Prayer in the present petition filed under Section 439 Cr.P.C. is

for grant of regular bail to the petitioner in case FIR No.40 dated

17.02.2017 registered under Sections 21/22/29 of NDPS Act at Police

Station City Beas, District Amritsar Rural.

Counsel for the petitioner states that the petitioner is in custody

since 23.07.2018 and has been named as an accused by the co-accused,

namely, Sarbjit Singh @ Sarb and Palvinder Singh, from whom, 1200

tablets of Alprazolam were recovered. He further states that the co-accused

are on regular bail and the petitioner is in custody since 23.07.2018. There

is no other case against him.

Learned State counsel does not dispute the aforesaid facts.

I have heard learned counsel for the parties.

Considering the fact that the co-accused of the petitioner

namely, Sarbjit Singh @ Sarb and Palvinder Singh have been admitted on

bail coupled with the fact that there is no other case against the petitioner,

he is admitted on bail subject to his furnishing bail bonds/surety bonds to

the satisfaction of the trial Court.

Accordingly, present petition is allowed.

It is made clear that in case the petitioner is found indulged in

any other case under the NDPS Act, the prosecution shall be at liberty to

seek cancellation of his bail.
