Labour Laws-II

Unit I Introduction –

Conceptual frame work of Social Security-Evolution and concept of Social Security, Scheme of
Social Security, Constitutional Framework.UN Conventions on social security, Labour welfare,
safety and health. Role of the International Labor Organization in promoting social security,
labour welfare, safety and health.

Unit II-LAWS PERTAINING TO REMUNERATION:

Payment of Wages Act, 1936:

Significance and Historical background of the Act; Object and Application of the Act; Definition and
Concept of Wages; Payment of Wages; Deduction from Wages (Authorized and Unauthorized
Deductions); Authorities and their powers; Penal provisions under the Act.

The Minimum Wages Act 1948:

Aims & Object, Responsibility Minimum Wages Act, 1948;Theories and Concept of Wages , Aims &
Objects of Act, Definition, Concepts of Minimum, Fair and Living Wages, Methods of Wage Fixation &
Revision of rates of Wages, Constitutionality of Minimum wages Act; Working Hours and Determination
of Wages and Claim etc. Authority- Appointment &Powers under the Act. Penalties and punishment for
certain Offences; Exemptions and exceptions under the Act.

The Payment of Bonus Act, 1965:

Application of the Act; Definition of Employer, Employees and Salary or Wage; Computation of bonus;
Eligibility and Disqualification for Bonus; Payment of Minimum and Maximum Bonus; Deduction of
bonus ;Recovery of bonus ,Reference of Disputes under the Act; Appointment of Inspectors and their

Unit III- SOCIAL SECURITY LEGISLATIONS:

(i) The Employees’ State Insurance Act, 1948 :Fatal Accident Act, 1855 - Scope and significance; Aims,
Objectives and Scope; Definitions Corporation, Standing Committee and Medical Benefit Council,
Contribution Kinds of benefits and eligibility, Conditions, Adjudication of Disputes and claims.

(ii) The Employees’ Provident Funds & Miscellaneous Provisions Act, 1952: Aims, Objectives and Scope,
Definitions Central Boards and its Role Provident Fund Scheme; Deposit Linked Insurance Scheme;
Family Pension Scheme1971 and Employees Pension Scheme 1995- scope and significance.
(iii) The Employees Compensation Act, 1923: Definitions, Aims & Object, Liability of Employer, Notional
Extension & Defenses, Determination of Amount of Compensation, Compensation when due-Penalty for
default, Contracting Out (Sec.17), Appointment & Powers of Commissioner (Sec.19-31), Recent
Amendment.

(iv) The Maternity Benefit Act,1961:Aims & Object, Definitions, Restriction on employment, Right to
Maternity Benefit, Medical Bonus, Leave Dismissal during Pregnancy (Sec.10-16), forfeiture of Maternity

The Contract Labor (Regulations and abolition) Act, 1970:

Object and Scope of the Act; Definition of the Contractor, Controlled industry,Establishment,Employer
and workman; Registration of establishment employing contract labour;Effect of non-registration
;Prohibition of employment of contract labor; Licensing of Contractors;Revocation,suspention and
amendments of licence;Welfare and Health of Contract Labour;Penalties;Authorities of the Act.

Unit V- Unorganized Sector

The Unorganized Workers’ Social Security Act, 2008:
