotion of productive government operations;

WHEREAS, there is a need for the restructuring and creation of new positions in
the City Legal Office to establish, operate, manage and maintain the offices in the local
government unit to perform the functions and mandates of the different offices of the city
in order to generate more revenue and enhance the delivery of public service pursuant to
the social and economic objectives of the city;

WHEREAS, the effective structuring under the City Legal Office will better respond
to the increasing needs for manpower in the government and will yield efficiency to the
delivery of services and bring forth local economic growth;

WHEREAS, Section 3(b) of Republic Act 7160, otherwise known as the Local
Government Code of 1991, states that there shall be established in every local
government unit an accountable, efficient, and dynamic organizational structure and
operating mechanism that will meet the priority needs and service requirements of its
communities, and a continuing mechanism to enhance local autonomy not only by
legislative enabling acts but also by administrative and organizational reforms;

WHEREAS, the effectiveness of the various services in the City of General Santos
must be enhanced through a body which will be responsible for coordinating the
programs and activities of existing units, offices, and organizations and provide functions
and services not presently performed or not adequately performed by existing units,
offices, and organizations;

NOW, THEREFORE, on motion of City Councilor Hon. Jose Edmar J. Yumang, duly
seconded by City Councilor _______, be it -

AN ORDINANCE ADOPTING THE NEW ORGANIZATIONAL STRUCTURE OF THE


CITY LEGAL OFFICE

Be it ordained by the Sangguniang Panlungsod, City of General Santos that:

SECTION 1. Adoption. – The herein new organizational structure of the City


Legal Office:

SECTION 2. Composition. – The new organizational structure of the City General Legal
Office shall have the following composition:

SECTION 3. Function.
A. LEGAL SERVICES DIVISION – The legal services division shall have the
following functions, to wit:
1. in charge of all civil cases involving the interest of the City
brought before any court or administrative body;
2. draft ordinances, contracts, bond leases, and other instruments
involving any interest of the local government unit;
3. develop plans and strategies related to programs and projects
connected to legal services;
4. renders free legal assistance to the less fortunate constituents of
general santos city in relation to their legal problems;
5. renders legal opinion in writing on any questions of law as per
request of the mayor or sanggunian;

6. Reviews and submits recommendations or ordinances and
executive orders issued by component unit.

B. ADMINISTRATIVE DIVISION – the administrative division shall have the


following functions, to wit:
1. in charge of the incoming and outgoing communications and
keeps records of the same;
2. in charge in the preparation of payroll, disbursement vouchers,
purchase request, rfq’s, liquidation of cash advance and petty
cash of the city legal office;
3. prepares and sends invitation for pre-procurement conference,
pre-bid cobference and opening of bids to bac, twg, coa and ob;
4. takes and prepares all minutes of city legal office;
5. in charge of accommodating those who seek for legal advice;
records essential information and keeps the same;
6. prepares reports such as:
6.1. Bids results, for infrastructure project, goods(CB),
alternative mode
6.2. Monthly Accomplishment Report
6.3. Department Plan
6.4. OPCR
6.5. Department Training Plan
6.6. Fund Utilization Report
6.7. Department’s AIP, LDIP, APP-CSE
7. keeps and maintains cleanliness and sanitation within;
8. In-charge of the photocopying of all documents and maintenance
unit;
9. In-charge in the withdrawal of Office Supplies, Materials and
Equipment;
10. Prepares and sends invitations for any CLO organized events,
forums, seminars, and messengerial functions.

SECTION 4. Creation of Additional Positions. - The following are created

SECTION 5. Duties and Functions of Additional Positions. - The duties and


functions of the aforementioned positions are the following:

A. Attorney IV

Renders legal work such as but not limited to the following:

i. Assists in the supervision and coordination relative to the implementation of


project and program of the office.
ii. Prepares legal studies and opinions on queries and issues propounded by
various offices.
iii. Conducts investigation and evaluates administrative cases upon instruction
from superior.
iv. Attends hearings and recommends decisions on administrative cases.
v. Undertakes the interpretation of laws, orders, rules and regulations
including legal documents.

vi. Performs research work on various resolutions, ordinances, executive orders
and proposals that may affect the programs and projects of the City.
vii. Reviews contracts, legal forms and other related documents and
recommend its approval.
viii. Performs other related functions

B. Attorney III

Renders legal work such as but not limited to the following:

i. Assists on legal matters affecting office policies, interpretations and


administration of laws and rules
ii. Attends hearings and recommends decisions on administrative cases
iii. Conducts legal studies in connection with cases or matters referred to or
being handled by the Office
iv. Prepares legal studies on queries propounded by various offices
v. Undertakes the interpretations of laws, orders, rules and regulations including
legal documents;
vi. Reviews contracts, legal forms and other related documents and recommends
its approval
vii. Performs such other functions that may be assigned from time to time.

C. Legal Assistant II

i. Researches legal provisions under the direct supervision of the City Legal
Officer raised by any department or agency for legal comment/s and/or
recommendation/s.
ii. Drafts endorsements, memorandum, and written communication/
correspondence under the direct supervision of the City Legal Officer.
iii. Assists in the investigation of administrative cases upon instruction from
superior.
iv. Makes and monitors transcriptions of all recorded hearings conducted by the
Legal Division
v. Attends to Walk-in Clients and refers the same to City Legal Officer/Asst.
City Legal Officer/ Legal Assistants for Legal Advice.
vi. Organizes and monitors the records or files of all administrative cases being
handled by the Legal Office

D. Legal Aide V

i. Performs clerical tasks.


ii. Assists in mailing and sending documents to the Post Office, to the Cour,
and other liaising functions as directed by superior.
iii. Answers telephone, receive mails related to legal services, and operates
office equipment.
iv. Performs other duties as requested.

E. Administrative Officer III

i. Maintains book of expenditures and other financial records.


ii. Prepares department budget.
iii. Supervises the operations and implementation of plans of the section
iv. Prepares the required report of disbursement to liquidate cash advances.

v. Coordinates with offices to ensure availability of cash.
vi. Controls office supplies and equipment usage.
vii. Reviews office documents.
viii. Perform human resource related functions.
ix. Does other related functions.

F. Admin Assistant V

i. Assists the Administrative Officer in the day-to-day functions in the Office of


the City Legal.
ii. Attends to calls and clients in the City Legal Office.
iii. Transmits and/or follows-up orders and requests from the City Legal
Office.
iv. Keeps and maintains office records.
v. Performs other related functions.

G. Admin Aide III

i. Perform a variety of skilled clerical tasks, receives and processes job request
or trip tickets following establish rules and regulations.
ii. Endorse communication to proper offices and addresses.
iii. Perform general messengerial work, collect/segregate incoming and
outgoing correspondence and documents.
iv. Perform clerical tasks such as filing cards, sorting mail, maintaining simple
records or small stock of office supplies.

H. Admin Aide II

i. Perform clerical tasks and general messengerial works.


ii. Assist in receiving and processing communications and office documents.
iii. Maintain cleanliness of the office.
iv. Maintain simple records or small stock of office supplies.

SECTION 6. Qualification of Additional Positions. – The following additional


plantilla positions shall be appointed by City Mayor and such appointment shall be
in accordance with civil service laws, rules and regulations and subject to the
following qualifications:
A. Attorney IV
Education - Bachelor of Law
Experience – Two (2) Years of Relevant Experience
Training – Eight (8) Hours of Relevant Training
Eligibility – RA 1080

B. Attorney III
Education - Bachelor of Law
Experience – One (1) Year of Relevant Experience
Training – Four (4) Hours of Relevant Training
Eligibility – RA 1080

C. Legal Aide V
Education - Completion of 2-year studies in college or High school. Graduate
with relevant vocational/ trade course.
Experience – One (1) Year Relevant Experience

Training – None Required
Eligibility – Career Service (Sub- Professional)/First Level Eligibility

D. Legal Assistant II
Education - Bachelor’s Degree Relevant to Job and completion of 2 years of
studies in the College of Law
Experience – Six (6) Months Experience in Legal and Research Work
Training – Four (4) Hours Relevant Training
Eligibility - Career Service (Professional)/ Second Level Eligibility

E. Admin Officer III


Education - Bachelor’s Degree Relevant to Job
Experience – One (1) Year Relevant Experience
Training – Four (4) Hours of Relevant Training
Eligibility – Career Service (Professional) /Second Level Eligibility

F. Admin Assistant V
Education - Completion of 2-year studies in college or High school. Graduate
with relevant vocational/ trade course.
Experience – 2 years of relevant experience
Training – Eight (8) Hours of Relevant Training
Eligibility – Career Service (Sub- Professional)/First Level Eligibility

G. Admin Aide III


Education – At least 2-year college level
Experience – Preferably with 6 months relevant experience and must possess a
Driver’s License
Training – None required
Eligibility – Career Service Sub-Professional/First Level Eligibility
H. Admin Aide II
Education - At least 2-year college level
Experience – Preferably with 6 months relevant experience
Training – None required
Eligibility – Career Service Sub-Professional/First Level Eligibility

SECTION 7. Funding of New Positions. – On top of the existing funded


positions, the executive department shall include in the budget for approval by the
Sangguniang Panlungsod the funding for the new positions in the organizational structure
of the City Legal Office

SECTION 8. Separability Clause. — If, for any reason or reasons, any part or
provision of this ordinance is held to be unconstitutional or invalid, other parts or
provisions hereof which are not affected thereby shall continue to be in full force and
effect.

SECTION 9. Repealing Clause. — Ordinances, rules and regulations or parts
thereof, which are inconsistent or in conflict with the provisions of this ordinance are
hereby repealed and/or modified accordingly.

SECTION 10. Effectivity. — This ordinance shall take effect fifteen days after its
publication in a newspaper of general circulation in General Santos City.
