Punjab Sugarcane (Development)

Cess Rules, 1964

No. SOF-III/13(56)!2003, dated 24-12-2003.-In exercise of the powers

conferred upon him under section 17 of the Punjab Finance Act, 1964 (XXIV of
1964), the Governor of the Punjab is pleased to direct that in the Punjab Sugarcane
(Development) Cess Rules, 1964, the following further amendments shall be made:

1. In rule 8 sub-rule (6) after the word "Department" and before the word
"shall", each occurring for the first time, the words "and brackets" in consultation
with the Provincial Sugarcane (Development) Cess committee"; shall be added.

2. In rule 9-
(i) In the heading, the word "District" shall be omitted and after the word
"Sugarcane" and before the word "Committee", the words and brackets
(Development) Cess", shall be inserted.

(ii) Sub-rule (1) shall be renumbered as (1-a) and before sub-rule (1), so .
renumbered, the following sub-rule (1) shall be added:--

"(1) Government shall constitute a Provincial Sugarcane (Development)

Cess Committee comprising the following:

(a) The Can Commissioner Punjab Chairman

(b) The District Coordination Officer of the District Member
concerned.
(c) The Chairman, Pakistan Sugar Mills Association or his Member
nommee.
(d) Member Technical from Planning and Development Member
Department, Government of the Punjab
(e) Representative of Finance Department, Government of ""
Member
the Punjab.
(f) Representative of Communication and Works Member
Department, Government of Punjab.

Representative of Growers to be nominated by the Member

(g)
Secretary to Government of" the Punjab, Agriculture
Department; and
(h) Any other member co-opted by the Cane Commissioner, Member
Punjab

(iii) Sub-rule (2) shall be substituted by the following:--

"(2) Subject to such general or special directions as the Government may

give from time to time and the availability of the required amount in the fund, the
provincial Sugarcane (Development) Cess Committee shall, for the purpose
specified in sub-apportionment of Sugarcane (Development) Cess amongst the
districts, release thereof and selection of development schemes as well as their
execution,"

(iv) After sub-rule (2), the following new sub-rule (2-A) shall be added:

"(2-a) Subject to such .general or special, directions as the Government

may give from time to time and the availability of the required amount in the
fund, the District Cess Committee shall, for the purpose specified in sub-rule (4
)of rule 8, have power to formulate and initiate development schemes and submit
its recommendations to Provincial Sugarcane (Development) Cess Committee for
final approval."

(v) In sub-rule (3), the words "District Committee" shall be substituted by

the words and brackets "Provincial Sugarcane (Development) Cess Committee" ;
and

(vi) In sub-rule (4), the words "District Cess Committee" shall be

substituted by the words and brackets "Provincial Sugarcane (Development) Cess
Committee".

3. In rule 10 sub-rule (1), the words "District Cess Committee" and

"District Committee" shall respectively be substituted by the words and brackets
"Provincial Sugarcane (Development) Cess Committee" and "Provincial
Committee".
