COMPROMISE AGREEMENT

Known all men by these Presents:

This Compromise Agreement is entered into by and between:

JOANDEL S. CABILING, Filipino, of legal age, married and

a resident of KM. 2, Barangay Luna, Surigao City, Province of
Surigao del Norte, hereinafter referred to as the FIRST PARTY;
-and-

ERNIE D. CABILING, Filipino, of legal age, married and a

resident of Km. 2, Brgy. Luna, Surigao City, Province of Surigao
del Norte, hereinafter referred to as the SECOND PARTY.

WHEREAS, the FIRST PARTY is the private complainant in the

Criminal Case No. 10039, before the Regional Trial Court Branch 32
of Surigao City for alleged Violation of R.A. 9262 against the SECOND
PARTY;

WHEREAS, it is the mutual desire of the FIRST and SECOND parties

to settle the civil aspect of the case amicably in the spirit of peace and
reconciliation, and, for this purpose, have agreed to the following terms
and conditions THAT:

1. The FIRST PARTY shall cause the DISMISSAL of the case

docketed as Criminal Case No. 10039 before the Regional
Trial Court of Surigao City for alleged Violation of R.A.
9262 against the SECOND PARTY;

2. The SECOND PARTY shall comply with the following

conditions:

a. The SECOND PARTY will send monthly support for

the children at bank of choice of the FIRST PARTY;
b. The SECOND PARTY has to seek permission from the
FIRST PARTY before exercising his visitorial rights
with their children;
c. The visitorial rights of the SECOND PARTY is limited
to two (2) hours and within the city of Surigao only;
d. The SECOND PARTY will refrain from harassing the
FIRST PARTY;
e. The SECOND PARTY will indemnify the FIRST PARTY
for the damages cause when the FIRST PARTY went
to Manila to recover their children;

3. The FIRST PARTY absolutely release, completely clear,

and forever discharge the SECOND PARTY any action,
cause of action, sum of money, liability, damages, claims
and demands whatsoever, which in law or in equity THE
FIRST PARTY have, or which THE FIRST PARTY’S heirs,
insurer, successors and assigns hereafter may have
arising from the complaint subject of the abovementioned
case;
 IN WITNESS WHEREOF, the parties hereunto affix their respective
