I believe there is probable cause to charge the defendant with these charges because:
On 2-2-19 at approximately 2151 hours, officers responded to the area of 2265 Monroe Blvd on a reported
unknown problem, possible gunshot wound. Officers located a male in front of the above address on the ground
and bleeding from injuries to his chest and back. The injuries appeared to be slash or puncture type injuries. The
male was unconscious, and had agonal breathing. The male was transported to McKay Dee Hospital, but later
died from his injuries. The victim was later identified as a 28-year-old male.
Officers learned there was a disturbance that took place in front of a detached garage belonging to the address
located at 2228 Monroe Blvd, Number one. Officers located several witnesses who were cooperative with the
investigation. The witnesses told investigators that a male identified as Xavier Soto was in a physical altercation
with a woman in the alleyway. The victim attempted to intervene and stop Soto from assaulting the woman.
Shortly after the victim confronted Soto, the victim started to run away west down an alleyway being chased by
Xavier Soto. The two ran across Monroe Blvd. and then south on the west side of Monroe Blvd.
Investigators located surveillance video from a location on Monroe which shows a portion of the fatal assault
between Xavier Soto and the victim which collaborates the information given by the witnesses.
The Utah State Medical Examiner conducted an autopsy and concluded that the victim had sustained two stab
wounds to his torso, one of which was fatal.

The person would constitute a substantial danger to any other person or to the community, or is likely to flee the
jurisdiction of the court
Xavier is a member of the Ogden Trece Criminal Street Gang. He has a substantial criminal history as a juvenile.
He's been in Millcreek and has had parole revoked. while at a community placement he stole a vehicle and fled
the court ordered placement. He is being charge with criminal homicide for intentionally causing the death of
another.
