PROTECTING ENVIRONMENT FROM RADIOACTIVE POLLUTION- A STATUTORY FRAMEWORK

Abstract

Environmental law is not a specific branch of law rather it can be considered as an


amalgamation of different statutory provisions. It is the law which is concerned with
environment, environmental problems and the protection of environment. The development
of environmental law can be traced back from the Common Law where nuisance was
considered as a civil wrong and also as an offence when affecting the public at large. It is a
vast area of law that operates from the municipal to the international law, involving a range
of different legal and regulatory provisions and measures. In theory, environmental protection
is obvious and ethically desirable because it is considered as one of the basic requirement of
every human being to live in a healthy environment. Yet, in practice, the concept is totally
different in reality as the environmental law is a messy and complex business fraught with
conflict. In the recent times pollution is considered as one of the vital problems and talking
more specifically about the man made pollution, it is ultimately leading to the dawn of
humans itself. there are various reasons to it but the more specific reason is population
growth as the world has faced the tremendous change in population in last 200 years from 1
billion to 7 billion according to the report of United Nations. There are various kinds of
manmade pollutants in environment but in this paper we are going to analyze the effect of
radioactivity on mankind and the legal frameworks for controlling the activities consisting of
radioactive waste and radioactive pollution all across the globe. The reason to analyze the
problem is very obvious as the whole of the world community is considering the other kinds
of pollutant like plastic, carbon mono oxide and other noxious gases but no one is focusing
primarily on the radioactive waste and disasters as the world has faced a lot in Fukushima,
Chernobyl and Nagasaki.
