 PROCEDURE OF FORWARD AUCTIONING
 POSCO IDPC will declare its Starting Price (SP), which shall be visible to the all vendors during the start of the
forward Auction.

 The start price of an item in online forward auction is open to all the participating bidders. Any bidder can start
bidding, in the online forward auction, from the start price itself. The second online bid and onwards will have to be
higher than the H1 rate by minimum one increment value, or higher.

 The minimum bid increment amount shall be display at the time of auction. The Bidding Rates will be on
Per MT /Per Number etc.

 Bidding in the last minutes and seconds should be avoided in the bidders own interest Neither the Service
Provider nor Seller will be responsible for any lapses /failure on the part of the vendor, in such cases.

 The Auto Bid feature allows Bidders to place an automated bid against other Bidders in an auction and bid
without having to enter a new amount each time a competing Bidder submits a new offer.

 Auto bid is not a confirmed bid. It is only the maximum ceiling amount set by the bidder to enable the auction
engine to place bids on his behalf, whenever he is out bided, up to the ceiling set by him.

 You will be able to view the following on your screen along with the necessary fields in the Forward Auction:-

(a) Highest Bid in the Auction.

(b) Bid Placed by you.

(c) Opening Price & Increment Value.

(d) Final Closing Price.

Training: Steelez.com will provide training (online) if required by the bidders at a mutually Convenient date
and time before the Auction.

TERMS & CONDITIONS OF FORWARD AUCTION

(TO BE SIGNED ON EACH PAGE BY THE PARTICIPANT IN AUCTION)
 Subject to the reserve price, if any, fixed by POSCO-IDPC and subject to the terms and conditions set out
herein, sale shall be made to the HIGHEST BIDDERS (H1 and H2) on “AS IS WHERE IS BASIS “and NO
COMPLAINT BASIS IS.”POSCO-IDPC does not undertake any responsibility to procure any
permission/license etc. in respect of the auction property offered for sale.
 After the Lifting the material, Buyer is supposed to the check the material with respect to Invoices before
taking out the material from the seller premises.
 POSCO IDPC reserves the right to enter into parallel contact to more than one bidder. In that case H2 party
needs to match H1 price. H1 bidder will lift the material for first part of working days of the contact period as
per SOB (Share of Business). H2 bidder will lift for second half of working days of contact period as per SOB.
 POSCO IDPC reserves the right to modify and amend the terms & conditions and announce the same at any
time before the auction concludes. Announcements during the auction on the website including announcement
of any additional conditions OR correction in the catalogue and/or additions or deletions of items being offered
for sale are being done with the consent and knowledge of POSCO-IDPC and it is binding on the bidder.
 POSCO IDPC and e-Business dot Com Pvt Ltd is not responsible for any damages, including damages that
result from, but are not limited to negligence. E-Business dot Com Pvt. Ltd will not be held responsible for
consequential damages, including but not limited to systems problems, inability to use the system, loss of
electronic information etc. POSCO-IDPC Steelez.com will not entertain any complaints or objections once Bid
is placed.
 In the event of failure on the part of the successful bidder to fulfill his contractual obligations ,POSCO-IDPC
Steelez reserves the right to debar such bidder from participating in any future auction conducted by Steelez on
behalf of POSCO-IDPC and take any other penal action as described in the contract.
 The highest bidder does not get any right to demand acceptance of his offer. SELLER reserves the right to
accept/ reject/ cancel any bid, withdraw any portion of the Auction Property at any stage from Auction even
after acceptance of bid/ issue of delivery order or release order/ deposit of full value by successful bidder
without assigning any reason thereof. In the event of such rejection/ cancellation/ withdrawal, SELLER, shall
refund the value of Auction Property, if paid for, to the successful bidder. SELLER shall not be responsible for
any damages/loss whatsoever to the successful bidder on account of such withdrawal. Quantity can vary 25 %
+- on th material Auctioned.
 In no case, Buyer will be allowed to take the materials without complete payment of Invoice.
 LIFTING OF MATERIAL:-The time is the essence of the contract and the successful tenderer (s) should
start lifting the material with immediate effect on award of contract.

 PENALTY FOR NON LIFTING OF MATERIAL:-In case the materials are not lifted from the factory
as indicated in the Contract sheet/schedule, POSCO-IDPC, reserves its rights to dispose it off to any other
party and loss will be made good by the successful tenderers and POSCO-IDPC, The successful tender(s)
shall also be liable to pay loss and damages. No extension will normally be permitted either for deposit of
amount or for lifting the materials. Such extension, if any, in special case, will be valid only if permitted in
writing by POSCO-IDPC
 NO DELAY IN LIFTING OF MATERIAL & PAYMENTS.
 The quantity of scrap may vary as per production volumes. Penalty for not lifting as per Penalty Clause.
 There shall be no employer/employees relationship between The Buyer and POSCO-IDPC, The Buyer shall
have entire charge/control/supervision of the work here in and this manner will be answerable or accountable
for any accident or injury of any kind or death which may occur to any of The Buyer’s employee during the
time and in the course of the performance of the work under this contract or for any injury, loss or damage
arising from negligence or carelessness of The Buyer or their property including the employees, supervisor
office or agents of the POSCO-IDPC and its proprietor nor for any amount, claim or liability civil or criminal
pertaining to license, taxes permits for overtime work or any other permits, all of which shall be for the
account of The Buyer, Who hereby covenant and agrees to assume all claims arising out of and related to
foregoing including but not limited to other direct or indirect Labor problem and claims and to hold the
POSCO-IDPC officer, agents and employees free and harmless there from.
 The Customer shall be solely responsible to pay the wages and any other dues / claim in respect of such staff
and will also abide by and deposit mandatory dues under the PF Act, ESI Act and any other act which may
come into force at any later stage/related to this contract. Details of PF & ESI of employees should be paid on
monthly basis along with loading charges.
 Sellers will not at any time be responsible for any injuries caused due to accident within its premises either to
the buyer or his representative / labor etc., and the buyer will make proper arrangements for any claim arising
out of the employment under any status. It is the responsibility of the buyer to provide necessary safety
appliances (like hand gloves / safety shoes etc.,) to the laborers, who are engaged for loading the materials.
 If any accident or damage to the property / life etc. arises by reason of any act of negligence / omission /
default or non-compliance with any of the Terms & Conditions or statutory regulations or rules and regulations
applicable within the Seller’s premises, on the part of the Buyer / his representative or employees, resulting in
death or injury to any persons or damages to the property of the SELLER or any third party, then in such an
event the Buyer will have to pay compensation to such person including the employees of the SELLER for
such accident or injury / death or damage caused to their employees or to any of the Seller’s employees or to
others or to the Seller’s property. The Buyer shall in such event, keep the SELLER fully indemnified from any
demand, claims or proceedings thereof.
