Using constitutional and legal mandates in education as reference, explain how the following
problems can be resolved. (To be answered/computer-encoded in a letter-sized bond paper. No
need to rewrite the situations.)

1. Mr. Alvarez is a public-school teacher for 10 years. It has been his intention to update
himself through enrollment to graduate school. For two years, he has completed his
academic requirements and passed the comprehensive exam. His thesis adviser has given
him just one year to finish writing his thesis. What educational legalities can help Mr.
Alvarez to finish his graduate studies without losing his job as a teacher.

According to RA 4670, Article No.5, section 24 teachers of public schools shall be entitled
to study leave not exceeding one school year after seven years of service. Provided,
however, that no teacher shall be allowed to accumulate more than one year study
leave, unless he needs an additional semester to finish his thesis for graduate study in
education or allied courses. In the case of Mr. Alvarez, he should undertake services for
three-year period.

2. Joana belongs to the advisory class of Mrs. Cruz. Joana was confronted by the parents of
her best friend who demanded that Joana would return their daughter’s handbag. How can
Mrs. Cruz help Joana since her parents are working abroad? What right allows her to stand
by Joana?

The Code of Ethics for Professional Teachers article VIII, section 9 stated that a teacher
shall insure that conditions contributive to the maximum development of learners are
adequate, and shall extend needed assistance in preventing or solving learners’ problems
and difficulties. This law indicate that Mrs. Cruz should protect Joanna, she should talk to
the parents of Joana’s best friend

3. Alyssa, a grade 7 student of Miss Paras does not like to come to school anymore because
her classmates are calling her names like “chubby,” and “baduy.” They even get her food
during lunch. Miss Santos knows about these repeated incidents but simply ignores them.
What educational legalities did Miss Santos violate? What could Miss Santos have done as
a teacher?

In this case, Miss Santos violated RA 10627, section 4 which states that if any case of
bullying occur, the school principal or any person who holds a comparable role shall be
responsible for the implementation and oversight of policies intended to address
bullying. What happened in this case is that Miss Santos did not put an action instead she
just ignored it. She should do action to put a stop in such bullying. She should report it
right away. After reporting the incident, she should notify the parents of the student
about the incident. This kind of incident must undergo proper investigation to find out
the reason behind the incident, and to prevent this king of incident from occurring.
