FACTS : Before this Commission is the Petition for Money Claim1 of Mr. Ronaldo V. Santiago,
Revenue Officer I, Bureau of Internal Revenue (BIR), Revenue Region (RR) No. 8, for payment
of his salaries and Personnel Economic Relief Allowance (PERA) for the period of October 1 to
December 31, 2015, in the total amount of P62,937.73.

For the period of October 1 to December 31, 2015, Mr. Santiago was deleted from the
payroll and was not paid his salaries and PERA due to lack of available leave credits as of
September 30, 2015 to cover his absences.

The Chief, Administrative and Human Resource, BIR RR No. 8, recommended the
payment of the claim of Mr. Santiago since he had already submitted his Daily Time Records for
the months of October, November, and December 2015.

On January 30, 2017, Mr. Santiago filed his Petition for Money Claim for the payment of
his salaries and PERA for the said period, in the net amount of P62,937.73.

ISSUE: The issue to be resolved is whether or not the Petition for Money Claim may be given
due course.

DISCUSSION: This Commission finds the money claim of Mr. Santiago meritorious.
As can be gleaned from the records, Mr. Santiago rendered services for the period of
October 1 to December 31, 2015. Thus, he should be rightly compensated for the same.
Mr. Santiago’s duly verified and certified DTRs clearly established that he had rendered
actual services for the period of October 1 to December 31, 2015, for which he is entitled to the
corresponding salaries and PERA
