Subject: IMPROVEMENT IN GENERAL STATE OF CLEANLINESS


Cleanliness of cities and towns is one of the most important
functions of Urban Local Councils. Efficiency of the sanitary staff can be judged
from the level of the sanitary services provided by councils. This objective can
only be achieved if streets are cleaned daily and solid wastage collected
periodically from well identified collection points and disposed off in proper and
efficient manners at the disposal sites. This requires clear planning and constant
supervision. It has, therefore, been decided that all the administrators/Chief
Officers and Municipal Medical Officers of Health should carry out weekly
inspection with regard to cleanliness of each ward forthwith.

To adjudge and ascertain that the inspections are carried out


systematically and to verify that those have actually and physically being carried
out, a quantified inspection Performa is being enclosed. All Inspecting officers
carrying out inspection should fill in this inspection Performa and submit the
same to the competent authority duly signed for information and verification, if
required.

Subject: OFFICES AND RESIDENCES FOR KEY OFFICERS OF THE


DISTRICT GOVERNMENTS

The competent authority has approved following policy for the offices and
residences for the key officers of the District Governments:
(a) The Residence of the Deputy Commissioners will be used by the
District Coordination Officers (DCOs) for residential purpose.
(b) The Residences of commissioners which are already on provincial
pool shall be kept vacant. The houses/surplus land attached with
these houses shall be disposed off through sale/auction later and new
houses of appropriate size constructed to accommodate officers of
District Government.
(c) The Office of the District Nazim may be established in the D.C.
Office Complex.
(d) The District Coordination Officer may hold office in the D.C. Office
Complex.

(e) Suitable rest houses/houses of Chairman Zila Councils may be


allocated for residential/accommodation of Zila Nazim wherever
available. Alternatively they may be provided Rs. 30000/- as house
rent allowance in Divisional Headquarters and
Rs. 20000/- in other places.
2. Please take further necessary action in the light of above guidelines and
send implementation reports.

Subject: AUTHORIZATION TO MAKE EXPENDITURE OUT OF THE


LOCAL FUND.

Under Section 107 of the Punjab Local Government Ordinance 2001,


every District Government, Tehsil Municipal Administration, Town Municipal
Administration and Union Administration is required to establish a Local Fund.
In order to regulate the expenditure out of this Local Fund, the Government shall
frame the Rules under Section 191 of the Punjab Local Government Ordinance,
2001. Till such time the rules are framed by the Government, temporary
arrangements as provided hereunder are being made within the meaning of
Section 197 of the said Ordinance to enable the local governments to meet their
necessary expenditure.

2. Under Section 112 of the said Ordinance, the local governments shall
prepare their budgets for the remaining part of the current financial year after
assuming the office and present it to the concerned Council for approval. This
exercise is to be completed by the local governments within ten (10) weeks of
their assumption of office. The Government has considered the issue of
expenditure out of the Local Fund by the District Governments and
Tehsil/Town/Union Administrations till the approval of their Budgets by the
concerned councils. In order to remove this difficulty the Government in exercise
of powers under Section 197 of the Punjab Local Government Ordinance, 2001,

have decided as follows:


(i) The Nazims of the respective local governments (District
Government, Tehsil/ Town Municipal Administration and
Union Administration) are authorized to make expenditure out
of the Local Fund on the items given below:
(a) Expenditure on salaries/pensions of the employees of the
dissolved local councils.
(b) Expenditure on utility charges.
(c) Expenditure on POL.
(d) Expenditure on stationary.
(ii) The expenditure on items mentioned above except on
salaries/pensions shall be subject to the conditions and
limitation given below:

3. The expenditure incurred during this period will be subject to


fulfillment of codal requirements.

instructions to the Union Nazims of their respective districts.

Subject: OPERATION OF LOCAL FUND BY LOCAL


GOVERNMENTS

The Punjab Local Government Ordinance, 2001 [S. 107] stipulates


the establishment of a Local Fund for each District Government, Tehsil/Town

Municipal Administration and Union Administration.

2. Under the provisions of S. 107(2) of the Ordinance, the following


sums shall be placed at the credit of the Local Fund of a local government-
(a) the funds of a Metropolitan Corporation, Municipal
Corporation, District Council, Municipal Committee, Town
Committee and Union Council transferred to a local
government as its successor under Section 180 of the
Ordinance;
(b) monies transferred by another local government under the
Ordinance;
(c) grants made or monies received by a local government from
Government or other authorities;
(d) the proceeds of taxes or charges levied by a local government
under the Ordinance;
(e) rents and profits payable or accruing to a local government
from immovable property vested in or managed by it;
(f) receipts accruing from trusts administered or managed by a
local government;
(g) interest or profits from bank accounts, investments or
commercial enterprises of a local government;
(h) gifts, grants or contributions to a local government by
individuals or institutions;
(i) income accruing from markets regulated by a local
government;
(j) fines paid with respect to offences under the Ordinance or bye-
laws or under any other law for the time being in force in
which provision is made for the fines to be credited to the
Local Funds established under the Ordinance, committed in
the local area of a local government;
(k) refundable deposits received by a local government in respect
of a local fund;
(l) proceeds from other sources of income which are placed at the
disposal of a local government under directions of the
Government; and
(m) any other sum received by or on behalf of a local government
under the Ordinance or any other law for the time being in
force.
3. The Local Fund for your respective local government may be

established immediately as is required under the said Ordinance.

4. The rules and procedures for operation and maintenance of the Local
Fund are under process. However, in order to meet, necessary expenditures the
Local Fund may be operated and maintained in accordance with the following
arrangements:

Subject: SETTING UP OF OFFICES OF THESIL NAZIMS.


Tehsil/Town Municipal Administations, headed by Tehsil Nazims have
been established in all the Tehsils/Towns of the Province. The Provincial
Transition Team had directed the District Transition Teams to establish the
offices of the Tehsil Municipal Administations within the premises of urban local
councils at Tehsil Headquarters and such offices have already been established
there.

2. It has been learnt that at some places Tehsil Municipal Administration are
desirous of acquiring offices and residences of Ex-Assistant Commissioners who

have been re-designated as Deputy District Officers (Revenue). This would be


against the directions of the Government.

3. It is desired that directions of the Government should be followed in letter


and spirit.

Subject: REGISTRATION OF DEATHS AND BIRTHS.


This is with reference to the minutes of the meeting held under the
Chairmanship of Governor Punjab on 5-11-2001. The matter cited as reference
was also discussed. It was observed that the procedure to register the births and
deaths within the union councils needs to be streamlined and every effort should
be undertaken to ensure the prompt registration of deaths/births by all concerned.
It was further observed that in order to preserve the existing data on the above
mentioned subject maintained by the defunct Urban Local Councils foolproof
arrangements should be made by various successor offices.

2. It is, therefore, requested that necessary steps may be undertaken to


implement the above directives of the Governor, under intimation to this
Department.

Subject: HONORARIA AND ALLOWANCES FOR NAZIMS AND


NAIB NAZIMS.
The Government of the Punjab has approved the following package
of honoraria and allowances of Zila Nazims, Naib Zila Nazims, Tehsil/Town
Nazims, Naib Tehsil/Town Nazims, Union Nazims and Naib Union Nazims for
adoption by the Local Governments in the Punjab. Details are given below :

(a) Zila Nazims and Naib Nazims


1. Honoraria Zila Nazim is entitled to draw honorarium
@ Rs. 15,000/- p.m. and Naib Zila Nazim is
entitled to draw honorarium @ Rs. 10,000/-
p.m.
2. Travelling allowance Zila Nazim is entitled to use official vehicles
for journeys while on official duty. If
official vehicle is not available private
vehicle can also be used as per Government
Rules. Also entitled to travel by air
(economy class)
3. Daily allowance Zila Nazim is entitled to draw Daily
Allowance @ Rs. 500/-
4. Use of Government Zila Nazim is entitled to stay at Government
Rest Houses Rest Houses subject to payment of normal
charges while on tour. If no Government
Rest House is available, hotel
accommodation can be acquired on payment
equivalent to three times of the daily
allowance.
5. Entertainment Zila Nazim is entitled to entertainment
allowance allowance @ Rs. 2000/- p.m.
6. Medical allowance Zila Nazim is entitled to free medical
treatment for self and family at Government
Hospitals as available to Civil Servants in
BS-20/21.
7. Telephone No limit for the Official use of Zila Nazim

and 1500 calls for residential Telephone.


(b) Tehsil/Town Nazims and Naib Nazims
1. Honoraria Tehsil/Town Nazim is entitled to draw
honorarium @ Rs. 8,000/- p.m. and Naib
Tehsil/Town Nazim is entitled to draw
honorarium @ Rs. 5,000/- p.m.
2. Transport Tehsil/Town Nazim is entitled to use official
vehicle up to 1000 cc.
3. Travelling allowance Tehsil/Town Nazim is entitled to use official
vehicles for journeys while on official duty.
If official vehicle is not available private
vehicle can also be used as per Government
Rules.
4. Daily allowance Tehsil/Town Nazim is entitled to draw Daily
Allowance @ Rs. 400/-.
5. Use of Government Tehsil/Town Nazim is entitled to stay at
Rest Houses Government Rest Houses subject to
payment of normal dues while on tour. If no
Government Rest House is available, hotel
accommodation can be acquired on payment

2. The Zila Nazims of the Districts of Lahore, Gujranwala, Rawalpindi,


Sargodha, Faisalabad, Multan, Bahawalpur and D.G. Khan are also entitled to
draw house rent allowance @ Rs. 30,000/- per month, and the Zila Nazims of
other Districts of the Punjab are entitled to draw house rent allowance @ Rs.

20,000/- per month.

NOTIFICATION

No. S.O. IV(LG) 10-1/2002. Shortage of sanitary staff in the Tehsil Municipal
Administrations has been under consideration of the Government for quite
sometime. The Governor of the Punjab has been pleased to allow 20% {Twenty
%} increase in the sanctioned strength of sanitary workers in each TMA as on
30.6.2001.

2. Each Tehsil Municipal Administration is allowed to amend their


Schedule of establishment accordingly. The expenditure on salary of newly
created posts shall, however, be met by the respective TMAs out of their own
budget. Recruitment against these posts shall be made on contract/work charge
basis as laid down in this Department’s circular of even No., dated 8th December,
2001.

3. This issues with the approval of Secretary, LG&RD Department.

Subject: SCHEDULE OF ESTABLISHMENT OF TMAs


The Schedule of Establishment of Tehsil/Town Municipal
Administrations drawn up by the TMAs in consultation with the respective
District Coordination Officers has been examined by the LG&RD Department.

2. Your attention is invited to Section 67(iii) of the Punjab Local

Government Ordinance, 2001 relating to functions and powers of Tehsil Councils


which is reproduced as under:
“Tehsil Council shall approve annual budget and appropriations for the
Tehsil Municipal Administration.”
3. It is requested that further necessary action may be taken accordingly
in the light of the following:
(i) All sanctioned posts of defunct Urban Local Councils (duly
verified by Audit) falling within the jurisdiction of the
concerned TMA shall continue to stand sanctioned on the
Schedule of Establishment of the respective TMA w.e.f. 1st
July, 2002. Schedule of Establishment is to be approved by the
respective Tehsil/Town Council. However, ban on fresh
recruitment will continue till further orders.
(ii) A 20% increase in the sanctioned strength of the sanitary
workers is allowed as already notified vide this Department’s
notification No. SO.IV(LG)10-1/2002, Dated 28th May, 2002.
(iii) The employees of defunct Zila Councils, LG&RD Department,
PHED, H&PP and defunct Development Authorities like BDA
and DGKDA shall continue to be part of Schedule of
Establishment of the respective TMA in which they have been
posted.

This is in continuation of this Department’s letter of even number
dated 20.6.2002 on the subject noted above.

2. It is further clarified that all posts pertaining to Education, Health


and other functions which are no longer within the purview of Tehsil/Town
Municipal Administrations under the Punjab Local Government Ordinance,
2001, shall stand abolished from the Schedule of Establishment of Tehsil/Town
Municipal Administrations on 30-6-2002 and the same number of posts shall

stand sanctioned on the Schedule of Establishment of respective District


Governments with effect from 1st July, 2002.

3. Further necessary action may be taken accordingly.

Subject: SCHEDULE OF ESTABLISHMENT OF TMAs / UNION


ADMINISTRATIONS.
This is in continuation of this Department’s letters of even number,
dated 20.06.2002 and 25.06.2002 on the above noted subject. It is clarified that
all the employees of LG&RD Department, defunct Zila Councils, defunct Urban
Local Councils (now TMAs) and others posted in the Union Administrations as
Secretary Union Councils/Naib Qasids etc. subject to a maximum of three
Secretaries and two Naib Qasids per Union Administration shall now become a
part of Schedule of Establishment of the respective Union Administrations in
which they have been posted. These posts shall stand abolished from the
Schedule of Establishment of LG&RD Department, defunct Zila Councils and
defunct Urban Local Councils/ TMAs on 30.06.2002 and will be borne on the
Schedule of Establishment of respective Union Administrations w.e.f. 1st July,
2002. The Union Administrations should complete all codal formalities by
getting the Schedule of Establishment approved from their respective Union
Councils.

2. All the Union Nazims are advised to ensure that the employees
posted in their Union Administrations should get their salaries w.e.f. 01.07.2002
out of the Budget of their Unions.

Subject: POLICY FOR ALLOTMENT OF PLOTS FOR MOSQUES


AND RELIGIOUS INSTITUTIONS
In partial modification of the instructions contained in this
Department’s letter of even number dated 03-4-2001 on the above cited subject,
the Government has designated the Ziia Nazim as the Convenor of District
Mosque/Religious Institutions Committee to regularize / streamline the policy of
allotment of plots/ sites for Mosques/Religious institutions. However, remaining
members of the committee and policy instruction will be notified later on.

by the District Governments / City District Government up to 1st August, 2002
for the purpose of payment of salaries for the months of June and July, 2002 to
such employees of these Governments who were previously drawing their
salaries from Local Fund.

Subject: RELEASE OF FUNDS TO THE UNION ADMINISTRATIONS


— PAYMENT OF SALARIES
The Government of Punjab, Finance Department vide their order
No.EXP(LG)1-12/2002, dated 19th August, 2002 has released an amount of Rs.
450.360 millions @ Rs. 60,000/- (Rs. sixty thousand only) per month to each
Union Administration in the Punjab except the Union Administrations of City
District Lahore. Where the funds @ Rs. l80,000/- (Rs. one hundred eighty
thousand only) have been released to the Union Administrations of the City
District Lahore.

2. It is clarified here that the aforementioned grant released by the


Finance Department includes salaries of employees posted in the Union
Administrations. Thus the payment of salaries would be the first charge on the
funds of the Union Administrations.

3. In view of the above, it is requested that all the Union


Administrations falling within your District should be advised to make payment
of salaries to their staff including all the Secretaries, Naib Qasids/Chowkidar etc.
out of their budgets in accordance with this Department’s letter of even number,
dated 27th June, 2002.

Subject: HOLDING OF CATTLE MANDIS/MARKETS.


Under the provision of Punjab Local Government Ordinance, 2001,
16 Compendium of Instructions for Local Governments

TMAs are competent to hold cattle markets/cattle mandis. To generate the funds,
TMAs are establishing new cattle markets without the approval of the
Government and without framing of bye-laws. The cattle mandis are established
without keeping in view the distances, days of the existing cattle mandis which
create undue litigation and adversely effects the income of the TMAs. The
contractor maneuvered to get contract of newly established cattle mandis at very
low rate to adversely affect and fail the cattle mandi being held previously.

2. To streamline this position, it has been decided by the Government that the
following instructions may be kept in view while establishing the new cattle
mandis:
(i) No new cattle market/cattle mandi may be established without prior
approval of the Government.
(ii) While sending proposals for establishing a new cattle markets, the
days and the distance of the surrounding cattle mandis which are
being held before 14-08-2001, may be mentioned in the proposal
along with map i.e., the day is not the same and the distance should
not less than 5 K.M.
(iii) The collection rights of any cattle mandi may not be leased out
beyond one year as provided under the Lease Rule, 1990.
(iv) The earnest money for the contract should also be realistic.

NOTIFICATION
NO. SO-IV(LG) 1-10/2002. In exercise of the powers conferred upon him under
Section 197 of the Punjab Local Government Ordinance, 2001 (XIII of 2001), the
Governor of the Punjab is pleased to allow the District Governments to discharge
the pensionary liabilities of the retired/retiring employees of the erstwhile Zila
Councils/Metropolitan Corporation, Lahore out of their existing Pension Fund
being maintained as Local Fund w.e.f. July 1, 2002.

2. Following procedure shall be observed while discharging such


pcnsioncry liabilities:
(a) The pensionery liabilities of the retired employees of the
erstwhile Local Councils, which now accrue to the respective
District Government out of the District Fund w.e.f. July 1,
2002 may continue to be discharged out of the respective
“Pension Fund” - being maintained separately as Local Fund.
(b) The monthly payment of pension to such employees shall
w.e.f. 01.07.2002 be made by the accounts branch of the office
of the Executive District Officer (Finance & Planning) of the
respective District Government. The pension vouchers shall be
authorized under the signature of Executive District Officer
(Finance & PIanning)/District Officer (Accounts).
(c) For the purpose of such disbursement the relevant pension
record of all pensioners shall immediately be transferred to the
office of the Executive District Officer (Finance & Planning)
of the District Government by the erstwhile Local Councils to
which such retired employees belong.
(d) The pension cases of all employees of the erstwhile Local
Council retiring from the District Government shall be
sanctioned in the prescribed manner to the Office of the
Executive District Officcr (Financc & Planning) who shall be
the Pension Sanctioning Authority. The pension payment
orders shall also be issued under the joint signatures of the
District Coordination Officer and the Executive District
Officer (Finance & Planning).
(e) For the purpose of verification of service of the retiring
employees of the erstwhile Local Councils, the relevant service
record may be send to the Office of the Executive District
Officer (Finance & Planning). The scrutiny of service record
for the purpose of determining the admissibility of pension
shall be carried out by the District Officer (Accounts).
3. The pension contribution in respect of employees of the respective
Local Council, shall be sent out of the “District Fund” at the rate prescribed by
the Local Government & Rural Development Department. The District
Government shall, for this purpose, make budgetary allocations under the
relevant object classification.

4. The Executive District Officer (Finance & Planning) shall issue


requisite sanction at the end of each month, and draw the aggregate amount of

such contributions from the respective District Accounts Officer/Accountant


General, Punjab on the submission of a bill in the prescribed manner. Tlic
District Accounts Officer/Accountant General, Punjab shall authorize the
sanctioned amount through a pre-audit cheque “Payees Account” for credit to the
relevant bank account maintaining the “pension fund”.

Subject: FUNCTIONING OF LOCAL GOVERNMENTS IN LAHORE


SYSTEM BASED SOLUTION.
I am directed to refer to the subject meeting held on 12-11-2002. The
issue regarding maintenance of roads in Lahore was discussed thread-bare and it
was agreed that the maintenance and up-keep of thirty major roads will be the
responsibility of the City District Government, in all respects, including street
lights, road marking etc. The maintenance and up-keep of the remaining roads in
all respects including street lights, road markings etc., will be the responsibility
of the respective Towns.

2. The recommendation of the meeting was submitted for the approval of


Governor, Punjab. He has approved the following decision:
“Thirty major roads will be maintained by City District Government
while remaining roads will be maintained by respective towns. This
list of roads will be notified by City District Government
immediately.”
3. It is requested that decision may be implemented in letter and spirit
and compliance report may be submitted within 10 days.

The competent authority has approved the following procedure for


grant of Ex-Pakistan Leave/out-station stay of the Nazims and Naib Nazims of
the Local Governments in the Punjab:
1. The Nazims and Naib Nazims shall obtain permission from
Government of the Punjab before proceeding on Ex-Pakistan Leave.
In case of Zila Nazims specific approval of the Chief Minister,
Punjab shall have to be obtained through LG&RD Department.
2. All references in this regard must reach the LG&RD Department at
least 15-days prior to the date on which leave is to commence.
3. The following authorities shall be informed by the Nazims/Naib
Nazims of the Local Governments whenever they intend to leave
their respective stations (District Headqurters in case of Zila Nazim
and Naib Zila Nazim, Tehsil/Town Headquarters in case of
Tehsil/Town Nazim and Naib Tehsil/Town Nazim and Tehsil/Town
area in case of Union Nazim and Naib Union Nazim).

Subject: MATTERS PERTAINING TO PENSION OF THE


EMPLOYEES GOVERNMENT / ERSTWHILE LOCAL
COUNCILS
With the implementation of the PLG Ordinance, 2001, the
administrative functions and financial management of the offices of Local
Government and Rural Development Department, Housing, Urban Development
and Public Health Engineering Department at the Regional, Zonal,
Circle/Divisional, District/Tehsil and lower tiers stand entrusted to the Tehsil
Municipal Administrations (TMAs).

2. To give effect to the provisions of Section 52 read with Sections


53(4) and 183(1) ibid, the civil servants working in the field formations of the
aforestated departments, and the employees of the erstwhile Local Councils were
transferred and adjusted in the Tehsil Municipal Administrations (TMAs) and
Union Administrations (UAs), in the light of this Department’s circular No. SO-
IV(LG)10-1/2002 dated 20-6-2002.

3. Meanwhile, the employees of Education and Health sectors of the


erstwhile Urban Local Councils were transferred and adjusted in respective
District Governments in the light of the policy contained in this department’s
letter of even number dated 25-6-2002. With the expiry of transitional phase of
devolution, and with effect from July 1st, 2002, the respective Local
Governments started paying salaries to such staff as borne on the schedule of
their respective establishments.

4. After the issuance of this Department’s notification of even No.


Dated 23-10-2002, inter-alia, establishing a “Pension Local Fund” in District
Governments, and proscribing a procedure for regulating the said fund, the issues
pertaining to sanction and payments of pension etc., to the employees of defunct
Zila Councils / MCLs adjusted in District Governments have been settled.

However, the employees of the govt. departments and the erstwhile Local
Councils, other than those mentioned above on their adjustment in local
governments, have raised questions and expressed concerns regarding the matters
pertaining to their pensionary affairs. Such issues have therefore, been engaging
the attention of the Government for redressal.

5. The employees transferred and adjusted in Local Governments fall in


the following four categories:
(i) civil servants adjusted in TMAs/UAs, including the Secretaries
working in erstwhile union councils, prior to devolution;
(ii) employees of erstwhile urban local councils, including the
employees of education and health sectors adjusted in District
Governments;
(iii) employees of erstwhile urban local councils and Zila Councils
adjusted in the respective successor Local Government
(TMAs) and,
(iv) employees of erstwhile urban local councils and Zila Councils
adjusted in Union Administrations.
6. Since the pension of an employee is a valid accrued liability on the
funds of the organization, it has been decided that it shall be sanctioned and paid,
in the manner, as already prescribed, by the government / successor local
government, respectively, for the employees as per the following procedure:
(i) The pension liability of civil servants falling in category
mentioned in para 5(i) above shall be borne by the
government. The TMA/UA, as the case may be, shall not be
required to make pension contribution in this respect. The
pension cases of such retiring civil servants shall be processed
and finalized by the erstwhile respective departmental
authorities, in the prescribed manner, on the basis of the last
pay certificate / service statement issued to the pension
sanctioning authority by the Tehsil Accounts Officer/Union
Nazim, as the case may be. The P.P.O’s shall be issued by the
Accountant General, Punjab / District Accounts Officer
concerned.
(ii) Pensionary liabilities in respect of the employees falling in
category mentioned in para 5(ii) above shall be shared
proportionately between the respective successor TMA as per
calculations worked out, and PPO issued by District
Government in the manner prescribed in this department’s
Compendium of Instructions for Local Governments 23

notification of even number dated 23-10-2002.


(iii) The pensionary liabilities of the employees falling in category
mentioned in para 5(iii) above shall continue to be discharged
out of the respective “Pension Fund” maintained under the
West Pakistan Local Council (Pension) Rules, 1964, and this
department’s circular No. SO-IV (LG) 5-2/81, dated 15-04-
1991.
(iv) The pension contributions in respect of the employees falling
in category mentioned in para 5(iv) above shall be made by the
union administration to the parent successor local government
i.e. District Government or the TMA, as the case may be, in
respect of each employee, as prescribed in this department’s
circular letter referred to para 6(iii) above.
7. PENSION SANCTIONING AUTHORITY:
The pension sanctioning authority in respect of civil servants, and
employees of erstwhile Local Councils posted in TMAs/UAs shall remain the
same as prescribed for such category of officials prior to their present postings.
The sanction for encashment of LPR of civil servants posted in TMAs/UAs shall
also be done by the respective authorities as prescribed for such category of
officials prior to their present postings.
8. LEAVE SANCTION:
The grant of sanction of leave of employees posted in TMAs/UAs
shall continue to be accorded under the Revised Leave Rules, 1981. The sanction
of such leave shall be done by the prescribed respective departmental authorities
in the erstwhile manner. Such leave shall, however, be subject to the
recommendations of the Tehsil Municipal Officer concerned in case of gazetted
Officers, and the / Tehsil Officer concerned, and the Nazim of Union
Administration, as the case may be, in case of non-gazetted employees.

that all such unauthorized constructions cannot be acquiesced by the Provincial
Government, therefore, all such activities should immediately be stopped and in
all such cases necessary permission may be obtained from the Government of
Punjab (Board of Revenue) which is the absolute owner of such State Land.

Subject: TAKING COGNIZANCE OF UNDESIRABLE ACTIVITIES


In the context of functions of Tehsil Municipal Administration, it has
been observed that Tehsil Municipal Administrations are not taking cognizance
of undesirable activities like industrial and hazardous waste, wall chalking,

affixing of posters, advertisement and bill boards and proper disposal of


industrial waste. As a result, cities all over Punjab look unclean apart from
reflecting urban and civic degradation. It is high time that the Tehsil Municipal
Administrations take cognizance of such offences, punishment of which has been
prescribed under the Punjab Local Government Ordinance, 2001. Following need
your specific attention:
(i) Regulating the affixing of signboards and advertisements
Under Section 54(g) of the Punjab Local Government Ordinance,
2001, Tehsil Municipal Administration is required to regulate
affixing of signboards and advertisements including all kind of
signage. No regard is being made to standardize the signboards/
billboards or regulate the mode of advertisements including the wall
chalking. The TMAs are, thus, required to regulate such activities, as
provided under the law.
(ii) Sanitation and solid waste collection and disposal of industrial
waste
Under Section 54 (h) (iv) Tehsil Municipal Administrations are
required to make necessary arrangements for sanitation and solid
waste collection and to arrange for disposal of industrial wastes.
Under Section 3 of Fourth Schedule discharging any dangerous
chemicals, inflammable, hazardous or offensive articles in any drain,
or public water course or public land in such manner as to endanger
the lives of persons living or working in the area / neighborhood, or
cause risk, to the property is an offence. Besides, under Section 45
(4) and 46 (1), the concerned Local Government can direct the
commercial or industries concerns to provide for the disposal of
wastes in the prescribed manner; failure on the part of the owner or
tenant or occupier shall be liable for punishment in lieu of such
municipal offence.
2. Chapter XVI provides legal procedure for taking cognizance of
municipal offence narrated as above. Tehsil Municipal Administrations may take
necessary action to curb the incidence of the undesirable and illegal actions being
taken by some public quarters, in this regard.

Reference this Department’s memorandum No.SO.III/2-11/80, dated
07-07-1982.

After promulgation of Punjab Local Government Ordinance, 2001,


the instructions contained in the above said memorandum have become
redundant and no longer applicable. Matters relating to the Local Governments
Properties are to be dealt as per provision under Section 124 of the Ordinance.
Regarding 10% annual increase in rent of land/shops leased by the Local
Governments, the procedure is clarified as under:
(i) The agreements which were settled prior to promulgation of
Punjab Local Government Ordinance, 2001 shall be governed
in accordance with the instructions issued vide letter No.
Compendium of Instructions for Local Governments 27

SO.III/2-11/80, dated 07-07-1982.


(ii) In those agreements which are made after promulgation of
Punjab Local Government Ordinance, 2001, all the parties are
bound to the terms and conditions settled therein.

Governments in contravention of the provisions of the Punjab Local Government
Ordinance, 2001 read with District Government Rules of Business, 2001 are
repatriating officers/officials i.e., transferring them out of their district who have
been posted in the Districts with the approval of the competent authority.

2. The Government has taken a serious view of this situation/non-


compliance of the provisions of law in this regard.

3. You are, therefore, directed not to repatriate officers / officials i.e.,


transfer them out of your district to the parent Departments without approval of
the Government as such actions are apt to cause serious legal implications.

2 It has come to the notice of the Government that provision of Rule 3


of Punjab Local Government (Auctioning of Collection Rights) Rules, 2003 is
not being adhered to in some Local Government which is as under:
A local government may prefer to collect any of its income as
specified in the Second Schedule of the Ordinance and duly
approved and notified in the official Gazette, through
contractor by awarding collection rights to him for a period not
exceeding one financial year.
Provided that contract of collection rights of such taxes, fees,
rates, cesses and other levies of a local government, demand of
which can be raised against a specific person and arrears of
which can be carried forward in his account, shall not be
awarded to a contractor in any case.
3. The proviso under sub-rule 3 above clearly indicates that collection
rights of all such taxes, fees, rates, cesses and other levies of local government
shall not be put to auction, or contracted out, demand of which can be raised in
the name of specific person (Tax payer) and arrears of which can be carried
forward in his account, in case of non-payment. The arrears of taxes, etc., are
recoverable; as arrears of Land Revenue, therefore, there is no justification to
auction such taxes.

4. Only collection rights of such taxes/fees can be put to auction


demand of which cannot be raised in the name of specific person and their arrears
can not be brought forward like Toll Tax, Parking fee, fee for slaughtering of
animals, tax on sale of animals, tax on transfer of immovable property,
advertisement tax etc. Auction of such taxes demand of which can be raised
against the specific person like Water rate, Building application fee, sanitation
fee, licence fees and lighting rate etc., cannot be put to auction.

5. All local governments are, therefore, directed to follow the spirit of


provision of Rule 3 of Punjab Local Government (Auctioning of Collection
Rights) Rules, 2003.

declaring staff (specially Taxation Staff) as surplus or laying them off on the
grounds that the collection of Tax has been stopped. In such an eventuality the
non-functional staff be adjusted against other assignments.

2. All the Tehsil Municipal Administrations are hereby advised to


adhere to the prescribed procedure for this purpose. No staff should be declared
surplus on the grounds that such a function has been evolved or devolved.

Subject: VERTICAL LINKAGES


In continuation of this Department’s letter number SOV(LG)5-
49/2002 dated 13-11-2002 on the above captioned subject it has further been
decided that:
(i) The transfer/postings functions relating to the employees of
LG&RD Department (Civil Servants) now working at various
tiers of local governments, previously exercised by ADLGs
will now be exercised by DO(HRM). Similarly, DCO will
replace DLGs. For transferring an official from one local
government to another within the district, NOC from both the
local governments would be necessary except where transfer is

required on administrative grounds. The transfer shall be made


on available vacant status posts only. The seniority of the
employees would be maintained as in the erstwhile system.
(ii) For employees of erstwhile urban/rural local councils governed
by Punjab Local Councils Servants (Service) Rules 1997, DCO
shall be the competent authority to make transfers from one
local government to another when both the local government
lie in different Tehsils/towns or when the transfer is being
made from one tehsil/town to another tehsil/town within the
same District or when the transfer is made between District
Government and a local government within the District. The
transfer shall be made against an available vacant status post
only. The conditions as specified by Rule (3) of Rules
mentioned above shall be adhered to in making such transfers,
i.e., the transfer would be made only on the request of the
official and after availing NOCs from both the local
governments. The transferred official would be placed at the
bottom of the seniority list at the new place of posting.
In case the official is transferred to a local government which
is the successor of the erstwhile local council where the
official originally belonged in the erstwhile system and to a
post that was part of the SoE of his parent erstwhile local
council, his seniority, upon such transfer shall remain intact as
was in the erstwhile system.
(iii) For employees of erstwhile urban/rural local councils governed
by Punjab Local Councils Servants (Service) Rules, 1997,
TMO will be the competent authority to make transfers from
one local government to another when both the local
governments lie in same tehsils/towns or when the transfer is
made between TMA and a Union Administration within the
tehsil/town. The transfer shall be made on an available vacant
status post only. The conditions as specified by Rule (3) of
Rules mentioned above shall be adhered to in making such
transfers, i.e., the transfer would be made only on the request
of the official and after availing NOCs from both the local
governments. The transferred official would be placed at the
bottom of the seniority list at the new place of posting.
In case the official is transferred to a local government which
is the successor of the erstwhile local council where the
official originally belonged in the erstwhile system and to a
post that was part of the SoE of his parent erstwhile local
council, his seniority, upon such transfer shall remain intact as
was in the erstwhile system.
(iv) These instructions shall not be applicable to education and

the Government’s instructions contained in letter dated 27-6-2002 whereby
Schedule of Establishment of Union Administrations was specified as consisting
of three Union Secretaries and two Naib Qasids.

2. I am further directed to state that Union Administrations cannot


amend the standard Schedule of Establishment without prior approval of the
Goveipment. Moreover, no direct recruitment can be made by the Union
Administrations till the formulation of Service Rules.

References are being received in the department from different local


councils stating that collection rights of different taxes have been leased out and
agreements have been executed with the contractors before issuance of Punjab
Local Government (Auctioning of Collection Rights) Rules, 2003. In some cases
contractors have made full payment. Cancellation of the contracts at this stage
would create undue litigation. TMAs have also submitted that adequate staff is
not available for the collection of these taxes. It has been requested by TMAs to
allow to continue the collection of these taxes through the contractors.

After thread-bare examination of the case, it is to inform you that the


Punjab Local Government (Auctioning of Collection Rights) Rules, 2003 were
issued vide letter No. SOV(LG)5-23/2003, dated 03-05-2003 and the same were
published in the official gazette on 14-05-2003. As per Rule-3 ibid, contracts of
collection rights of such taxes, fee, rates, cess and other levies of Local
Government, demand of which can be raised against a specific person and arrear
of which can be carried forward in his account shall not be awarded to a
contractor in any case. A clarification in this regard was also issued vide this
department’s letter of even number dated 22-7-2003.

You are, therefore, requested to take further necessary action in


accordance with the provisions of Punjab Local Government Ordinance, 2001,
rules and instructions issued in this regard from time to time. It is, further
requested that the provisions of Punjab Local Government (Auctioning of
Collection Rights) Rules, 2003 may please be observed in letter & spirit.

(d) He is not bankrupt and maintained active account in any
scheduled bank.
(e) He is not blacklisted by any institution.
(f) He is an income taxpayer and has valid National Tax Number.
(g) Registration & Renewal fee may be charged as under:

a large number of references have been pouring in the LG&RD Department


regarding clarification on the appointment of one child of a servant/employee of
(erstwhile) local council who dies while in service or is rendered medically
invalidated/incapacitated during service.

2. Appointment in such cases are made under Rule 17-A of


Appointment and Conditions of Service Rules, 1974 duly adopted mutatis
mutandis for its application to the employees of erstwhile Local Councils.

3. For the purpose of clarification, it is reiterated that there is no ban for


such kind of appointments. Moreover, in the new system of Local Government
the appointment in this regard shall be made by the successor Local Government
of the erstwhile local body where the official who has dies or has become
medically invalidated/incapacitated belonged in the former system.

4. However, for the employees of Education and Health sectors of


former Urban Local Councils who have been shifted to respective District
Government vide this Department’s letter dated 27-06-2002, such appointments
shall be made by the concerned District Government.

5. Relevant rules in this regard are enclosed for ready reference.

In continuation of this Department’s Notification of even number
dated 18-4-2002, I am directed to refer to the above captioned subject and to state
that LG&RD Department has been in receipt of a number of references seeking
clarification about the authority competent to take disciplinary action against
local council servants that have been adjusted at District Governments, TMAs &
UAs.

2. The matter has been examined. It is accordingly clarified that for


local council servants governed under the Punjab Local Councils Servants
(Service) Rules, 1997, the competent authority at the local government, which is
the successor of the erstwhile local body where the official belonged, shall take
disciplinary action regardless of the current place of posting of the official. For
officials transferred from one local government to another, it may be noted that
the competent authorities for this purpose are of the local government where the
official has been transferred, as provided vide Rule 3 of Rules ibid.

3. For employees of Health & Education sectors, placed under the


administrative control and supervision of District Governments, competent
authorities at respective District Government shall take disciplinary action, as
provided vide Notification of even number dated 18-04-2002.

1991.

3. Despite these instructions, the Department has been receiving


references where the retiring employees of (defunct) Zila Councils and Health &
Education staff adjusted at District Governments are facing problems on account
of slackness of the TMAs in tills regard.

4. I am, therefore, again directed to request that the pension


contribution etc., may immediately be consolidated and transferred to the
respective District Government. The list of such employees along with
consolidated figures of pension contribution shall be communicated to the EDO
(F&P) concerned under intimation to this Department.

Subject: PROMOTIONS IN NEW LOCAL GOVERNMENT SYSTEM

New Local Government System came into existence with the


promulgation of PLGO-2001 on 14th of August, 2001. As a result, various local
governments i.e., District Governments, Tehsil/Town Municipal Administrations
and Union Administrations were setup. Staffing requirements for the new local
governments were fulfilled by way of adjustments of the employees of former
local bodies. Various aspects of the service matters in respect of the said
employees, therefore, require fresh analysis and decisions. The need for new
promotion mechanism in the new setup has been engaging the attention of the
Department. In a bid to avoid future problems, owing to promotions being made
at the local governments in the absence of new law, a ban on promotions at
governments was imposed vide this Department’s letter dated 6-5-2003 while the
ie remained under active consideration of the Department. Accordingly new
procedure regulating the seniority and promotion etc., in respect of various
categories of employees at local governments is hereby specified as under:
(a) Employees of erstwhile Zila Councils/MCL now adjusted
at District Governments, TMAs and UAs
2. District/City District Governments have succeeded Zila
Councils/MCL. The District Local Council Servants of erstwhile Zila
Councils/MCL is, therefore, part of District Governments, a number of
employees of this group have, however, been treated (during the Transition
Period) at both Tehsil and Union levels. The staff has been dispersed within the
District at District Govt., TMAs & UAs.

3. Promotion, move-over and grant of selection scale cases for this


category of employees shall continue to be decided at the District/City District
Governments. For this purpose complete information/data about the staff and
their places of posting shall be maintained at the District. Former seniority lists
wouldn’t be disturbed. An official’s seniority will be independent of his place of
posting (whether District Govt., TMA or UA). For the purpose of promotion, all
the dispersed staff belonging to a cadre would be considered together as in the
former system. The promotions shall be made against vacant posts. In case the
post is occupied by way of ex-cadre adjustment of some non-defunct Zila
Council servant, an attempt would be made by the concerned local govt. to

rectify the ex-cadre adjustment. If the post to which an official is to be promoted


lies in a different local government and is vacant (or can be vacated because it is
occupied by an ex-cadre official), the official may be promoted and transferred to
the other local government against that post. It may be kept in mind that in the
process of transition in the new local govt. system, no post has been abolished
anywhere. All previous posts still exist, some of them have, however, been
shifted to other local governments. The promotion/selection committees along
with appointing authorities have already been prescribed vide this Department
Notification dated 18-4-2002.
(b) Employees of Education and Health Sectors of erstwhile
urban local councils now adjusted at District Governments
(excluding the Health and Education Functional Units of
LCS)
4. All the health and education staff of erstwhile urban local councils
was shifted to the respective Districts vide this Department letter dated 25-6-
2002. The posts were abolished from the Schedule of Establishment of TMAs
(successor of erstwhile urban local councils) and were created at the District
Governments. In the former system, seniority lists were maintained at the local
council level. Education/Health staff from various local councils has been
accumulated at each District. The seniority lists shall now be maintained as per
the erstwhile fashion. For that purpose all such staff at a District would be
considered as formed by smaller groups, each group representing a particular
(parent) local council with promotions, move-over & grant of selection scales
considered and made (within that group) as would be done if they were posted in
their respective local body under the previous system. This arrangement would
continue till such time that the cadre is phased out. All service matters including
promotions in respect of this category of employees shall now be decided at the
District Competent authorities for appointment, selection/promotion committees
have already been specified vide this Department’s Notification dated 18-4-2002.
(c) Employees of erstwhile urban local councils now adjusted
at District Governments, TMAs and Union
Administrations (other than health & education staff).
5. Urban local councils have succeeded by the TMAs. Staff of erstwhile

urban local councils (Town Committees, Municipal Committees and Municipal


Corporations) has, however, been adjusted at District Governments and Union
Administrations, besides the TMAs. Moreover, employees of various erstwhile
urban local councils have accumulated at one TMA. For each erstwhile urban
local council a CO unit is also present at the TMA.

6. The seniority for this category of employees shall be separately


maintained for each (defunct) urban local council as was the case under the
erstwhile system. Chief Officers (now Council Officers) shall keep complete
record of the staff and posts of the local council he is representing. Since the staff
and posts have been scattered at District Govt., TMA and UA, he shall coordinate
with other local govts., for this purpose, the erstwhile seniority lists of both the
octroi staff and general cadre shall remain intact. CO Unit shall send the
recommendations for promotions, move-over & grant of selection scales to
Tehsil Promotion Committee constituted under Notification dated 18-4-02. The
posts occupied by ex-cadre adjustments shall be treated as vacant for the purpose
of promotion of junior to those posts. An attempt shall be made by the TMA to
rectify/undo the ex-cadre adjustment. In case the vacant post to which an official
has been promoted lies at District Govt., or UA, the official may be promoted
and transferred to that local government by the appropriate authority.

7. It has further been decided to lift the ban on promotions (imposed


vide this Department’s letter dated 6-5-2003) with immediate effect with the
condition that all promotions/move-over/grant of selection scale cases decided
since 14-8-2001 at the Union Administrations, TMAs and District Governments
shall be re-considered in the light of this new promotion procedure.

parking fee as well as lifting of vehicles from empty roads during night and
misconduct by the staff are on increase. In order to resolve the matter in public
interest, it has been decided that all the concerned Local Governments should
establish/notify “Complaint Centers” at various public places, where the public
could readily approach for redress of their complaints/grievances.

3. It is, therefore, requested that such Complaint Centers may be


established at convenient places, within one month. Moreover, establishment of
Complaint Centers should be properly advertised for the information of general
public.

I have been directed to refer the above noted subject and to state that
the Citizen Community Boards (CCBs) are required to be setup under the
provision of Section-98 of PLGO, 2001 in every local area by a group of non-
elected citizens for encouraging the committees for development and
improvement in service delivery. 25% funds are earmarked for development
budget of every local Government for utilization through CCBs. The rules of
business for the CCBs have already been promulgated and issued by this
department.

2. It is observed that the process of registration of CCBs is slow and


only a limited numbers of CCBs have yet registered by the authorities. It is,
therefore, requested that the process of registration of the Citizen Community
Board (CCBs) may be expedited so that the communities may formally be

involved in the development process and the funds earmarked for the purpose
may be utilized for the public welfare.

3. A progress report in this regard may be sent to this department on


monthly basis after doing the needful in the subject matter.

2. It has been observed that a period of about three years has elapsed
since the establishment of the Local Government system in the Punjab, however,

Punjab, LG&RD Department has decided that Jharoo Allowance @ Rs.100/- per
month may be allowed to the Sanitary Workers of erstwhile local councils and
washing allowance be allowed @ Rs.100/- per month to such Fire Fighting Staff
of the erstwhile local councils for whom the uniform is mandatory with
immediate effect.

In continuation of the previous instructions, envisaged under PLGO,
2001, on the issue involved, I am directed to enclose herewith a copy of subject
resolution regarding one-window operation in the Provincial Government
Departments in the Punjab and to request that necessary arrangements may be
made to commence and reinvigorate one-window operation in the public dealing
offices, as per following guidelines:

(i) Diary No./receipt must be issued to the public on submission


of applications/documents etc.
(ii) Chargeable fee of each service must be clearly notified on the
prescribed application form and the office notice board for
information of public.
(iii) In all cases feasible time frame must be indicated on the
prescribed application form/receipt and the office notice board
regarding disposal of the matters/delivery of services etc.
(iv) In such cases, where definite target date is not possible the
arrangement must be made to decide/settle the matters strictly
on first come first served basis. However, in longstanding
cases, on the written request the concerned person must be
officially informed about the requirements/stage of the case.
(v) A senior officer in each office must be notified on the notice
board being incharge one-window operation, to settle the
grievances of the visitors.
3. The District Governments shall circulate the instructions to all the
union councils and the subordinate offices for immediate compliance.
Implementation report may be furnished to this department at the earliest for
onward transmission to the concerned quarters.

Subject: COMPLAINTS/APPEALS AGAINST THE AUCTIONING OF


COLLECTION RIGHTS OF DIFFERENT TAXES/FEE.

2. It has been observed with great concern that provisons of Punjab
Local Government (Auctioning of Collection RightS) Rules, 2003 are not being
observed while auctioning the collection rights of different taxes/fees. A number
of complaints/appeals are being filed by the participants/ contractors pointing out
irregularities in this regard. Upon receipt of comments and reports on the
complaints from the concerned Local Governments, it transpires that procedure
laid down under the Punjab Local Government (Auctioning of Collection Rights)
Rules, 2003 is not being strictly adhered to by the Local Governments.

3. The procedure envisaged in Rule 6 & 7 of the Punjab Local Government


(Auctioning of Collection Rights) Rules, 2003 is reproduced below:
(i) Statement of participants. (1) On given date and time of
auction a statement of participants, who are eligible to
participate in the auction and have deposited the earnest
money, shall be prepared and signed by the Nazim of Local
Government concerned or a person authorized by him and at
least two participants of the auction.
(2) The name, address and identity card number of each
participant shall be written and attested copy of the

participant’s identity card shall be collected and kept in the


record.
(ii) Statement of bid or offer. The auction shall be stated after
announcing and delivering the copy of terms and conditions of
the contract. A statement of bids offers shall be prepared in the
presence of the participants of auction and it shall be signed by
the Nazim or the person authorized by him and signatures of
three highest bidders shall also be obtained in a column against
the amount of their bids.
3. You are, therefore, directed to implement the aforementioned rules in
letter and spirit. Any violation of the law/rules/procedures/policy shall be viewed
seriously.

It has been observed with great concern that TMAs are charging toll tax in the
name of road user charges/service charges which is not covered under Second
Schedule of PLGO, 2001. Moreover, this tax is being levied without vetting and
gazette notification by the department which is a violation of the provisions of
Section 116 of PLGO, 2001.
3. You are, therefore, directed to stop collection of such tax forthwith

2. The LG&RD Department has decided to extend the facility of grant


of financial assistance w.e.f. 10-11-2004 mutatis mutandis to the employees of

GROUP TERM INSURANCE SCHEME AND RATES OF
DEDUCTION.
In continuation of this Department’s letter of even number dated
10-10-2003, on the above noted subject.

2. As you are aware that Government of the Punjab had enhanced the
sum assured for the Government Servants w.e.f. 01-07-2002 and this facility was
also extended to the employees of erstwhile Local Councils w.e.f. 01-07-2002
vide above quoted reference.

3. The new coverage also required enhancement of amount of premium


by the concerned employees. As regard employees BS-1 to 4, i.e., Rs. 10/- of the
total premium per month will be paid by the Local Councils and additional
amount of Rs. 30/- per month shall have to be deducted from employee’s
monthly salaries. The annual and monthly rates of premium as per enhanced sum
assured for different categories of employees’ w.e.f. 01-07-2002 will be as under:

NOTIFICATION
No. SO D-III (LG)l-48/2005(P). In exercise of the powers conferred upon
him under section 87 of the Punjab Local Government Ordinance-2001 (XIII of
2001) and in supersession of all previous notifications/orders in this behalf, the
Governor of the Punjab is pleased to approve the following criteria for allocating
minority seats in a Union Councils where the population of minorities is in excess
of 10% of the total population of the Union:
(i) Population for one Muslim General Seat is 100/4 25%
(ii) Second seat to the minority shall be given where population of minority
in a Union Council is more than 37.5 % i.e. {mid point of 25% and
50%}
(iii) Third seat to the minority shall be given where population of minority
in a Union Council is above 62.5 %.
2. Wherever, the additional seats of minorities are allocated equal
number of seats specified for Muslim members shall be reduced.

Subject: PROVISION OF TRANSPORT FOR THE USE OF


RETURNING OFFICERS
In a meeting held on 11.07.2005, under the Chairmanship of Chief
Minister, Punjab, it was, unequivocally, advised by the Chief Secretary that for the
purpose of Local Government Elections-2005, DCOs are required to provide vehicles
to the District Returning Officers (DROs) as per the requirements of their respective
districts. The vehicles are to be provided by the DCOs by requisitioning official
vehicles of the devolved departments or by hiring the same from the transport
rentals: POL/transport charges will be borne by; the Election Commission of Pakistan.
It has come to the notice of the Provincial Government that in some districts,
deviation is being made from the said policy guidelines.

2. I have been directed to request you to please take further necessary


action, on this count, in the light of afore-stated as contained vide para 1 and liaise
with your respective DROs for working out the transport requirements. DCOs are
further advised to take necessary measures, in this regard, to check duplication of
action as well as external intervention in their chain of command.

Subject: VIOLATION OF COPE OF CONDUCT.


I have been directed to intimate you that violation of Code of Conduct
by the candidates during their electioneering campaigns for Local Government
Elections, in some districts of the Punjab, has been observed by some quarters. Over-
sized (prohibited) bill-boards and hoardings have been installed on the Highways,
major thoroughfares and round-abouts of some major cities and towns. Such
activities are violative of the ‘Code of Conduct’, prescribed by the Election
Commission of Pakistan, to be followed by the contesting candidates.

2. I have been further directed to request you to please ensure strict


compliance of the ‘Code of conduct’ as well as instructions issued by the Election
Commission of Pakistan for the conduct of Local Government Elections in a fair and
transparent manner. Please direct the TMAs of your districts to take cognisance of

installation of prohibited-sized bill-boards/hoardings for electioneering in their


respective areas of jurisdiction and take necessary measures to get them removed,
forthwith. Besides, regard ought to be made, not to allow fixation of any such

Subject: CONDUCT OF LOCAL GOVERNMENT ELECTIONS-

I am directed to refer to this Department’s letter of even number,
dated 11.07.2005, 16.07.200S and 22.07.2005, on the above noted subject and to
state that while it is imperative to provide transport to the DROs/ROs for
use during the forthcoming Local Government Elections. It may be taken
into consideration that vehicles of those Departments, which are executing and
supervising special development programme of the Chief Minister like District
Monitoring Officers and those Departments, which have launched special
campaigns like Agriculture Extension, Water Management and Plant Protection
Wings of Agriculture Department may be exempted from Election Duty.
Similarly, vehicles of former Nazims and non-Government Organizations
like PRSP, Khushhali Bank etc., may not be used for flection duty.
2. In view of the aforementioned, it is suggested that the
requirement of transport in the District may be worked out in consultation with
concerned DRO and provide vehicles from the Government Departments, In case of
shortage, vehicles from car hiring agencies may be arranged for which funds will be
provided by the Election Commission of Pakistan.

My dear District Coordination Officer,

Reference my telephonic conversation with you on July 01, 2005 on the


afore-captioned issue.

2. Election Commission of Pakistan has issued Code of conduct to be


observed by all the stakeholders during Local Government Elections-2005
(Annex-A). Some of its provisions warrant actions to be taken by the Provincial
Government as well as Local Governments. Press reports and public complaints,
being received at the level of Chief Election commissioner and higher echelons of
Government of the Punjab, are indicative of some violations of the Code being made
by some irresponsible elements. For the purpose of your convenience, such
provisions of the Code, which are required to be regulated by the Provincial
Government and the Local Governments (such as District Governments & TMAs), are
reproduced as follows:
(i) For the purpose of corner meetings, candidates are not allowed
to block highways, major streets/roads and round-abouts of an
city/town.
(ii) No corner meeting would be held at religious places viz. mosque
church and temple. Besides, no election speech would be
allowed at such places of worship.
(iii) No corner meeting would be allowed at any venue where corne
meetings of other candidates have already been scheduled.
(iv) Local Governmen Elections will be held on non-party-basis,
therefore, no candidate will use, directly or indirectly,
platform flag, symbol and claim linkage with any politica,
religious sectarian or ethnic party.
(v) Candidates or their supporters will not takeout processions
on public transport/carriages like buses or trucks nor are they
allowed to take out torch-bearing processions.

(vi) Carrying of fire-arms to the corner meetings has been


prohibited; use of any explosive material (fire crackers) or
resorting to aerial firing has also been prohibited.
(vii) During their election campaigns, Federal/Provincial Ministers,
Ministers for State, Advisors and Chairmen of Standing
Committees are not allowed to use official vehicles nor are they
allowed to display national or party flags and their official
designations. Besides, they are not allowed to make public
announcements with regard to launching of any development
scheme in any local area.
3. Local Governments i.e. District Governments and TMAs are required to
take the requisite actions. On this count, necessary guidelines have already been
issued by the Department (Annex-B). It is once again reiterated that it is the
resolve of the Punjab Government to provide enabling environment for the
conduct of free, fair and transparent Local Government Elections. It is, therefore,
urged that necessary measures may please be adopted to effectively check violation of
Code of conduct by any quarter, irrespective of anyone’s status or standing.

Subject: MINUTES OF THE MEETING HELD ON 21.12.2005 AT 11.00


A.M. AT 90-SHAHRA-E-QUAID-E-AZAM, LAHORE, UNDER
THE CHAIRMANSHIP OF CHIEF MINISTER, PUNJAB.
A meeting of the District Coordination Officers and District
Monitoring Officers in the Punjab was held on 21.12.2005 at 11.00 a.m at 90-
Shahra-e-Quaid-e-Azam, under the Chairmanship of Chief Minister, Punjab.

2. The meeting was started with the recitation from the Holy Quran.
Chief Minister, Punjab welcomed the participants. The Chief Minister
appreciated efforts made by the DCOs in the rehabilitation/relief activities carried
out in the earthquake effected areas of NWFP & AJK. He particularly,
appreciated the efforts made by DCOs of Lahore, Chakwal and Attock Districts.
Thereafter, Chief Minister briefed the DCOs about the development initiatives
taken by the Provincial Government for the socio economic uplift of the
Province. He briefed the participants about the Punjab’s vision 2020 and stated
that fifteen years down the road i.e., by 2020 Punjab would achieve the targets in
literacy, employment generation, skilled labour, economic and social
development.

3. In order to achieve the goals set in vision 2020, the District


Coordination Officers will have to play a vital role. The Chief Minister stated
that recent amendments made in the PLGO-2001 have removed bottlenecks in
the law. The role of DCO has been defined more clearly and the DCO has to act
as anchor person/nominee of the Provincial Government at the District level. The
Chief Minister, Punjab observed that the role of DCO is not only to assist the Zila

Nazims but to act as a link between the Provincial Government and the District
Government. The Provincial Government initiatives are to be implemented and
monitored at the District level by the District Governments and the DCOs are
responsible for their efficient implementation. Ownership of these initiatives
vests with the Provincial Government and no delay in this regard will be
tolerated and DCOs will be held responsible for any lapse or under utilization of
funds. The Chief Minister further stated that on the pattern of Education Sector
Reform Programme, the Provincial Government is likely to introduce Health
Sector Reform Programme and DCOs are required to play an active role in this
regard. The Chief Minister, further advised the DCOs to follow Provincial
Government Policies while formulating their annual budget for the financial year,
2005-2006. No block allocation should be made in the annual budgets.
Development priorities of the Districts should be clearly identified and should be
in line with the Provincial Policies. The District based Multiple Indicators Cluster
Survey {MICS} may be followed while formulating annual development
programme of the District so as to cover the deficiencies.

4. Elaborating the role of District Monitoring Officers, the Chief


Minister, Punjab emphasized that the DMOs are part of the District Team and
they have been posted in the District to help/assist the DCOs in the monitoring of
the Provincial Government development initiatives.

5. Chief Secretary, Punjab, Senior Member, Board of Revenue,


Chairman, P&D Board, Secretary, Agriculture and Secretary Education
Departments briefed the participants about the major development initiatives as
well as various policy parameters. Secretary, Agriculture emphasized upon
DCOs to accelerate implementation progress on the National Programme of
Lining of Water Courses. Secretary Education, stressed upon the DCOs to
closely monitor execution of civil works under the Punjab Education Sector
Reforms Programme (PESRP). In this regard, Secretary C&W Department was
also asked to ensure quality work by the technical people of C&W Department at
the district level.

6. On pointation by the District Coordination Officer, Sialkot, Chief

Secretary, Punjab agreed that DCOs are acting as Project Coordinator of various
Provincial Government Projects e.g., PESR, Lining of Water Courses etc. They
may be considered for grant of Project Allowance @ Rs.25,000/- per month to
compensate them for the extra amount of work.

7. Following decisions were taken in the meeting:


(ii) In order to meet increase in the salary budget of the Local
Governments, share of Local Governments will be increased in
the forthcoming Provincial Finance Commission Award.
(ii) The DCOs should ensure adequate allocation of funds for
repair and maintenance of the existing physical infrastructure.
In this regard, instructions issued by the Provincial
Government from time to time should be followed strictly.
(iii) No grant-in-aid by the Local Governments to any body is
allowed under the law, therefore, the District Governments
should refrain from sanctioning grants-in-aid, to
individuals/organizations. Similarly, no block allocations
should be made in the Annual budget of the Districts.
(iv) Utilization of Local Government development funds should be
in a proper/transparent manner. DCOs should regularly
monitor pace of development activity and utilization of funds
at the District level and an efficient monitoring system within
the District be evolved.
(v) Monthly progress reports of utilization of District
Development Funds be submitted to the Provincial
Government/Planning & Development Department regularly.
(vi) DCOs should take advice from the Provincial Government
while implementing development programmes initiated by the
Federal Government and should refrain from direct interaction
with the Federal Government. No work should be started
without permission of the Provincial Government.
(vii) Efforts should be made to expedite utilization of 25%
development budget earmarked for the CCBs.
(viii) Secretary Education will circulate guidelines to all the District
Governments regarding execution of civil works under the
PESR. Secretary, C&W Department will ensure quality of
work on these schemes.
(ix) Chief Secretary, Punjab will hold regular meetings with the
DCOs to review and monitor implementation status of
Provincial Government Policies/development initiatives.

SUPPORT A FAMILY PROGRAMME


Chief Executive Officer “District Relief Management Society”
briefed the participants about the Support a Family Programme initiated by the
Government of the Punjab for the rehabilitation of affected families of
earthquake areas. The DCOs were asked to extend their full support in this
regard, they were asked to establish coordination between small traders/
shopkeepers etc., and well to do people to adopt one family under the aforesaid
programme.
