CITY RESOLUTION NO. 2013-002

A RESOLUTION ESTABLISHING THE PERSONNEL SELECTION

BOARD IN THE LEGISLATIVE DEPARTMENT FROM JULY 2013
TO JUNE 30, 2016

WHEREAS, Section 80, subsection (b) & (c) of the RA 7160 otherwise known as
the Local Government Code of 1991 states that:

(b) “There shall be established in every province, city or municipality a

personnel selection board to assist the local chief executive in the judicious and
objective selection of personnel for employment as well as for promotion, and in the
formulation of such policies as would continue to employees’ welfare.”

(c) “The Personnel Selection Board shall be headed by the Local Chief Executive
and its members shall be determined by resolution of the Sanggunian concerned. A
representative of the Civil Service Commission, if any, and the personnel officer of the
local government unit concerned shall be ex-officio members of the board.”

WHEREAS, pursuant to Civil Service Commission Memorandum Circular No. 03

s. 2001 which states more particularly on Section 6, subsections a (a.3), b and c
to include:

(a) As Chairperson
a.3 Vice-Governor/Vice-Mayor or the authorized representative if the vacant
position is in his/her Office or in the Office of the Sanggunian;

(b) Division Chief or the authorized career service representative of the

organizational unit where the vacancy is;

(c) Human Resource Management Officer or the career service employee directly
responsible for personnel management;

WHEREAS, Section 456 of R.A. 7160 also provides the powers, duties, and
functions of the City Vice-Mayor, to wit:

The City Vice-Mayor

Section 456. Powers, Duties, Functions and Compensation.

(a) The City Vice-Mayor shall:

(1) XXXX
(2) Subject to civil service law, rules and regulations, appoint all officials and
employees of the Sangguniang Panlungsod, except those whose manner of
appointment is specifically provided in this Code;

WHEREAS, Civil Service Commission Memorandum Circular No. 04, s. 2005

embodies the Amendment to Policy No. 12 of CSC MC No. 3, s. 2001 and clarifies the
functions and responsibilities of the Personnel Selection Board, and consequently
stipulates in Rule No. 2 that:

“The membership of the Personnel Selection Board can be modified, provided it

conforms to the composition prescribed in CSC No. 3, s. 2001. Agencies may add a
reasonable number of members, but the prescribed composition may not be reduced.
PSB members must be duly designated and their names posted in the agency bulletin
board.”

WHEREAS, there is an urgent need to establish the Personnel Selection

Board in the Legislative Department in compliance with the provisions of the Local
Government Code of 1991, Civil Service Commission Memorandum Circular No. 03 s.
2001 which states more particularly on Section 6, subsections a (a.3), b and c, and
Civil Service Commission Memorandum Circular No. 04, s. 2005.

NOW THEREFORE

BE IT RESOLVED, by the 3rd Sangguniang Panlungsod, in its 1st Regular

Session assembled, to establish the Personnel Selection Board in the Legislative
Department from July 2013 to June 30, 2016 with the following composition,
to wit:
