Tutorial 1 – Week 2

INSTRUCTIONS:

1. Please form a group of five (5) members and appoint a group leader. (15 Min)
2. Submit the list of members’ name to the lecturer.
3. Please be seated according to the group.
4. Group Leader will take a poll for presentation slot and assignment’s question. (10
Min) – Conducted by the lecturer in charge.
5. Discuss the following question according to the number of the poll. (20 Min)
6. Ad Hoc presentation. (7 Min per group)

Question.

1. In some circumstances, it is prohibited (haram) to propose a woman a hand in


marriage. Discuss.

2. What is the legal implication when there is a breach of promise to marry?

3. Discuss the philosophy of marriage from Islamic point of view.

4. Who is a wali? Who is wali mujbir and what is the power given to wali mujbir?

5. What are the conditions of pronouncement (sighah) of ijab and qabul?

6. Mariam fell in love with Malik, her uncle’s son. Malik is a clerk in Majlis Bandaraya
Kuala Lumpur, felt inferiority complex to marry Mariam, a lawyer. In the meantime,
Mariam’s father wants to marry her with his doctor nephew, Zaki. He contended that
Malik is not suitable for her as he is not well educated and he is of the same blood
with her.
Mariam does not love Zaki and told her father that Zaki is not a good man and does
not carry out his duties as an obedient Muslim. She insisted to marry Malik instead
of Zaki. Advise her.

7. Marriage is prohibited permanently and temporarily. Elaborate.

Question 1
1. If a women is already engaged, it is not permitted for anyone else to offer the women
for marriage because of the Hadeeth of Ibn Umar which states that the Prophet said: “No
man should offer a proposal of marriage over the proposal of his brother until the first
one gives up or gives him permission.” Apart from that, any form of impediment against
the proposed marriage which exist under the Shariah will make a betrothal prohibited.
For instance, if a women is still in an existing valid marriage, or is observing her iddat
following a revocable or irrevocable divorce, or the death of her husband then she is not
free to betrothal with another man/ marry another man until the marriage is dissolved or
she has completed her iddat. This was mentioned in quran verse (4:24), (2:28), and
(2:234).
