” on the topic “The principle of Inheritance Under Customary and Islamic
Law”. This project is given by our honorable subject professor “Dr. Deo
Narayan Singh ” and first of all I would like to thank him for providing me such
a nice topic and making me aware as well providing me a lot of ideas regarding
the topic and the methods to complete the project.

desired books regarding the topic as the whole project revolves around the

INTRODUCTION

The Hindu Succession Act, 1956, deals with the inheritance to (a)the separate
properties of Mitakshara male, (b) to the separate and coparcenary properties
of Dayabhag male, and (c) to the undivided interest in the joint family of a
Mitakshara coparcener, who dies leaving behind a widow, mother, daughter,
daughter’s daughter, son ‘s daughter, widow, grandson’s daughter, grandson’s
widow, or daughter’s son. The Act does not apply to the property of a Hindu
who is married under the Special Marriage Act, to estate which descends to a
single heir by the terms of any covenant or agreement entered in to by the
Ruler of any Indian State with the Government of India or by the terms of any
enactment passed before the commencement of the Hindu Succession Act and
to the Valiamma Thampura Kovilagam Estate and the Palace Fund of former
Cochin State. (This clause has become redundant after the Kerala Act 16 of
1961).
