Secretary General Banki-moon (Human rights Day 2014) proclaimed in his message that

“ human rights are for all of us, all the time, whoever we are and whenever we are from, no

matter our class, our opinions, our sexual orientation”. However, marriage rights especially

same-sex marriage has been a controversial issue for a long time. Some people think that the

legislation for same-sex marriage should be passed whereas some object to this. It is our firm

belief that same sex marriage should be legalised.

Everyone has rights to live, be free and pursue happiness. Therefore, right to love is one of

the most basic human rights of human being. All people deserve the rights of citizenship to love

anyone they feel affection regardless of their gender. No one even their parents or government

could prevent them from coming to each other. Clinton (as cited in Sherman, April 2015)

claimed that there was no doubt to recognize and treat every loving couple and family equally

under any circumstances. Moreover, according to Clinton people must respect equality right

instead of discriminating and segregating as the Court realized that if any groups were told apart,

it would make our struggle for a better union lag behind ( as cited in Sherman, June 2013).

According to Smart’s survey (as cited in Looking for Love in the legal discourse of marriage,

2014) which also contributes to equality rights, the statistic points out that the number of people

who back up for gay marriage increases twofold between 2001 and 2005. There were fourteen

countries including Uruguay, New Zealand and France which allowed same-sex couple to get

married in 2013 (Renata, 2014).

Some people who oppose to LGBTI community think that same-sex marriage is a new

concept. However, in fact, the nature of same-sex marriage is true love. As a matter of fact, the

affection of gay or les couple is perfectly idealistic love instead of hetersexual relationship

(Renata, 2014). Their relationship has got over heterosexism. As a result, Labor and Green (as
cited in Looking for Love in the legal discourse of marriage) aim to make out clearly love

relationship between same-sex couple. Moreover, Civil Union Bill ACT (2006) stated that

anyone can use civil union no matter what their gender is. Therefore, love along with civil right

is the thread connecting people in the community with each other irrespective of their

homosexuality.

It is believed that same-sex couples can do better in the parental role because there is no

evidence showing that the gender of parents can affect the ability to provide children with a

loving, caring and safe environment to develop completely. For instance, Butler (as cited in

Looking for Love in the Legal Discourse of Marriage, 2014) is one of many people who

indicates the take-off of non-traditional family models not only in homosexual families but also

in other cultures such as African American families in the US and Na families in China.

Albanese ( as cited in Looking for Love in the Legal Discourse of Marriage, 2014) said that he

had seen a lot of bad parents but he had not seen bad same-sex parents and every same-sex

couple he knew really wanted their child and loved their child. Empricial studies ( as cited in

Looking for Love in the Legal Discourse of Marriage, 2014) consistently show that there is no

negative effects on bringing up offspring in homosexual families.

Opponents of this view say that same-sex couples cannot have happy lives because they are

not able to have children by themselves. This point has some merits on the surface. However,

with the development of science, there are a various ways for same-sex couples to have children

such as baby cloning, artificial insemination, donors or surrogacy agreements ( as cited in

Looking for Love in the Legal Discourse of Marriage, 2014). Another key thing to remember is

that apart from scientific methods, the homosexual can adopt children who are street chidren,

abondoned in hospital or those in orphanages. This not only bring happiness to homosexual
families but aslo give unlucky nippers new hopes and new lives with love and protection. In the

United States, reseachers estimate that there are approximately 6 to 14 millions of children in

total living with at least one gay parent (Overview of Lesbian and Gay parenting) . In California,

lesbian and gay parents have adopted more than 16,000 children, which is the highest number in

the United States (Gary, Gates, Badgett, Chambers, Macomber, 2007). What is more, not all the

couples marrying longing for having children because they are infertile or because they want to

enjoy their lives with their life partners, spend all their time and all their love for their beloved or

travelling around the world together.

In a nutshell, despite the difference in tendency of gender, the homosexual are humans like

us. They also love, want to be loved and desire for happiness and fair. We should have a

subjective and dimensional view at this problem. Therefore, the right for homosexual to get

married should be legalized by government and recognized by the public.
