COUNTER AFFIDAVIT

I Arnel S Gumanao, of legal age, Filipino, single, and residing at JD-233, Buyagan, La
Trinidad, Benguet, in answer to the complaint for murder filed against me by Alvin Lee A Ordillo for
allegedly killing his brother on February 14, 2018, hereby states under oath that:

1. I am currently enrolled at CCDC College of Law for the second semester of SY 2017-2018
and that Mr. William Jake Balong-angey and Ms. Emereta Ventura are my classmates;

2. Ms. Emereta Ventura was my former girlfriend and after our break up, I already accepted the
reality that maybe we are not meant for each other so I moved on and now, I have a new
girlfriend prettier than her;

3. On February 12 to 15, 2018, we had vacation with my new girlfriend at Hongkong so I was
absent in school that week and it is impossible for me to be in La Trinidad or somewhere in the
Philippines on those days. This is evidenced by my passport, pane ticket, and boarding pass
hereto attached;

4. Sometimes in December 2017 in CCDC, we had an altercation with Mr. William Jake Balong-
angey when I refused to lend him money for his tuition fee that resulted to his failure in his
subkects when he was not allowed to take the final exam for December 2017. Maybe this was
the reason why he is indicting me of a crime for which I am innocent with;

5. I do not know personally the complainant Mr. Alvin Lee Ordillo and Mr. Crame Peckley who is
one of the witnesses. They only identified me through my picture in the cellphone of Mr.
William Jake Balong-angey. I strongly believed that it was Mr. William Jake Balong-angey who
insisted to them and made them believe that the person who stabbed John Ordillo is me;

6. I am executing this affidavit to attest the truthfulness of the foregoing statements praying that
the case of murder filed against me be dismissed taking into consideration the above-
explanations.

A: To give my statement and file a complaint in behalf of my family against Arnel S Gumanao who
killed my brother John Ordillo y Angiwan in the evening of February 14, 2018 along Balili Road, La
Trinidad, Benguet.

04.Q: Did you personally see Mr Arnel S. Gumanao kill your brother John.
A: No sir.

05.Q: How were you able to know that Arnel S. Gumanao was the one who killed your brother?
A: Based on the result of your investigation and the testimony of his classmate William Jake Balong-
angey, and the testimony of Crame L. Peckley who reported the incident to the police.

06.Q: What was the cause of the death of your brother?

A: Due to a stab wound on his back that damaged his kidney.

07.Q: Do you have a copy of the death certificate of your brother for evidentiary purpose?
A: Yes sir

08. Q: Do you know personally Mr. Arnel S. Gumanao?

A: No sir. I just heard about him after the death of my brother.

03.Q: What prompted you to come before this police station?

A: To give my statement on what I saw regarding the stabbing incident that has just transpired a
while ago along Balili Road, La Trinidad, Benguet.

04.Q: Where were you when the stabbing incident happened?

A: I just ferried my girlfriend at Central Balili, La Trinidad, and I was walking along Balili Road going
to Km 5 highway.

05.Q: What happened while you were walking along Balili Road?
A: I was about to pass by three male persons walking opposite my direction when the one in front
suddenly fell to the ground. While the person just behind him was pulling a blooded knife stabbed
at the back of the person who fell.

06.Q: What did the person do after pulling a bloody knife at the back of the one who fell?
A: He ran towards km5 highway

07.Q: What was your distance from the three persons your about to pass by?
A: Three to five meters sir.

08. Q: Was there light in that place?

A: Yes sir. It was lighted by street light.

09. Q: How about the third person, what did he do after the incident?
A: He stayed so I assisted him in boarding the person stabbed to a taxi which happened to passed
by. He brought his wounded companion to Benguet General Hospital while I dropped by this
police station to report the incident.

10.Q: Can you recall the person who stabbed the victim?
A: Yes sir, I cannot forget his face.

11.Q: Showing to you a picture from this cellphone of William Jake Balong-angey, the one you assisted
in bringing the victim to the hospital, can you recognize this picture?
A: Yes sir, the picture is the same with the person who stabbed the victim

while ago along Balili Road, La Trinidad, Benguet.

04.Q: Do you know the person stabbed?

A: He is John A. Ordillo

05.Q: How about the person who stabbed?

A: He is Arnel S. Gumanao. They are both my classmates in CCDC.

06.Q: Where are you during the stabbing incident?

A: I was with John Ordillo and Arnel Gumanao walking along Balili Road towards Central Balili, LTB.

07.Q: Where did you come from?

A: We came from Sab-atan Bar and restaurant at km 6, Betag, La Trinidad for a drink.

08. Q: What do you think is the reason why Arnel Gumanao killed John Ordillo?
A: I don’t know sir but after our class today, Arnel Gumanao invited me and Joel Ordillo for a drink.

09. Q: What did you observe about Arnel Gumanao during your class?
A: He was silent and uneasy, seemed to be out of his mind.

10.Q: What did you do after having a drink at Sab-atan?

A: Arnel Gumanao insisted to ferry John Ordillo going home at Balili, La Trinidad so I accompanied
them.

11.Q: Did you ride a taxi in fetching John Ordillo?

A: No sir. We boarded a jeep up to km 5, then we walked going to Balili.

12.Q: What happened while on your way going to Balili?

A: I was behind the two when I saw Arnel Gumanao brought out a knife from his waist and stabbed
the back of John Ordillo,

13.Q: What did Arnal Gumanao do after stabbing John Ordillo?

A: He ran towards km 5.

14.Q: How about you?

A: I brought John Ordillo to Benguet General Hospital with the help of a passerby who is within this
police station today.

15.Q: What happened when you arrived at the hospital?

A: John Ordillo was declared dead on arrival by the attending physician.

16.Q: Do you know where Arnel Gumanao is now?

A: No sir. He cannot even be contacted through his cellphone.

17.Q: Do you have a picture of Arnel S Gumanao with you now?

A: Yes sir. I have in my cellphone.

A: Yesterday at around 5:30PM while we were in school, Mr Arnel S. Gumanao approached me
angrily and told me that he was jealous with John Ordillo and threatened to kill him if I will not
break up with him.

05.Q: Are John Ordillo and Arnel Gumanao your class/schoolmates in CCDC?
 A: Yes sir

06.Q: Why do you think that Mr. Arnel Gumanao is jealous with John Ordillo?
A: Because it was John Ordillo whom I accepted as boyfriend instead of him being my long time
suitor since 2015 while we were first years.

A: It was just in the evening of February 13, 2018 sir.
