Re: Formal Complaint of misconduct of officers


I would like to file a formal police misconduct complaint
against each officer involved in the execution of search warrant
at the property 3318 Friar Tuck Rd. Raleigh, NC. All of the
officers involved have committed numerous, serious violations of
departmental policy and the law, and for this reason, and for
the safety of the community at large, this complainant requests
a formal investigation be undertaken immediately. These
violations include:

 Aiding another (officer) to violate a rule


 Discrimination
 Harassment
 Law violation(s)
 Malicious threats or assault
 Racial or ethnic intimidation
 Unnecessary force through ridiculing, taunting,
humiliating, and mental abuse

On Wednesday, 11/14/18 Michael Clark, Wanda Clark, and Aydan


Clark were at the residence and were forced out of the residence
with SWAT team members aiming rifles at them. There was no
immediate threat; however the use of force and intimidation that
was used to execute the search warrant was excessive in
magnitude and nature. The officers involved threatened and
intimidated my 6 year old son with autism, with a DRAWN RIFLES
when he and my 62 year old mother exited the house. Although he
has minimal vocalizations, my son was not a threat to anyone
there nor was my mother that was escorting him out of the
residence. As they were exiting the premised, guns were still
aimed at nonthreatening humans, knowing that a gun could have
mistakenly gone off at any moment. After nothing was found in
the residence, my parents were harassed into answering questions
that they were not legally obligated to answer, however answered
to the best of their abilities while under duress. The use of
force continuum that was used in this situation was initiated at
the highest level of force possible in that situation, that had
no reflection on the level of subject resistance that was
demonstrated by a disabled child and 2 senior citizens that
merited the corresponding increases in force. The officers (1)
presence and (2) verbalizations would have been sufficient
enough in the execution of the search warrant of the identified
property, however the unnecessary excessive force through usage
of a SWAT vehicle being driven on the lawn, 20 other officers
being on location, as well as the harassment and intimidation of
my family as well as concerned neighbors does not fit the
specifications of the search warrant that provided after all of
these things transpired. There was NO RESISTANCE displayed by
any of the occupants (1-disabled child, and 2-senior citizens)
of the residence, therefore the level of force that was used is
completely questionable since other non-resistive and least
resistive tactics could have been used.

 Aiding another (officer) to violate a rule: it is believed


that other officers on the scene were aware of departmental
procedures, yet failed to intercede to protect the rights
of a disabled child and 2 senior citizens
 Discrimination: The officers discriminated against the
disabled child and 2 seniors by treating them in an
inhumane and degrading manner, based on their geographical
location and demographic affiliation, in a way that is
worse than the way people are usually treated.
 Harassment: In executing the search warrant, the officers
involved acted over zealously through undue intimidation
tactics by the officers using their position and authority
by the officers’ intentional behavior that "would cause a
person of ordinary sensibilities" to fear injury or harm.
 Law violation(s): The search warrant was not provided to
my parents until after the search was over. There is also
probable cause to believe that excessive force and police
tactics were used that violated the civil rights of my son
and my senior parents, after it had been known that my son
has disabilities and the physical conditions of my parents.
 Malicious threats: A terroristic threat was given when the
officers communicated credible, violent threats with the
intent to terrorize my disabled son and 2 senior parents.
When Michael Clark asked if they had to sit on the cold wet
ground, they were threatened by an officer in which the
officer responded, “If you don’t sit on the ground then you
will be handcuffed.”
 Racial or ethnic intimidation: due to the demographic
location of the residence, the officers involved created a
humiliating and embarrassing scene by drawing so much
attention to their presence.
 Unnecessary force through ridiculing, taunting,
humiliating, and mental abuse: usage of a swat team and
tactics (i.e. calling a senior citizen outside that was
trying to prepare and calm an autistic child on a loud
horn) to serve a search warrant in which a credible threat
had not been identified at that location. Children and 2
senior citizens were forced to sit on a cold (40 degrees at
that time) and wet ground, although it had been established
that there was no threat to officers. When Michael Clark
asked if they had to sit on the cold wet ground, they were
threatened by an officer in which the officer responded,
“If you don’t sit on the ground then you will be
handcuffed.” Mental abuse was inflicted upon the disabled
child and 2 senior citizens, by forcing them outside with
rifles aimed and ready for fire on non-threatening targets.

While it was by the grace of God that my son and my parents were
not physically injured, the severe psychological effects of
unjustly being forced out of their home and humiliated in this
manner is having a tremendous toil on them. I earnestly believe
that it is not in this department’s policy and procedures to
treat disabled children or seniors in the manner in which they
were treated, since they were not posing any type of threat to
themselves or others, in which this was the case. For my own
safety and the public good, I would like to see departmental
policies that would justify those officer’s actions as well as
hear what steps are being taken to address all of the officers’
roles in my misconduct complaint against all of the officers
involved. Please inform me of any other procedural steps
necessary as well as offered to me under the full extent of
civil and/or criminal law. Please respond to this letter as soon
as possible, since time is of the essence, to inform me how this
department will resolve this matter.

Re: Police Misconduct Compliant for 20 officers
On Wednesday afternoon, November 14, 2018 I was home when I received a phone call, and the
person said that,” This is the Police and we are outside your house. We want to know every
person in your house and for you to come out one at a time.” I really could not believe what I
was hearing and I told my wife what they wanted us to do and she couldn’t believe it either. I
walked out the door to a swat vehicle on my front lawn with 20 officers surrounding me. I was
told to turn around and put my hands up in the air, walk backwards to the street with swat
officers pointing their barrage of lethal and deadly weapons at me, and once I made it to the
street I was told to sit down on the ground. Due to the amount of armory that was pointed at me,
I respectfully asked if I had to sit on the wet, cold ground. The officer closest to me replied,
“You can sit down there or I will handcuff you.”
After all the things that have been going on in the media concerning special needs people, I made
sure that they knew that my grandson had autism. My wife and six year old grandson that
suffers from autism were then ordered out of the house via a bull horn, in which they verbally
harassed her while she was trying to change my grandson’s diaper and put his shoes and coat on.
As they were walking out of the house with guns pointed at them as well, my grandson started
crying due to the terror that they were inflicting on him. From the time they made initial contact
with me, I continuously asked what was going on and why were we being treated like this. A
number of officers went into and out of the house, while ignoring my requests of notifying me of
what was going on.
Unfortunately we had to wait over an hour outside on the cold and wet ground, before we were
able to go back into the house. Surprisingly, as we were sitting on the ground like some animals,
we noticed the only black officer visibly on the scene, approach with the actual search warrant.
By this time the officers had already been in the house taking apart whatever they could get the
hands on, and 2/3 of the house had already been searched. They forced me to give them keys to
search all of my vehicles as well as keys to search the utility house. I am 64 years old and have
never been treated this bad by anyone, not to mention the police. We have never had any
problems with the police before and have always supported law enforcement and fire fighters.
We were treated terribly as if we were less than human beings. The officers were extremely
rude, callous, malicious, and racist in attempting to do their jobs. I have never been so degraded,
embarrassed, and humiliated in my life. The disdain that the officers had on their faces and in
their disposition were the worst I have ever experienced or want to experience. I truly believe
that if we were white, this situation would not have transpired in the manner that it did. We were
extremely passive compliant with the officers and did not do or say anything to precipitate their
treatment.
The officers’ actions on that day, demonstrated a clear abuse of power. The blatant use of
military style weapons on my 6 year old grandson, my 65 yr. old wife, and me was meant to
provoke fear and intimidation through a means of excessive force, degradation, harassment, and
discrimination. Furthermore, the deprivation of my rights for the officer to inform me of my
constitutional right to due process, by informing me of what was going on during my oppressive
treatment. Those officers came to my house looking for a fight, without any oversight of moral
judgement or objective reasoning. The manner in which they search my house, all my vehicles,
and my utility house on more than one occasion, only to find nothing…seemed to make the
officers visible frustrated and upset. Even after my home had been search on TWO occasions, I
still had to have a police escort, just to go to my own bathroom.
I grew up in the 50’s and I have seen a lot, but I have never been so humiliated and demeaned
like the gang of all white officers that came to my house. It is not solely about black and white,
but also right and wrong. How that band of white officers treated our family was extremely
WRONG. Those officers came to my house looking to be the Judge and executioner. The
manner in which they executed that search warrant reminded me of a clan rally, while we had to
be paraded, demonized, and humiliated. I would never have imagined being terrorized by the
people that supposed to protect us. I have always instilled respect for law enforcement in my
actions as well as my family, but being treated worse than dogs have truly changed my
perception of law enforcement. It is truly disheartening that senior citizens, disabled children,
and blacks are still treated in the manner that these officers treated us in the 21ts century. My
wife hasn’t been sleeping well at all since that night and my sweet and innocent grandson’s
behaviors have worsened. I truly hope these unethical, dastardly, and antagonistic officers are
disciplined, because the next innocent person may not be so blessed not to be killed.
I am requesting:
1. The list of names of all swat officers, police officers, and detectives that were involved
with the search warrant to ensure there is not a pattern of abuse of power or misconduct
complaints as well as what steps were used to identify the officers that were involved,
2. that this complaint is placed in every officer’s personnel file that were present and
participated in the execution of the search warrant,
3. a copy of the policy and procedure for rpd that identifies the procedure in which a search
warrant is carried out,
4. a copy of the policy and procedure in regards to the use of force warranted during a
search warrant,
5. a copy of the policy and procedure that describes the treatment of children, the disabled,
and seniors during the execution of a search warrant,
6. the written report or any applicable documentation that documents each officer’s actions
and role in the execution of the warrant,
7. a copy of the return of service documentation, and
8. Written notification of how this department will review, investigate, and the remedies
that will be taken to ensure other citizens do not have to endure the same traumatizing
experience that my family and I have.

To whom it may concern:

On Wednesday afternoon, officers from your department came to my house at 3318 Friar Tuck Rd.

The purpose of this letter is to notify this department of police misconduct by officers who violated

state and federal laws, as well as the civil rights of my family, that they were sworn to serve and

protect. There was a blatant display of unnecessary and excessive use of physical and deadly force,

through unprompted use of language or conduct that is insulting, demeaning, or humiliating,

discrimination, harassment, and being selective with the rules they chose to follow.

I received an unknown phone call to my residence, in which the caller was asking for Michael

Clark. After I pasted the phone to my husband, he told me that he was asked outside. Before I

proceeded outside, I had to put on my shoes and coat as well as change my grandson’s diaper in

addition to putting on his socks, shoes, and coat. While I getting myself ready as well as my 6 yr.

old grandson that has special needs, took more time than the officers allotted due to their unexpected

arrival. I then hear my name called on a bull horn, but I knew I couldn’t go any faster. After finally

getting us prepared, my grandson and I headed outside the door with guns being pointed directly at

us as we headed towards the street. Having guns pointed at a 6 yr. old was extremely frightening and

completely unnecessary. Even now, I still have nightmares about those guns being pointed at me and

my grandson. It was very disheartening to hear my grandson’s frantic whaling and crying as we

finally made it to the street. Then I was asked to sit down on the cold hard ground until the officers

allowed us back into the house. When I walked into the house, I was astonished at the rooms being

torn apart, because of something that was not there. After going through the hell that we were forced
to deal with, they finally told us that they had a search warrant. The officers showed no respect for

us, our emotional well-being, or our home. Those officers didn’t care what they did to us, or how

they treated us in their quest to terrorize us and look for us that we didn’t have anything to do with. I

truly believe that if we lived in Wakefield or north Raleigh, then we would not have been treated the

way we did.

I feel that our rights and property were violated and that the officers involved were only out to

terrorize someone. We were treated worse than whoever and whatever they were looking for. I

have never been so demonized, humiliated, and mistreated in my life. I earnestly feel as if those

officers could have handled their duties in a more humane manner. It is my request that this matter

be investigated and all officers that were involved in the incident on Wednesday, November the 13th

are held accountable and responsible for the manner in which they treated my family. Additionally,

I would like this complaint to go into every officer’s personnel file and for the outcome of this

complaint be sent to me.
