COMPROMISE AGREEMENT
UNDERSIGNED PARTIES:
COMES NOW, CARL CHIEF ELESTERIA, represented herein by its authorized representative Ms.
Cyrill Agbones, of legal age, Filipino, and resident of Brgy. Busay, Cebu City,

And

JONEY BOY GOBACHA, represented herein by its authorized representative Mr. Martel, of legal
age, Filipino, and resident of Brgy. Bag-o, Danbantayan, Cebu

AGREE as follows:
In order to buy peace and without going into the merits of the case, both parties FREELY agree to
execute this compromise agreement, by way of an amicable settlement, with the following terms and
conditions, to wit:
1. Accused expressly acknowledged having taken five items namely:
a. Jordan 11 Black Nike shoes priced at Php 7, 000,
b. Mackbook Pro 10 priced at Php 60, 000,
c. Parker Pen set priced at Php 8, 000,
d. IPhone 7 priced at Php 45, 000, and
e. five signature shirts (two Calvin Klein and three Superdry) priced at Php 10, 000 in
total,
and cash amounting to Php 20, 000 from the private complainant, for a total amount of Php 150,
000, and commits to settle the same through salary deduction for 20 months at Php 7, 500 per
month. Such salary deduction shall commence on May 2019 until December 2020 and should be
paid within the first 10 days of every month.
2. Non-compliance to the terms and conditions set forth hereof, the aggrieved party may seek the
assistance of the Honorable Court for the reinstatement of this case;
3. That in the event of breach of any of the conditions in this Compromise agreement, the non-
breaching party has the SOLE option to invalidate any and/or all provisions contained herein.
4. That this Compromise Agreement represents the full and final settlement of all existing and
subsisting claims between herein parties, their counsels and authorized representatives,
assignees and heirs, as of the date of this agreement;
5. That none of the parties are under duress or any form of coercion or threat, but acted mutually
and voluntarily in accordance with their own volition and free will in executing this Compromise
Agreement;
6. That all parties have fully understood the contents of this Compromise Agreement , the same
having been fully explained to them in a language or dialect known to them;
7. This Compromise Agreement shall be valid and binding between the parties, their successors-in-
interest and assigns;
8. No amendment of the terms of this Compromise Agreement shall be effective unless in writing
and signed by the parties involved therein;
9. Should any provision of this Compromise Agreement be declared null and void, the nullity shall
not affect the validity of this transaction or any provision herein which shall then be considered
as valid and binding by all the parties herein;
10. Being not contrary to law, morals, good customs, public order and public policy, both parties,
agree to waive their claims and counter-claims in this case and pray for the provisional dismissal
of the above-captioned case.

IN WITNESS WHEREFORE, the Parties hereto have read, fully understand the merit of this
agreement mutually and voluntarily agreed the above stipulations and signed this Compromise
Agreement at PMC Cebu Unit on February 10, 2019, for consideration and approval of the Honorable
Court.
