Dear Me. Minsky:
1 am writing in response to your March 21, 2019 request for records from the City of Mendota
Police Department pursuant to the California Public Records Act, Government Code § 6250 et
seq.
Your request seeks “[a)ny and all records of communication between the Mendota Police
Department and the Santa Maria Police Department including, but not limited to, electronic mail
(e-mail) communication, text messages, and phone eall records, between January 1, 2014 and up
to [the] date of satisfying this request.” The request also states that you “believe [these reconds]
tobe held by the Santa Maria Police Departmen.”
Initially, it should be noted that an agency is only obligated to disclose public records “in the
possession of the agency” to which the request is made, (Govt. Code § 6253, subd. (¢).). Thus,
to the extent your request seeks records “held by the Santa Maria Police Department,” the City
has no records to disclose.
Nevertheless, in an effort to assist you in making an effective request, we will construe the
request as seeking records held by the City of Mendota Police Department,
‘The City has performed a search for records responsive to the request, as constiued, aud
responsive records have been found. However, the responsive records are not subject disclosure
pprsuant to Government Code § 6254(). (See Haynie v. Superior Court (2001) 26 Cal.4th
1061.) Accordingly, no records will be produced or made available for inspection.
