CONSERVATION December 17, 2018 Darren MacKenzie ‘Supervisor, Compliance & Enforcement Re: Promotion to Director of Planning & Regulations Dear Darren, The Niagara Peninsula Conservation Authority (NPCA) would like to take this opportunity to offer you revised terms and Conditions of employment through your acceptance of the role of Director of Planning and Regulations effective December 17, 2018 Compensation In this role you will report directly to myself as the Interim CAO/Secretary-Treasurer. Your work location, hours of work. employee benefits, professional services lieu time and initial start date will remain unchanged Su will be provided with a monthly vehicle allowance of $1,000.00. This vehicle allowance is inclusive of all expenses Pertaining to the Director of Planning & Regulations work functions, thus you are not permitted to submit any other vehicle expenses (e.g. mileage, gas, insurance, etc.) The NPCA will be responsible for documenting the vehicle allowance on your T4-Statement of Remuneration Paid, and you will be responsible to report the vehicle allowance contained on the T4 with your Income Tax Return Vacation Probationary Period Termination a) Ifyou decide to terminate your employment with NPCA, you may do so at any time by giving working written Notice of your last day of work in accordance with applicable provincial legislation, as amended. b) _NPCA may terminate your employment without notice or payment in the event of cause Continuation of benefits, if applicable, will be in accordance with the Ontario Employment Standards Act, 2000, as amended 4) As you are receiving vacation at the start of the year, should you cease to be employed by the NPCA at any time during the year, the vacation entitlement amount will be amended and pro-rated based on the amount of months ‘worked thal year. This may result in a deduction from your final pay for vacation time that was used, but not earned. By signing this offer of employment, you authorize this deduction. In no circumstance will you recelve a lesser vacation entitlement than your entitlement under Ontario's Employment Standards Act, 2000, as amended Confidentiality [also take this opportunity to remind you that all confidential information acquired by you during your employment remains the property of the NPCA. Any private use by you of that information during your employment or after is unlawful. If | have reason to believe that my access codes or devices have been compromised or stolen, | wll immediately contact my immediate supervisor in the NPCA | agree to comply with all of the obligations and imperatives of the Municipal Freedom of Information and Protection of Privacy Act. | further agree that as an employee of the NPCA who is working in @ fiduciary position, | have been entrusted with confidential information ‘and am aware of my obligations regarding the communication of sensitive information obtained during my employment with the NECA, | make the commitment that | will nt, ether during or after my employment with the NPCA, and without due authority, disclose, discuss ‘or make known to any third party any matter that would not normally be disclosed to the public except where required by law.
