THE HUMBLE APPLICATION OF

THE APPLICANT ABOVE NAMED:

MOST RESPECTFULLY SHEWETH:

That the present Applicant is the respected citizen of India and

he is been falsely implicated in connection with C.R. No. 250 of

2017 lodged with Kurar Police Station u/s 363, 376 of the I.P.C.

r/w. sections 4, 8, of the Protection of Children from Sexual

Offences Act, 2012 and he was been arrested on 14th October, 2017

and thereafter he was been produced before the Hon’ble Special

Judge and the Hon’ble Judge was pleased to remand the Applicant

to Police Custody from time to time and thereafter the Hon’ble

Court has protected him in Judicial custody. Thereafter the

applicant filed the Bail Application and the Hon’ble court was

rejected the Bail Application.

THE GROUNDS FOR BAIL ARE AS UNDER

(a) That the Investigation agency has been reluctant to conduct

investigation and submit its report in time. They have not

filed the charge sheet in Court even after the completion

of statutory time period of 90 days.

(b) That the prosecution has drastically failed to put up their case

against the applicant as they have nothing materially to show

the involvement of the present accused in the alleged crime.

(c) That the abovenamed applicant was been arrested on 14th

October, 2017 and thereafter he was been produced on 14th

October, 2017 before this Hon’ble court and thereafter it was

been 90 days delayed by the investigation agency.

(d) The accused is not related to the above offences and he is

ready to furnish bail.

(e) Hence it is most respectfully prayed that this Honourable

Court may be pleased to release the accused on bail.

(f) That there are no reasonable grounds at the moment for

believing that the Applicant is guilty of an offence punishable

with imprisonment.

(g) That the accused is not likely to abscond as he has firm routes

in Mumbai. The accused is gainfully employed and he

undertakes not to tamper with the prosecution witnesses and

shall abide by every condition that may be imposed upon him

if enlarged on Bail.

(h) That the applicant is permanent resident of the address

mentioned above and he would provide sufficient surety to

secure his presence during the entire trial.

The Applicant therefore prays:

 (A) That this Hon’ble Court may kindly be pleased to enlarge

the present applicant on Bail in R. A. No. 314 of 2017 in

connection with C. R. No. 250 of 2017 lodged with Kurar

Police Station.

(B) That the Applicant may be released on Bail u/s 167 (2) of

the Cr. P. C. as the prosecution has been failed to file the

charge-sheet in 90 days.

(C) For such other and further reliefs as this Hon’ble Court

may deem fit and proper.

(D) In the alternative Cash Bail be allowed provisionally.

FOR THIS ACTS OF KINENESS, AS IN DUTY BOUND, THE

APPLICANT SHALL EVER PRAY.
