and agree to abide by the conditions strictly.

1) Sealed Tenders for Purchase of M.S.Misc.Scrap, Cast Iron Scrap, Bearing Scrap,
Stainless Steel Scrap, Alloy Steel Scrap, PVC Scrap, Rubber Scrap, Damaged
conveyor belt scrap, Old News Paper Scrap, Deal wood Scrap, Empty Barrels, Mill
Reject, Furnace oil sludge sediment, Condemned Jeep, Van and Car etc., furnished
in the enclosed tender schedule will be received by the Superintending
Engineer / Purchase and Administration/ Mettur Thermal Power Station.I/Mettur
Dam-6 upto 2.00 P.M on 06.08.2014 against Tender Specification No.CE / MTPS.I
/Sale of scrap/Specification No. 01 / 2014-15. The tenderer may also at their
option submit their Tender at office of the Chief Engineer/Mech.Thermal Stations/
144, Anna Salai, Chennai-2. In this case tender will be received by EA to
CE/Mech/TS/ Chennai-2.

THE TENDER SHOULD BE SENT IN DOUBLE COVER SYSTEM


2) The inner cover (envelope) should contain only quotation for the items in the
prescribed TANGEDCO tender schedule form duly signed therein.
The inner cover should then be placed in the outer cover along with Pay order or
Demand Draft for the Earnest Money Deposit and required documents and the outer
cover should be sealed properly.

3) The following superscription should be written or typed on the top of the outer
cover.

At the left hand bottom of the tender cover, full postal address of the tenderers should
be written or typed clearly.
EMD HAS TO BE PAID FOR LOT. 1 TO 14: @ 5% OF THE QUOTED PRICE
ROUNDING TO NEAREST TEN RUPEES & Lot.15 (MILL REJECT): Rs.10,000/-
ONLY.
ON OPENING THE OUTER COVER, THE DEMAND DRAFT OR PAY ORDER TOWARDS
EARNEST MONEY DEPOSIT FOR LOT.1 TO 14: @ 5% ON THE OFFERED VALUE &
LOT.15 (Mill Reject): Rs.10,000/- ONLY, HAS TO BE PAID BY THE TENDERER SHOULD
BE AVAILABLE. THEN ONLY THE INNER COVER WILL BE OPENED. OTHERWISE IT
WILL BE SUMMARILY REJECTED. SUCH TENDER COVERS WILL BE RETURNED TO
THE TENDERER UNOPENED.

4) Cash should not be sent along with the tender.
5) (a) Tender cover received after the due date and time will not be accepted /
opened and they will summarily be rejected. Such tender covers will be
returned to the tenderer concerned unopened.
(b)The tender documents will be placed in the TNEB Web Site
w.w.w.tangedco.gov.in and T.N.Govt. Web site W.W.W. tenders. tn.gov.in.
the tenderers can get the Tender Specification by down loading from Web Site. If
downloaded, cost of form need not be paid.

( c )The quantities offered for sale are only approximate which may be altered/
deleted/reduced.

6) The Chief Engineer/M.T.P.S.I/Mettur Dam – 6. Reserves the rights to reject the


tenders due to the following reasons.
a. Tenders received from parties, who have not purchased the tender specification
from this office or by down loading from TNEB WEB SITE .
b. Tenders received without Earnest Money Deposit for each Lot and also tenders
received with part Earnest Money Deposit.
c. Telegraphic/Fax/Telex Quotations.
d. Tenders received in forms other than the tender forms enclosed with the
Specification.
e. Tenders received without quoting firm rate both in figures and words separately
for each lot in the tender schedule.
f. Tenders received without the signature of the tenderer in the tender form
concerned.
g. Tenders received without the signature of the tenderer in whose name the
specification is issued
h. Tenderers should not stipulate their own terms and conditions and their own
validity period for the rates quoted by them either in the department tender
form or in separate letter along with the tender. If the rates quoted by such
tenderer are found higher than the other tenderers, the EMD paid by them will
be forfeited for stipulating their own Terms and Conditions.
i. The tender form purchased by the tenderer from outside Tamil Nadu should not
be submitted in the name of their Branch Office situated in the State of Tamil
Nadu. Such Tenders will summarily be rejected.
j. Tenders received after the due date and time will summarily be
rejected.
k. Tenders received without TNGST Registration Certificate duly attested
& latest renewal challan and copy of PAN CARD.
l. Tender received without the signature of the person in whose name
the TNGST registration is made.
m. Tender signed by other person without authorization letter from the person in
whose name the firm is registered.

7. EARNEST MONEY DEPOSIT


The Earnest Money Deposit has to be paid for Lot.1 to 14: @ 5% on the
offered value & Lot.15(Mill Reject): Rs.10,000/- only. The Demand Draft No/ Pay
Order No. and date and the amount has to be furnished without fail

NOTE :-

a) The Earnest Money Deposit remitted by the tenderers will not carry any interest.
b) There will be no exemption to S. S. I and N.S.I. units from payment of E.M.D. and
therefore the tender received without the E.M.D. will not be opened and summarily
rejected.
c) The EMD amount may be remitted for Lot. 1 to 14:@ 5% of the rate quoted &
Lot.15 (Mill Reject): Rs.10,000/- only, by the Tenderers by Demand Draft or by Pay
Order drawn in favour of “ The Superintending Engineer/ Purchase &
Administration/ Mettur Thermal Power Station.I/Mettur Dam- 636 406”
payable at Mettur Dam only, those who opt to submit the Tender at MTPS.I/
Mettur Dam or those who opt to submit the tender at office of the Chief
Engineer/Mechanical/Thermal Stations/Chennai-2.
d) The Pay Order or Demand Draft for the EMD amount paid should be sent along
with the tender.
e) Cash should not be sent along with the tender itself.
f) Cheques and Bank Guarantees or Any Other Bonds towards EMD will not be
accepted.
8) OPENING OF THE TENDERS
a) All the sealed tenders received up to 2.00 p.m. on 06.08.2014 will be opened at
2.30 P.M at two places on the same day by the officers authorised one at office of
the Chief Engineer/Mechanical/Thermal Stations/144, Anna Salai, Chennai-2,
tenders received at office of the Chief Engineer/Mechanical/Thermal Stations/
Chennai, and another at Mettur Thermal Power Station.I, Mettur Dam, tenders
received at office of the Superintending Engineer/ P&A / MTPS.I / Mettur Dam-6, in
the presence of those tenderers or their authorised representatives who are
present at the time of opening in the conference hall at canteen building
upstairs/Mettur Thermal Power Station.I. The rejection of tenders, which do not
satisfy the conditions, stipulated would be intimated in the presence of the
tenderers who are present at the time of opening. The highest rates quoted by the
tenderers will be accepted subject to confirmation of sale as per prevalent rules
and regulations of the TANGEDCO.

b) In case, the date of opening of tender happens to be declared a holiday due to


unavoidable circumstances, the opening of sealed tenders will be conducted on the
next working day at the same time.

9) INSPECTION OF MATERIALS

The materials offered for sale are available at Central Stores, Mettur
Thermal Power Station.I, Mettur Dam- 6 for Lot. 1 to 14. Further, the Mill rejects
offered for sale are available at behind switch yard, CHP Railway track north gate,
western side and northern side of MTPS campus between Railway track and south
west of compound wall for Lot.15. In ‘AS IS WHERE IS CONDITION ONLY’ The
inspection of materials will be permitted only to the persons who have purchased and
downloaded from the Web site the Tender Specification. The Officers in charge of
Stores will permit for inspection only on production of the Tender Specification.

Inspection will be permitted only during working days and working hours of
the Stores i.e. from 9.00 A.M. to 12.00 Noon and 2.00 P.M. to 5.00 P.M. Selection or
disturbance of the lots during inspection of the lots will not be permitted. Permission
for inspection of the materials after 12.00 Noon on the final day of submission of
tender will not be granted.

10) FURNACE OIL SLUDGE SEDIMENT WILL BE SOLD ONLY TO TENDERERS


AS DETAILED BELOW FOR LOT.NO: 10
a. The Tenderers those who have registered with Central Pollution Control Board,
New Delhi and Tamil Nadu Pollution Control Board, Chennai with proper
validity shall be allowed to participate in the Tender for Lot.No.10.
b. The Tenderers should enclose a copies of the above Registration Certificates of
Central Pollution Control Board, New Delhi and Tamil Nadu Pollution Control
Board, Chennai along with the Tender Schedule Forms, failing which their offers
will be Rejected.

c. The Copies of Authorisation Certificates obtained from Central Pollution Control


Board, New Delhi and Tamil Nadu Pollution Control Board/Chennai for
collection of furnace oil sludge sediment and transporting to their plant with
the details of quantity allotted by the above Board and the details so far lifted
against the allotted quantity in various firms should be enclosed along with
Tender Schedule Form without fail ;
d. The Original Registration Documents obtained from Central Pollution Control
Board, New Delhi and Tamil Nadu Pollution Control Board/Chennai should be
produced at the time of release of material without fail so as to endorsing the
quantity of furnace oil sludge sediment released against Sale Order. Otherwise
the ordered materials will not be released at any cost.

e. Incase of Transport of hazardous waste to a facility for Treatment, Storage, and


disposal existing in a state other than the State where hazardous waste is
generated the occupier shall obtain “ No Objection Certificate” from the
State Pollution Control Board or Committee of the concerned state or Union
Territory Administration where the facility is existing.

f. Further If any changes of Rules ordered by Central Pollution Control Board,


New Delhi and Tamilnadu Pollution Control Board, Chennai in future/ at the
time of Release of the Materials will also be followed in the tender.

11) ACCEPTANCE OF TENDER AND ISSUE OF SALE ORDER


a. The successful tenderers will be intimated of the acceptance of the rates for the
lots/items through a sale order. 1% Income tax as applicable will also be
collected along with sale amount. This intimation will be given within a
reasonable time from the date of opening of the tender.
b. The successful tenderers should remit the entire amount covered by the sale
order within 21 days from the date of receipt of sale order for Lot.1 to 14
& 15 days from the date of receipt of sale order for Lot.15 (Mill Reject),
by demand draft in favour of “Superintending Engineer/Purchase &
Administration/Mettur Thermal Power Station.I/Mettur Dam-6” payable at Mettur
Dam only. Cash Receipt should be produced, to the Stores Controller, Central
Stores/ MTPS.I/Mettur Dam-6, who will arrange for the issue of Release order.
MILL REJECT FOR LOT.15
The minimum quantity to be lifted 1000 tonne per month.
Period for lifting the Mill reject is as detailed below:-
Time for remittance for first sale order value is within 15 Days.
Subsequent sale orders will be issued on every 1 st of the month. The sale
amount is to be remitted within 15 days from the date of issue of sale order (even
though the previous lifting is on progress)

Note: Under any circumstances, extension of time will not be granted


for remittance of the amount covered by the sale order.
c. If the entire sale amount covered by the sale order is not remitted by the
successful Tenderers within the time stipulated above, the E.M.D. for the lot will be
forfeited to the TANGEDCO without further reference to him. No plea for non-
remittance of the amount in time will be entertained and partial remittance is also
not acceptable.

d. The Chief Engineer/MTPS.I/Mettur Dam reserves the rights: -


i) To accept the highest or any tender
ii) To reject any or ALL THE TENDERS without assigning any reason there for
whatsoever.
iii) To revise or to retain the quantity of any or all the items covered by the
Specification for use by the TANGEDCO at any time and release the balance for
sale. Under such circumstances, the average cost of the materials collected in
excess will be refunded to the successful Tenderer without interest.
iv) To reduce the quantities to be sold if necessary during the pendancy of the
tender;
v) To equally distribute the quantities to more than one successful tenderers who
have quoted the same rate.

12) REFUND OF EARNEST MONEY DEPOSIT

a) The refund of E.M.D. amount will be made, to the unsuccessful tenderers


after due intimation to them about the rejection of their tenders.

b) The E.M.D. paid by the successful tenderers within Tamil Nadu will be
adjusted against the sale amount of materials for which sale orders are issued
for Lot. 1 to 14.

c) The E.M.D. paid by the successful tenderers within Tamil Nadu will be
refunded after successful completion of lifting within the stipulated period for
Lot.15(Mill Reject)

c) For the successful tenderer from Outside the State of Tamil Nadu, the EMD
will be released only after the satisfactory completion of contract in all
respects.

13 ISSUE OF RELEASE ORDER & CONDITIONS FOR REMOVAL OF MATERIALS


SCRAP MATERIALS

i) a) On production of the Cash Receipt by the successful Tenderers or their


authorised representative for having remitted the full amount covered by the
sale order, necessary release order will be issued for clearance of the
sold materials from the Stores Premises. The purchased materials should be
removed completely by the successful tenderers from the MTPS Premises
within 15 (Fifteen) days from the date of receipt of the release order.
(Including holidays) for Lot. 1 to 14.
MILL REJECT
The minimum quantity to be lifted 1000 tonne per month for Lot.15 (Mill
Reject). The period of contract is 12 months.
b) For the successful tenderer from Outside the State of Tamil Nadu, the
materials will be released only after submission of proof of payment of
purchase tax liability in respect of the transaction to the Government of Tamil
Nadu.
c) The time schedule for removal of materials should be furnished
before releasing of the materials.
d) If the successful tenderer fails to remove the purchased materials within
the time limit specified in the Release Order, either partly or fully, then a
further extension of time for 15 days (Maximum) with GROUND RENT will be
granted for removal of the materials. This will be done only against specific
written request from the successful tenderer giving the reason for non
removal of the materials in time.
e) Rates for collection of ground rent for the non removal of materials in time
shall be as follows: -

(i) RS.100/-(Rupees One Hundred only) per day per metric ton or part thereof
for the Lots accounted in weight for Lot. 1 to 14..

(ii) Rs.50/- (Rupees Fifty only) per day for each lot or part thereof for the lots
accounted for in numbers for Lot. 1 to 14.

e) (i) The materials (either in full or part) that remain un-lifted even after the
extended time limit granted with ground rent, will be forfeited to the
TANGEDCO. In addition, the cost of the materials so undelivered will also be
forfeited to the TANGEDCO and the tenderer will not have any claim or
compensation whatsoever afterwards.
(ii) The successful Tenderer should make his own arrangements to clear the
lots sold to him. He should make his own arrangements at his cost for
removal of the materials by providing labourers for weighing or towing,
handling and packing and transport etc. No Departmental labour will be
provided for the removal of the materials. Release of materials will be
permitted only from 9.30 A.M to 4.30 P.M in all working days.

(iii) THE MATERIALS OFFERED FOR SALE ARE UNDER ‘AS IS WHERE IS
CONDITION’’. HENCE, REJECTION, SELECTION OR SEGREGATION OF THE
MATERIALS FROM THE LOT IS NOT PERMITTED.
(iv) The release of the materials will be done only to the successful tenderer or his
accredited representative duly authorised and whose signature is attested by him.
(v) The successful tenderers will not be permitted to bring any dealers or merchants
for inspection of materials or for further examination of the materials in the Stores
premises once the tender is finalised.
(vi) If at any time of release, the quantity in any of the item varies from the quantity
offered for sale or the quantity approved for release, the purchaser should accept only
the actual quantity available at the time of release. If the quantity is less,
proportionate cost will be refunded without interest to the successful tenderer on
completion of release.
(vii) Release of materials should not in any way interfere to TANGEDCO’s work that
may be in progress. Employees engaged by the purchaser for the removal of the
materials shall work subject to TANGEDCO’s rules and conditions.
(viii) Drivers of the vehicle entrusted for the loading of materials should possess
proper driving license, which is liable for checking at the main gate before permitting
the vehicle inside the plant. No child labourers shall be engaged for handling of
materials. The TANGEDCO will not be responsible for any damage or loss that may be
suffered by the successful tenderer or his representative or his vehicle during the
process of removal and transport of materials. The successful tenderer is responsible
for all acts of his employees and any damage to the properties of the TANGEDCO or
any other person or public body in the course of movement of his Vehicles and
transport the materials shall be made good by him.
In case of accident to any staff of TANGEDCO in the course of removal and
transport of materials, the successful tenderer shall bear necessary
compensation that may be awarded to the persons involved in the accident
according to The Workmen Compensation Act besides arranging immediate
medical aid.
(ix) Tenderers are advised to satisfy themselves the quantity and condition of the
materials before tendering. The TANGEDCO is not responsible for any deterioration or
loss in the materials from the date of removal from the site and no representation
about the quality and condition of the materials during the above period or at the
time of taking delivery or any time after will be entertained on any account.

(x) The materials accounted in weight basis shall be weighed in the
Departmental weighing machine or in the Departmental 40 M.T.Weigh
Bridge according to the availability. Weighment and the weight recorded by
the Departmental weighing machine will be final and should be accepted by
the successful tenderer. The weighing machines are periodically maintained
and certified by the competent authorities.
xi) The successful tenderer should contact the official in-charge of Central Stores(i.e
Stores Controller) in advance for taking delivery of materials. After confirming
the availability of the witnessing officer, the tenderer should arrange for the vehicles
and taking delivery of the materials. The successful tenderers should remove the
materials from the Stores premises within the working hours of Stores.
(xii) The materials will be released only on production of the release order at Central
Stores for lot. 1 to 14.
The Mill Reject will be released only on production of the release order to the
Executive Engineer/Mill Plant/MTPS.I.
(xiii) The successful tenders shall remove the weighed quantity then and there.
Further weighment will be taken up only after the removal of already weighed quantity
from Stores premises. No part of the weighed or delivered quantity will be allowed to
be kept in the Departmental premises after the weighment and deliveries are done.
xiv) If any loss is sustained to the TANGEDCO on account of non release of the
materials due to backing out of the successful tenderer, the difference between the
original sale value and re-sale value will be recovered from the successful tenderer of
the first sale.
xv) The Chief Engineer/M.T.P.S.I, is the sole and final authority for deciding on any
point of any clarification or dispute arising during the sale of materials and such
decision is not liable for any reference to any authority.
xvi) No suit or any proceedings in regard to any matter arising in respect of this
contract shall be instituted in any court, save in the High Court, Madras or District
Court at SALEM or Sub-Court at METTUR DAM or at the District Munsif Court at
SALEM. It is agreed that no other court shall have jurisdiction to entertain any suit or
proceedings even though, part of the cause of action might arise within their
jurisdiction. In case any part of the cause of action might arise within the jurisdiction
of any other courts in Tamil Nadu and rest within the jurisdiction of courts outside the
State of Tamil Nadu, then it is agreed to between the parties that such suits or
proceedings shall be instituted in a court within the State of Tamil Nadu and no other
court outside the State of Tamil Nadu shall have jurisdiction even though any part of
the cause of action might arise within the jurisdiction of such courts.

14) VALIDITY

a) The rates should be kept valid for for 120 days from the date of opening
of tender.

b)If the tender is withdrawn by any tenderer within the validity period of
120 days, the E.M.D. paid by him will be forfeited to the TANGEDCO.

SPECIAL CONDITIONS FOR MILL REJECT (LOT.No:15)

15) PERIOD OF CONTRACT: The period of contract is 12 months from the date of
issue of first sale order.

The mill reject should be collected by the successful tenderer as in the schedule
as per special condition laid down and as instructed by the Engineer-in-charge.

i) The mill rejects are to be transported only during the period from 8.30AM to
5.30PM as fixed by the MTPS.I authorities.

ii) The purchaser has to make his own arrangement for collection and transporting
of mill reject under the direction of MTPS.I staff.

iii) The purchaser will have to bring the own labour for loading of Mill Reject which
will be under his own supervision and direction of an AEE deputed by the
SE/MI/MTPS.I/Mettur Dam –6

iv) It is essential that the purchaser should use only rubber tyred vehicles for
conveyance of mill reject so that the TANGEDCO roads enroute are not
subjected to any under wear and tear. Iron tyres vehicles will not be permitted
under any circumstances.

v) The contractor should provide all labourers accident group insurance policy
under workmen compensation Act 1923 during the entire period of lifting and
hand over the original policy to SE/M-I/MTPS.

vi) The area of mill reject collection should be kept clean and tidy without spilling
of mill reject all around.

vii) All the vehicle of the purchaser to and from the area allotted are liable for
check by the MTPS security staff and they should abide by the traffic safety
regulations enforced in the area from time to time.
The Purchaser should indemnify the TANGEDCO against all possible thefts,
pilferage etc., of TANGEDCO’s property by his workmen of any member of
his establishment.

viii) The purchaser vehicle will have to be weighed on the departmental weigh
bridge inside the power house in the presence of AEE/Authorised MTPS.I staff,
Mill Plant/MTPS.I before and after each collection of mill reject and the net
weight will be taken as the weight of mill reject supplied.

ix) Notice Boards should not be put up by the purchaser in the TANGEDCO’s
premises without the prior approval in writing of The Superintending Engineer/
M-I/MTPS.I/Mettur Dam-6.
x) The Purchaser on the date of completion of his purchaser should ensure that all
his obligations to the board are duly fulfilled as stipulated in the conditions. He
should intimate in writing a week in advance before the expiry of the sales the
date and time of the returning back of the site by him after completion of the
work.

xi) The TANGEDCO reserve the right to terminate the purchaser earlier for non-
fulfillment of any of the conditions stipulated without prejudice to any other
proceedings that may be taken by the TANGEDCO such termination will not
entitle the purchaser to any claim for compensation of any kind whatsoever.

xii) In case of any dispute or difference of opinion between the purchaser and the
department representative at site in matters reliant to day to day working and
the interpretation of the sale order the decision of the Chief Engineer/MTPS.I
shall be final and binding.

16) SAFETY: The purchaser shall arrange for the necessary tools, implements etc., for
the collection of the mill reject. He shall also procure and supply necessary safety
appliances to the persons for the collection handling and transport of mill reject.

17) LIABILITY FOR ACCIDENTS TO PERSONS:


The purchaser shall indemnity and a save harm to the board against all
actions suits, claims, demands, costs or expenses arising in connection
with injuries suffered during the sale order period by persons employed
by the purchaser or the purchaser period by persons his sub purchaser
on the work whether under the general law or under the workmen’s
compensation Act 1923 or any other’s status in force at the date of the
purchaser dealing with question any claims there of the liability of the
employer for injuries suffered by employee and to have taken steps
properly to injure against any claims there under.

On the occurrence of any accident which may result in the death of a


person employed by the purchaser or which is due to the mill reject lifting work end or
so serious as to be likely, to result in the death of any such person the purchaser shall
within hours of happening of such accident, intimate in writing to the concerned,
Engineer and such officers required by the provision of the worker compensation act
the fact of accident. The purchaser shall indemnify the TANGEDCO against all loss or
damage sustained by the TANGEDCO resulting directly or indirectly from his failure to
give intimation in the manner afford said including the penalties or fine if any payable
by the TANGEDCO as a consequence of the TANGEDCO’s failure to given notice under
the workmen’s compensation act otherwise the confirm to the provision of the said act
in regard to such accident.

In the event of any claim being made or action brought against the
TANGEDCO involving the purchaser and arising but of the matter referred to an in
respect of which the purchaser is liable under the clauses the purchaser shall be
immediately noticed there of an he shall with the assistance if he so required of the
TANGEDCO but at the sold expense of the same or of any litigation that may arise
there from. In such cases, the TANGEDCO may at the expense of the purchaser,
afford assistance for the any such purpose.

In the event of any accident in respect of which compensation may


become payable under workmen’s compensation act VIII of 1923 and any subsequent
amendment there of whether by the purchaser or by the TANGEDCO, as principal it
shall be lawful for the Engineer to retain out of moneys it due and payable to the
purchaser such sum of sums of money as may be in the opinion of the said Engineer
be sufficient to meet such liability. The opinion of the Engineer shall be final in regard
to all matters arising under this clause.

Liability for damages or lose to the third party including inspection
officers due to act of the purchaser of his plant or sub purchaser connected with the
execution of this purchaser shall be fully borne by the purchaser. The purchaser shall
maintain such detailed records to furnish information regarding entertainment and
discharges persons employed under this purchaser as to be adequate for the timely
and full settlement of claims under the workmen’s compensation act. All cases of
accidents injuries shall be reported to the Engineer with all the full details required for
the settlement under the workmen’s compensation act.

The purchaser should report above all accident within 24 hours to the
Engineers for the TANGEDCO in the preliminary accident form. He should furnish
other particulars such as medical certificate wage particulars, fitness certificate proof
of having paid the compensation fixed by the TANGEDCO etc., is due course without
delay.

18)LIABILITY FOR DAMAGES TO WORKS OR PLANT:

The purchaser shall during the of period of sale order, properly protect the
work/plant and shall take every reasonable proper timely and useful precaution
against accident or injury to the same from any cause and shall remain answerable
and liable or deemed to be or be accessioned the acts or commissions of the
purchaser or his persons or his sub purchaser and all losses and damages to the
work/plant arising from such accidents or injuries as aforesaid shall be made good in
the most complete and substantial manner by and the sale cost of the purchaser and
the reasonable satisfaction of the Engineer, should such loss or damage happen to
units of works or plant or materials falling outside the scope of this sale order
conditions and due to the sale order these shall be replaced or compensated for by
the purchaser to the satisfaction of the Engineer.

Until the site shall be or deemed to be taken over as aforesaid the purchaser
shall also be liable for and shall indemnify the TANGEDCO in respect of all damage or
injury to any person or to any property of the TANGEDCO or of others occasioned by
the defective work or material but not due to cause beyond his control.

Provided that the purchaser shall not be eligible under the purchaser for any loss
or profit or loss of sale of claim made against the TANGEDCO not already provided for
in the sale order conditions, no for any damage or injury caused by the arising from
the acts of the TANGEDCO or of other (save as to damage by fire, as here in after
provided) due to the circumstances every which are purchaser has not control nor
shall his total liability for loss, damage or injury exceed the total value of the sale
order.

19) SALES TAX, INCOME TAX AND OTHER CHARGES

a) No Sale tax is livable for the sale of scrap materials within Tamil Nadu.
b) No Central Sales Tax will be collected from the Tenderers, outside the State of
Tamil Nadu, since the sale is on Ex. TANGEDCO Stores. But they should pay in
addition to the sale price payable to TANGEDCO, the purchase tax applicable to the
transaction to the Government of Tamil Nadu, then only the materials will be
released.

c) If any T.N.G.S.T or C.S.T. is ordered by the Government at the time of release of
the materials, the rates prevailing them will be levied and collected from the
successful tenderer.

d) The tenderer should have registered under T.N.G.S.T. Act 1959/VAT. The
copy of the registration certificate along with latest renewals and copy of PAN card
should be enclosed along with the quotation without fail.

e) As per Section 206-C of Income Tax Act, 1961, Income Tax at 1% for the total
sale amount will be collected from the successful tenderer along with the sale
amount. Surcharge on Income-Tax will also be collected from the Tenderer along
with sale amount as detailed below.
(i) In case of Companies, surcharge at the rate of 2.5% of Income-Tax will be
collected
(ii) In case of Individuals / Partnership Firms, Surcharge at the rate of 10% where
the transactions exceeds Rs.8.5 Lakhs will be collected. If it is less than Rs.8.5
Lakhs no surcharge will be collected.

20) The tenderers should furnish their full and clear postal address in the tender
document and all their subsequent correspondences. If the sale order or release
order or any other letters are received back due to non availability of the address, the
TANGEDCO will not be held responsible for it and it will be assumed that the tenderer
has backed out and is not interested in purchase of the items covered by this
specification. Hence the Tenderers are requested to make proper arrangements for it.
The TANGEDCO will not be responsible for any loss or delay in transit of the tender
documents due to wrong or incorrect postal address.

21) If the tenderer has any doubt about the meaning of any portion of this
Specification, he should at once submit particulars, to the Superintending
Engineer/ P&A/MTPS.I, in writing so that the doubt may be clarified before
submission of his tender.

22) The sale order and the release order will be issued only to the successful tenderer
who has submitted the quotation. No change in name and address or transfer of
sale or release order will be permitted.

23) TENDER REGULATION TO APPLY

The procedure laid down in TANGEDCO Tender Regulation with latest


amendments will be followed in this Tender.
