OBLIGATIONS OF THE USUFRUCTUARY

(Art. 583 – 602)

3 Stages

1. required at the commencement of the usufructuary

2. required during the life of the usufruct
3. required at the termination of the usufruct

1st Stage: In general, the usufructuary is obliged to:

a. make an inventory of all the property covered by

the right of the usufruct
b. to give security or bond

N.B. These are not conditions sine qua non for the
effectivity or commencement of the usufruct.
However, the usufructuary may not possess and
enjoy the property unless these obligations are
complied with.

Failure to comply with the foregoing obligations will

only prevent him from exercising his right of
usufruct but not the termination of the usufruct
