Scope of Buying This Catalogue is intended to form a rate contract with the buyer. The rates once finalized should be valid for a period of 15 Days.

Execution Location
Execution Lead time • The execution should be completed within 15 days from the release of the Sanction for lifting materials. Failing which the
party shall be penalized as per the Company’s rule.
Price Validity for • Price shall remain Firm & Valid for at-least a period of 15 days for placement

Change in Terms • Based on business exigencies JUSCO reserves the right to change anytime the

buyer.
Others Terms & • JUSCO will have the discretion to terminate the arrangement anytime by giving buyer an advance notice of 30 days.
Conditions. Termination could be on account of dissatisfactory service or violation of norms cited in this contract.
Payment terms • The entire amount has to be deposited in advance within 3 days of release of sanction for lifting materials through Demand
Draft / Banker’s Cheque in favour of M/s. JUSCO Limited and payable at Jamshedpur.
Site Visit • Buyer can visit the materials location any time before quoting the rate.
Arbitration Clause • In case of any dispute, where the settlement could not reached, difference between the parties arising out of or in
connection with this contract. (Excluding the matter of any interpretation of any clause (s) of the Contract, or any of its
terms or in the matter of any enforcement of any right or obligation, of the parties, where JUSCO’s decision shall be final and
binding on the contractor) the same shall be referred for arbitration to MD of JUSCO and who will appoint his nominee as
Sole Arbitrator. The award of the Arbitrator shall be final and binding upon the parties of this contract. Subject as aforesaid
the arbitrator conciliation Act 1966 and the rules there under and statutory modifications thereon in force may apply to such
arbitration proceedings under this clause. Cost of such arbitration shall be shared by the respective parties. During the
process of arbitration the contractors shall continue the work & will remain responsible/ liable for all causes. For JUSCO,
jurisdiction of courts shall be Jamshedpur/ court’s ruling Jamshedpur only.

 Indemnity BUYER shall undertake to fully indemnify JUSCO against all kinds off liabilities or damages, of whatsoever
Clause nature, arising due to reasons attributable to the supplier with respect to the supplies and under the
contract.
• Force Majeure shall include conditions which could not have been foreseen under normal
circumstances and beyond the control of the parties Viz. acts of God and Government but will
exclude causes like power breakdown/ shortages, strikes, accidents etc.
Force • Affected party will notify the other party immediately upon occurrence of any of such events, which
Majeure DIRECTLY has impact on works and submit details/ and mitigate and overcome effects thereof.
Clause. • In the event of Force Majeure conditions, neither of the parties will be entitled to any compensation
except that the JUSCO may at their sole discretion consider ‘extension in completion period’ as
deemed fit.

*All the customers will have a unique account number. The unique account number is an alpha numeric code consisting of 13
characters. The Customer’s unique “account number” is a combination of the MJ’ SAP code along with the 7 digit bidder SAP ID
and can be used as reference for all subsequent transactions. The Customer’s Account Number detail is available in “Profile” after
the customer logs into our website using the user id and password.

. EMD deposited by the H1 bidder as part of e-auction stands converted into Security Deposit for this contract and shall be retained till such time the sale order amount is
completely paid and on 100% completion of lifting the materials.

TERMS & CONDITIONS:

1. The materials will be sold on “as is where is” and no complaint basis. Bidders are advised to bid after proper inspection of the materials on the inspection
date & time.

2. All the lots are offered on stock basis only. Lot transfers will not be allowed.

3. Price to be quoted is basic ex-Jamshedpur exclusive of all taxes.

4. GST, TCS and any other statutory levies, as applicable, would be charged in addition.

5. Full Payment: Full payment of lot value is payable by the highest bidder within 3 days from offer letter issued. (The payment should be in the form of
DD/ Pay order only. “JUSCO Ltd” payable at Jamshedpur.) Any failure, the Security Deposit of Rs. 50,000/- will be forfeited.

Refund- within 10 days as soon as the DO/lot is closed, please intimate A/Cs Dept., JUSCO for refund if any.

6. Payment terms (payments in the form of DD/ Pay order/ RTGS only) & Lifting Terms.

 • The payment to be made within 3 working days from the date of offer letter and lifting is to be completed within7 working days from the date of order.

• Security Deposit will be refunded after successful completion of contract.

7. Loading/ dispatch of materials (scrap) will be done from morning 8.30 am to 4.00 pm. No scrap vehicle will be allowed to move out from JUSCO after 4.00
pm. The safety rule has to be followed during dismantling of the job.

8. In the event of breach of contract/ default towards meeting the payment terms, lifting terms, etc. as stated above, the security deposit shall be forfeited,
and the lot will be closed. For any dispute, JUSCO is the final authority.
9. All persons are required to wear helmet, safety shoes and hand gloves with safety training card before loading of scrap materials.
