Abstract

The way in which Traffic Police officers are practicing Bribery from the people which seems
to be Legal but we all know that there is Misuse of law by the officer in the name of Court
Proceeding Fear. Traffic officers are taking huge advantage of this fear and earning for
themselves by wrong means but pretending to do Legal Practice .
Uniformity in fines through E-chalaanshould be imposed. Instead of earning from the people,
government should have permanent solution and rapid solution to overcome road problems.
Special Centre should be made so that we can approach directly if we face any problem by
government officers with wrong intension.
TrafficPolice as a Law enforcing agency is an important institution and is an integral part of
the present day society. A society in the present set up cannot live and progress without an
effective, sincere and honest police force.
Corruption exists in one form or the other in the police system. Corruption has
infected every sphere of modern life. It has vitiated the moral values of the society and the

police force cannot be an exception. In fact, corruption of Traffic police is not a new
phenomenon, but the irony is that the issue has seldom been seized by the organization with a
sense of seriousness. In this paper an attempt has been made to discuss Corruption done by
Traffic police in India.
I have suggest some remedies to control the corruption among Traffic policemen. The
main objective of the paper is to discusscauses and remedies of traffic police
corruption .The basis of the discussion is from secondary sources like police commission
reports, books, magazines, news paper, and other sources.

INTRODUCTION

Traffic police corruption is a form of traffic police misconduct in


which law enforcement officers end up breaking their political
contract and abuse their power for personal or departmental gain.

“A bribe is never demanded directly by the traffic cops; there are


hints thrown in and the motorist then has to haggle over the sum,”
In the name punishment, a person is asked to sit several hours in police
station and tortured in the name of Documents.“This is exactly how
citizens who refuse to pay bribes are punished,”

 The study was conducted by Centre for Media Studies and MDRA at transport
hubs including Ludhiana, Delhi, Ahmedabad, Indore, Mumbai, Kolkata, Vijaywada,
Bangalore and Chennai.

The study estimated the total bribe on roads to be close toRs 22,000 crore every year.

Traffic Police allegedly collects around Rs 25,000 to Rs 30,000 per month for running
ready-mix cement vehicles, sand, bricks, and other construction material vehicles.
For each over-loaded sand truck the amount of Rs 3,000 to Rs 4,000 is allegedly taken
by the Traffic Police.
For illegal school vans or buses, the Traffic Police allegedly take Rs 1,000 to Rs 2,000
per month.
The Traffic Police also allegedly takes Rs 5,000 to Rs 10,000 per month from malls,
hotels, beer bars, marriage halls, etc for allowing illegal parking of vehicles on the
road.
Towing van contracts are given to private operators. The Police Constable, who
generally remains on the towing vans allegedly takes money from persons, and
vehicles are released immediately after towing. On each such towing, the concerned
police constable allegedly gets Rs 20 per vehicle and the remaining amount allegedly
goes to the Senior Inspector of Police of the concerned Traffic Police chowky.
Cops allegedly collect Rs 40,000 to Rs 50,000 per month from three-star, four-star, and
five-star hotels for allowing illegal parking on the busy road. Hundreds of illegal taxis
and rickshaws, among others, ply in Mumbai, however without prosecuting them, the
Traffic Police allegedly charge Rs 1,000 to Rs 2,000 per month illegally from each
taxi/rickshaws.

STEPS THAT MUST BE TAKEN TO AVOID CORRUPTION BY

 Creation of an email ID on which the public can send complaints against the traffic
police.

 CCTVs should be installed in a phased manner at major traffic intersections.

"All these cameras must be connected to the traffic control room and also to
the office of the joint commissioner of police, traffic department. The activities of all traffic
police personnel at various locations, including intersections, will be continuously monitored
in the control room minutely and whenever any suspicious activity is noted immediate action
will be taken,"

 In order to minimise cash handling by the traffic police personnel, a cashless system
of collecting fines and penalties through e-challans must be introduced .

The introduction of e-challan has wiped out the old cash collection system. This has left less
scope for the enforcement personnel to get involved in illegal activities,"

between the policemen on road and traffic violators.

RESEARCH PROBLEM

1 Awareness about traffic police corruption.


2.Is this a one of the profitable business for the traffic police today?
3.Whether police is misusing the law?
4.Is there any permanent solution for these problem?

HYPOTHESIS

According to me there must be some permanent solution of these problem created by


government officers and misuse of these law must be stopped.
Instead of finding solution to the problem, government is taking advantage of the
public fear towards police and punishment by police. It has become the major source
of earning by government from people. Government is made by people, so they must
not find new ideas for earning from there own people.

METHODOLOGY

The Methodology adopted for this Socio-Legal research is Doctrinaire and Empirical. The
issues are analyzed in the lights of social, political and legal issues. The data is collected from
primary as well as secondary authoritative sources. The research design is formulative or
Exploratory.

OBSERVATIONS:
1) 60% Agreed that they have faced the problem by traffic police and it’s Corruption.
40% people have not faced such type of problem.

2) Out of 60% people, 28% have given proper fine.


30% tried to conveyed officer by giving low fine without receipt.
38% people wanted to complain higher authority but couldn’t complaint because of
lack of requirements to satisfy police officer.
4% given the demanded fine, avoiding Court Proceedings.

3) 56% people agreed that government and police are misusing the law.
24% disagreed.
20% said that only police ia misusing the law.
4) 8% Said that taking fine is permanent solution to this problem.
60% said that taking fine is not permanent solution.
32% said that fine must be imposed but there must be permanent solution to this
problem.

5) 90% people said that E-challan must be imposed.


10% disagreed with E-challan imposition.

6) 52% agree with my suggestion that government should take


48% were agreed with some suggestions and No one disagreed with my Suggestion
for improving the situation.

CONCLUSION

The problem created by government officers and Bribery System must be must be
ended with some permanent solution.
Few steps must be taken i.e

 Creation of an email ID on which the public can send complaints against the traffic
police.

 CCTVs should be installed in a phased manner at major traffic intersections.

 In order to minimise cash handling by the traffic police personnel, a cashless system
of collecting fines and penalties through e-challans must be introduced .

 body-worn cameras on a pilot basis which will record (audio and video) all
communications between the policemen on road and traffic violators.
