Notice is hereby given that David J. McManus, Jr., Patrick J. Hogan, Michael R.

Cogan, Kelley A. Howells, and Malcolm L. Funn, in their official capacities as Members

of the Maryland State Board of Elections; Linda H. Lamone, in her official capacity as

State Administrator of Elections; and Brian E. Frosh, in his official capacity as Attorney

General of Maryland, defendants in the above-named case, hereby appeal to the United

States Court of Appeals for the Fourth Circuit from that portion of the January 3, 2019

order of the United States District Court for the District of Maryland (ECF No. 39), granting

the plaintiffs’ motion for preliminary injunction and enjoining the defendants from

enforcing §§ 13-405 and 13-405.1 of the Annotated Code of Maryland, Election Law

Article as to the plaintiffs during the pendency of this action.
