The undersigned, being sworn says, 0n information and belief, that ZACHARY GREENBERG did, in the

County of Alameda, State 0f California, 0n 0r about February 19, 2019, commit a FELONY, to Wit: ASSAULT
WITH FORCE LIKELY TO PRODUCE GREAT BODILY INJURY, a Violation 0f section 245(a)(4) 0f the
PENAL CODE 0f California, in that said defendant(s) did willfully and unlawfully commit an assault on
Hayden Williams by means of force likely t0 produce great bodily injury.

"NOTICE: Conviction of this offense will require you to provide specimens and samples pursuant t0 Penal
Code section 296. Willful refusal t0 provide the specimens and samples is a crime."

SECOND COUNT
The undersigned filrther deposes and says on information and belief, that said ZACHARY GREENBERG did,
in the County 0f Alameda, State 0f California, 0n or about February 19, 2019, commit a FELONY, t0 wit:

BATTERY WITH SERIOUS BODILY INJURY, a Violation of section 243(d) of the PENAL CODE of
California, in that said defendant(s) did willfully and unlawfully use force and Violence upon the person 0f
Hayden Williams, resulting in the infliction 0f serious bodily injury on such person.

"NOTICE: The above offense is a serious felony within the meaning 0f Penal Code section 1192.7(0) and a

Violent felony within the meaning 0f Penal Code section 667.5(0)."

"NOTICE: Conviction of this offense Will require you to provide specimens and samples pursuant t0 Penal
Code section 296. Willful refusal to provide the specimens and samples is a crime."
THIRD COUNT
The undersigned further deposes and says 0n information and belief, that said ZACHARY GREENBERG did,
in the County 0f Alameda, State of California, on or about February 19, 2019, commit a FELONY, to wit:

CRIMINAL THREATS, a Violation of section 422 0f the PENAL CODE of California, in that said defendant(s)

did willfully and unlawfillly threaten t0 commit a crime which would result in death and great bodily injury to

Hayden Williams, with the specific intent that the statement be taken as a threat.

"NOTICE: The above offense is a serious felony within the meaning of Penal Code section 1192.7(c)."

It is further alleged that the threatened crime, 0n its face and under the circumstances in Which it was made,
was so unequivocal, unconditional, immediate and specific as to convey to Hayden Williams a gravity of

purpose and an immediate prospect 0f execution. It is further alleged that the said Hayden Williams was
reasonably in sustained fear of his/her safety and the safety of his/her immediate family.

NOTICE PROVISION—RE STATE PRISON ELIGIBILITY- SERIOUS FELONY AS TO DEFENDANT


ZACHARY GREENBERG
It is further alleged that the above offense is a serious felony Within the meaning of Penal Code section
1192.7(c) and that pursuant to Penal Code section 1170(h)(3) an executed sentence for the offenses herein

charged shall be served in the state prison.

FOURTH COUNT
The undersigned further deposes and says on information and belief, that said ZACHARY GREENBERG did,
in the County of Alameda, State of California, on or about February 19, 2019, commit a MISDEMEANOR, to
wit: VANDALISM UNDER $400 DAMAGE, a Violation 0f section 594(a) of the PENAL CODE 0f California,
in that said defendant(s) did unlawfully and maliciously deface with graffiti and other inscribed material and
otherwise damage and destroy real and personal property, to Wit: Cell Phone, not his or her own, belonging to

Hayden Williams.

Pursuant t0 Penal Code Section 1054.5(b), the People are hereby informally requesting that defendant’s counsel provide
discovery to the People as required by Penal Code Section 1054.3.
