DECISION

This is a case for Confirmation of Right under Republic Act (RA) No.
3844, involving an agricultural landholding situated at Brgy. Caputican,
Talavera, Nueva Ecija, with an area of Twenty Two Thousand Nine Hundred
Fifty Six (22,956) square meters, covered and embraced by Transfer
Certificate of Title (TCT) No. NT-050-2017002554 registered in the name of
the Republic of the Philippines.

In substance, petitioner alleged that she is a farmer beneficiary to the


subject landholding under Operation Land Transfer (OLT) pursuant to RA
3844, where the Land Bank of the Philippines (LBP) financed the acquisition
of landed estates to be distributed to qualified farmer beneficiaries.

According to the petitioner, the subject landholding is under the


Nicanor Jacinto Estate which was acquired by the LBP under RA 3844. As

such, LBP was issued TCT NT - 223113 covering the 22,956 square meter
subject of this case.

However, at present under the new policy, LBP turned over to


Department of Agrarian Reform (DAR) all titles under its name and custody
under RA 3844 whereby the subject landholding is now under the name of
the Republic of the Philippines with TCT No. NT-050-2017002554.

Accordingly, to guarantee the payment of amortizations, an


Investigation/Inspection Report on the application to purchase lot (Annex
“C”) was conducted by the Municipal Agrarian Reform Officer (MARPO)
concerned.

Petitioner further averred that pursuant to Section 1, Rule II of the 2009


DARAB Rules of Procedures, this case is within the jurisdiction of this Board.

In view of the foregoing, petitioner prayed that her right over the subject
landholding be confirmed.

On July 20, 2018, respondent PARPO II of DAR Nueva Ecija through


the Office of the Legal Services Division filed an Answer admitting all the
material allegations of the petitioner and joining the prayer of the latter for
confirmation of his right over the subject landholding.

In a hearing held on August 2, 2018, the case was submitted for


resolution based on available records.

This Board resolves to grant the instant petition.

Indisputably, this case is well within the jurisdiction of the Board as it


involves the right of a farmer beneficiary over an agricultural land covered by
Republic Act (RA) 6657 and other agrarian related laws, in this case under
RA 3844.

Further, on the basis of the evidence presented, particularly, the Order


of Award and the Report of Investigation/Inspection issued by the MARPO
and without objection on the part of the PARPO II, this Board is convinced
that the petitioner is the rightful beneficiary on the landholding and is entitled
to all the rights and privileges of a farmer beneficiary under existing agrarian
reform laws.

WHEREFORE, in view of the foregoing, an Order is hereby issued


CONFIRMING the petitioner Clariza A. Vicente to be the rightful beneficiary
over the 22,956 square meter landholding covered by TCT No. NT-050-
2017002554.

SO ORDERED.
