EXTRAJUDICIAL SETTLEMENT OF ESTATE WITH

DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS;

This Extrajudicial Settlement of Estate with Deed of Absolute Sale entered and
executed this day of ______2019 at __________________Philippines by and among;

ALVIN S.GESMUNDO, Filipino, married to MONINA H. GESMUNDO, of legal age,with


resdidence at 683 J.P Coronado st. Nagcarlan Laguna;

MARICRIS D. GESMUNDO, Filipino, of legal age widow of ARDEN GESMUNDO,in her


own right and representation of their Filipino minor children, namely; (a)Joseph Ian Kirby D.
Gesmundo;(b) ma. Kristina Cassandra D. Gesmundo; and (c) Ma. Alessandra Gwyneth D.
Gesmundo, all with resdidence at 683 J.P Coronado st. Nagcarlan Laguna(hereafter,
collectively (“Heirs of Arden”);

MYRA S. GESMUNDO, of legal age, single with residence at 683 J.P Coronado st.
Nagcarlan Laguna;and

RISA GESMUNDO married to CARLO ESTRADA, both Filipino, of legal age, all with
residence address at 683 J.P Coronado st. Nagcarlan Laguna

( Unless referred to by name, the parties shall hereafter be referred to as the “Vendors” )

WITNESSETH, that:

WHEREAS, the vendors are the registered co-owners of a parcel of land situated at
Brgy. Yukos, Nagcarlan ,Laguna covered bt Transfer Certificate of Title No. 075-2016002192
(TCT-075-2016002192) consisting of THREE THOUSAND EIGHT HUNDRED EIGTHEEN Square
meters (3818 sqm), more particularly described as follows:

“A parcel of land ( Lot 2-Q of the subdivision plan (LRC) PSD-103884 being a
portion of Lot 2, describes on Plan PSU-8005, LRC (GLRO) Record No. 15195, situated in the
Barrio of Yucos,Municipality of Nagcarlan, province of Laguna. Bounded on the NW., and NE
Points 1 to 2 by Lot 2-P; on the NE., and SE., Points 7 to 13 by Lot 2-S; on the SW., and E.,
Points 13 to 17 by Lot 2-R; on the W., and SW., Points 17 to 21 by Lot 2-M; and on the NW.,
and W., Points 21 to 22 and 22 to 1 by Lot 2-L, all of the subdivision plan, Beginning at a point
marked “1” on plan, being S. 59 deg. 45’W., 399.85 M. From B.L.L.M 3, Nagcarlan Laguna:

containing an area of THREE THOUSAND EIGHT HUNDRED EIGHTEEN (3,818) Square meters,
more or less. All points referred to are indicated on the Plan are marked on the ground by
P.S. CYL. CONC.MONS. 15x60 CM; bearing true; date of the original survey, April 14-15,1916,
and that the subdivision survey, January 13-15,1969.

made an integral part of this instrument)
WHEREAS, ARDEN died intestate on March 22, 2017 at Community General Hospital,
San Pablo City, Laguna as shown by Certificate of Death, attached hereto as Annex “B”

WHEREAS, ARDEN is survived by his sole heirs, HEIRS OF ARDEN, leaving an inestate,
without a WILL and TESTAMENT and without any outstanding debts in favour of any person
or entity;

WHEREAS, at the time of his death ARDEN, was a co-owner in the property covered by
TCT No. 075-2016002192;

WHEREAS, pursuant to Rule 74 Sec. 1 of the Rules of Court of the Philippines, the Heirs
of Arden, represented herein by MARICRIS adjudicate among themselves ,ARDEN’s share in
TCT No. 075-2016002192;

WHEREAS, the above named decedent left to know no debt or no obligations which
remains unpaid and settled and chargeable against his estate;

FURTHER, FOR AND IN CONSIDERATION of the sum of ONE HUNDRED EIGHTY SEVEN
THOUSAND NINE HUNDRED FIFTY PESOS ONLY (P187,950) Philippine Currency, receipt of
which is hereby acknowledged, PAID TO US in hand by CONCHITA S. GESMUNDO, widower, of
legal age, Filipino Citizen, residence of 683 J.P Coronado st. Nagcarlan Laguna, ( VENDEE 1) we
do hereby SELL, TRANSFER, CONVEY, AND DELIVER, by way of ABSOLUTE SALE unto said
CONCHITA S. GESMUNDO her heirs, successors and assigns, TWO (2) PORTIONs of TCT No.
075-2016002192, particularly those denominated in the Subdivision Plan (attached and
marked as Annex “c” hereof) as (A) Lot 2-Q-3, with an area of One Hundred Forty Four square
meters (144 sqm) ; and (B) Lot 2-Q-4, with an area of Three Hundred Seven Nine square
meters (379 sqm) with following boundaries:

a. Lot 2-Q-3 b. Lot 2-Q-4


North: Lot 2-Q-8 North: Lot 2-Q-1/ Lot 2-Q-9
South: Lot 2-Q-7 South: Lot 2-Q-5
East: Lot 2-Q-7 East: Lot 2-Q-7

FURTHER FOR AND IN CONSIDERATION, of the sum of THREE HUNDRED THIRTY THREE
THOUSAND SIX HUNDRED PESOS (P333,600) Philippine Currency, receipt of which is
hereby acknowledged PAID TO US by SPOUSES DANTE STO.TOMAS FLORENTO and IVY
VALENZONA FLORENTO, both of legal age, Filipino Citizens, with postal address at 589
Irene Compound Brgy. Yukos, Nagcarlan Laguna, (VENDEE 2) we do hereby SELL,
TRANSFER CONVEY AND DELIVER, by way of ABSOLUTE SALE unto said VENDEE 2, their
Heirs, Successors and assigns, TWO (2) PORTIONs of No. 075-2016002192, particularly
those denominated in the Subdivision Plan (attached and marked as Annex” “hereof)
as (A) Lot 2-Q-1 with an area of One Hundred Thirty Nine square meters (139sqm); and
(B) Lot 2-Q-2, with an area of One Hundred Thirty Nine square meters (139sqm), with
the following boundaries:

(a) Lot 2-Q-1 (b) Lot 2-Q-2

sold and conveyed and further declare that the same is free and clear of all liens and
encumbrances of any kind whatsoever.
