Memorandum

To: DMX Aircraft Maintenance Technicians and Inspectors

From: Lonnie Warren

Subj: State of Operational Emergency – AMFA

We have been experiencing an unusually high number of out of service aircraft over the last few
days. Due to this number of out of service aircraft, our operation requires all of our scheduled
Aircraft Maintenance Technicians and Inspectors. We have an obligation to our Customers and to
our fellow Employees to safely and efficiently run our operation. Therefore, due to the out of
service aircraft, I am declaring Dallas in a State of Operational Emergency effective 10:00
a.m. Central.

1. Due to the emergency, we will direct Employees alleging illness to provide a doctor’s
note, on their first day back, indicating when the doctor was seen and confirming that the
Employee was unable to work on the dates he claimed illness. The only exception will be
an illness or an absence which is covered by FMLA. Failure to comply may be considered
insubordination and abuse of sick leave which could result in termination.

2. Due to the emergency, the Company will only honor vacation, floating holiday, or shift
trade requests that have already been approved. Aircraft Maintenance Technicians and
Inspectors will be directed to work their regular shift. Failure to comply may be considered
insubordination and could result in termination.

3. Due to the emergency, the Company will fully utilize the station’s allocated manpower in
any bid location deemed necessary to support the operation. If an Employee refuses to
work in the assigned bid location, failure to comply will be considered insubordination and
will result in termination.

4. Due to the emergency, the Company will continue to call an appropriate amount of
overtime to support the operation. It may become necessary to utilize mandatory
overtime. Failure to comply with mandatory overtime will be considered insubordination
and will result in termination.

This Operational Emergency will remain in place until it is lifted by memo from me advising of the
same. This is not the type of communication I (or any Leader) want to issue, but it is necessary to
get our aircraft back in service in order to serve our Customers.
